1 BOARD OF COUNTY COMMISSIONERS MINUTES OF PUBLIC HEARING White Dove, LLC Commissioner Absent: Chairman Marc Eberlein, Commissioner Chris Fillios and Commissioner Bob Bingham Staff Present: The purpose of the meeting was for the Board to conduct a public hearing as advertised in the Coeur d Alene Press. Chairman Eberlein called the hearing to order at 9:00 a.m. The members were polled for conflicts of interest. No conflicts were expressed.. Case No. ZON , a request by White Dove, LLC, for a Zone Change from Rural to Light Industrial on approximately acres of land. The subject parcel has an existing residence and outbuildings. Access to the property is from N. Pope Road, a public road maintained by the Lakes Highway District. The parcel number is 52N04W and described as: S2-SE E OF HWY EX S 660 FT & EX TX#S EX RW, S 66 FT-N2-SE E OF in Section 24, Township 52N, Range 04W B.M. Kootenai County Idaho. The Hearing Examiner held a public hearing on September 6, 2018 and recommended approval. The Board held a public hearing on November 8, 2018 and unanimously approved the request. (Vlad Finkel-Planner) Staff Presentation: Vlad Finkel, Planner, introduced the zone change application stating this request was heard before the Board on November 8, 2018 and was unanimously approved. Following the Board s decision, Community Development discovered that due to a clerical error, the November 8, 2018 Board hearing was not published in the Coeur d Alene Press. This failure to notice prompted a second public hearing according to Kootenai County Code Title 8, Section Mr. Finkel reiterated the location and details of the request which prompted no further concerns from the public or public agencies. Applicant Presentation: Rand Wichman, Applicant Representative, stated it was not necessary to recall of the details of the previous hearing. He was pleased that the error in noticing did not create unknown opposition. Exhibit: B 2000 Presentation submitted by Vlad Finkel. Public Testimony: Comment Sheets submitted: 1. Applicant Representative 1; In Favor -0, Neutral 0, Opposed 0. There were no public in attendance. Rebuttal:. Motion by Commissioner Fillios seconded by Commissioner Bingham, to close the public hearing and enter into deliberations at 9:06 a.m. Deliberations: Chairman Eberlein stated he appreciated that staff came forward with the error and this hearing would correct the error. The Board had no concerns regarding this application request. Motion by Commissioner Fillios, seconded by Commissioner Bingham, to approve the zone change from Rural to Light Industrial as recommended by the Hearing Examiner and supported by the Conclusions of Law and Findings of Fact for ZON White Dove, LLC.. Chairman Eberlein called the hearing to order at 9:07 a.m. The members were polled for conflicts of interest. No conflicts were expressed.. Case No. ZON , a request by Peck & Peck Excavating to complete a Zone Change of three (3) parcels from Agricultural to Light Industrial totaling approximately 29 acres. The purpose of this request is to potentially construct a main office building and storage yard for Peck & Peck Excavating and other industrial uses. According to the Applicant, the site was previously used as a dirt racetrack; however, there is no evidence of that use on the site today. The subject parcels are bordered by parcels zoned Light Industrial, Commercial w/conditional Zoning Development Agreement and Agricultural. Access to the subject parcels is via W. Bedrock Road (within public right-of-way), a privately maintained road from Beck Road, a public road maintained by the Post Falls Highway District. The property is located within the shared tier of City of Hayden, Rathdrum and Post Falls Area of City Impact. The parcel numbers are AA, ZZ and AA. The parcels are described as: Parcel 1: EAST FARMS IRR TRS PLAT 5, TR 145 EX RW; Parcel 2: EAST FARMS IRR TRS PLAT 5, TR 152; Parcel 3: EAST FARMS IRR TRS PLAT 5, TR 158 & PTN VAC RW; all parcels located in Section 01, Township 50N, Range 06W B.M. Kootenai County Idaho. The Hearing Examiner held a public hearing on September 6, 2018 and recommended approval. The Board held a public hearing on November 8, 2018 and unanimously approved the request. This prompted the second hearing according to Kootenai County Code Title 8, Section Mr. Finkel reiterated the location and details of the request which prompted no further concerns from the public or public agencies. 5 Minutes Date: Lone Mountain Estates 2 nd Addition MSF David Callahan, Clif Trimble, Kathryn Ford Case No. MSF , Lone Mountain Estates 2 nd Addition, a request by Big Sky Capital, Inc., for final approval of an 18 lot Major Subdivision with 2 non-residential Tracts, across two parcels totaling approximately 190, in the Rural zone. Each newly created lot will meet the minimum lot size for the Rural zone. Access to the lots will be from E. Diagonal and Spire Road, via extensions of Massif Road. The subject Parcel Numbers are: 52N04W and 52N04W and described as: W2-SW-NW, W2-E2-SW-NW in Section 01, Township 52 North, Range 04 West, B. M. Kootenai County, Idaho and Parcel Number 52N04W is described as: N2-S2 LYING SE OF RW, in Section 02, Township 52 North, Range 04 West, B. M. Kootenai County, Idaho. Lone Mountain Estates 2 nd Addition was preliminarily approved by the Board of County Commissioners on March 1, The Board held deliberations on December 13, 2018 and unanimously approved the request. Motion by Commissioner Fillios, seconded by Commissioner Bingham, to approve and execute the signing of the Order of Decision for MSF Lone Mountain Estates 2 nd Addition.
