1 AGENDA August 1, 2017 Regular Meeting of the Hazlet Township Committee held at 8:00 p.m. Salute to the flag and moment of silent prayer called by the Mayor. Mayor s Statement Open Public Meetings Act & Emergency Fire Exits. In Compliance with the Open Public Meetings Act of the State of New Jersey, adequate notice of this meeting of the Township Committee was provided in the following manner: (A) On January 3, 2017, advance written notice of this meeting was posted at: 1766 Union Avenue, Hazlet, New Jersey. (B) On January 3, 2017, advance written notice of this meeting was forwarded to the Independent and Asbury Park Press. It was also published in the Asbury Park Press on January 5, (C) On January 3, 2017, copies of advance written notice of this meeting were mailed to all persons who requested and paid for such notices on or before January 1, Time will be allotted for public comment at this meeting. Each speaker will be allotted a 5 minute time limit when recognized by the Mayor. Individuals wishing to address the Committee shall be recognized by the Mayor and shall give their name and address. Although the Township Committee encourages public participation, it reserves the right, through the Mayor, to terminate remarks to and/or by an individual not in keeping with the conduct of a proper and efficient meeting. The Township Committee will not during the public portion of this meeting discuss matters involving any specific, prospective or current employee. FIRE EITS are located in the directions I am indicating: Farther down at the end of the room, through the doors and down the stairs, directly out the front door. To my right is the door, make a right down the hallway which leads to the stairs and directly out the rear of the building. If you are alerted for fire, please move in a calm and orderly manner to the nearest exit. Finally, let the record reflect that the minutes of this meeting will accurately reflect the topics addressed during this meeting but will not be a verbatim transcript of tonight s proceedings. 3 Charles Hoffman- Is this is an extension of a program where you are trying to redevelop and you would give tax abatement to someone who came in to redevelop is that the idea? Mayor Kiley- Correct. Mr. Hoffman- This is an extension. Mayor Kiley- It is making some clarification to the ordinance making it more clear what that tax abatement is. Mr. Hoffman- Is the program for residential tax abatement for building improvements still in affect? Mayor Kiley- Yes and that is totally different. Mr. Hoffman- When you are talking about abatement are you talking about total or a percentage. Mayor Kiley Yes it would be a percentage of abatement on their improvements to the structure and the amount of tax they would pay would graduate over a period of years to the full amount. POLICE DEPARTMENT June 2017 Total Calls Handled 2,291. Resolutions, Motions and Appointments: Resolutions #179 through #183 are by Consent Agenda. All matters listed under Consent Agenda are considered to be routine by the Township Committee and will be enacted by one motion. There will be no separate discussions of these items. If discussion is desired by the Mayor or any member of the Township Committee, that item will be removed and will be

4 considered separately. Advance copies of each resolution have been given to each Committee Member. The original resolutions are with the Municipal Clerk for inspection as listed below Issuance of Raffle License RL-4129 to Special Teens and Adult Recreation Supporters Refund of monies to Esmeralda Paris for CIT registration fee Refund of the overpayment of landlord fees to Michael Hanus Refund of monies to Sue Conanan for Soccer Camp prior to camp starting Refund of Swim Club Fees for Kathe Keusch. PUBLIC HEARING Anyone who would like to address the Township Committee regarding the below listed Resolutions on the Agenda, please come up, print your name and address on the sign in sheet. There is a five (5) minute time limit. No participant may speak more than once on the same topic until all others who wish to speak on that topic have been heard. No one spoke at hearing. 5 Introduction of a Redevelopment Plan: 1. INTRODUCTION OF REDEVELOPMENT PLAN HAZLET TOWN CENTER REDEVELOPMENT PLAN, BLOCK 239, LOTS 1 AND Title read by: Deputy Mayor Aagre Hearing Date: August 15, Offered Deputy Mayor Aagre Citizens Hearing: There is a five (5) minute time limit. No participant may speak more than once on the same topic until all others who wish to speak on that topic have been heard. Maureen Miller- Can you explain what the Introduction means? Mayor Kiley There is a Re-Development plan that has been submitted by the builders for that K-mart Pathmark plaza and it gets evaluated and voted on whether we approve or not. If you would like a copy of that you can request it and we can give you a copy. We don t really discuss it until the hearing. Deputy Mayor Aagre- It is similar to the project in Middletown where Livoti s and Apple Bee s is where they did a face lift and a few new stores. Here they are looking to improve the parking lot and another restaurant, convenience store/gas station. It is an improvement to the current shopping center. Ms. Miller- On Middle Road you guys have nothing to do what is happening there but do you know what is happening there? Mayor Kiley- The Board of Education owns that property and from what I have been told (hopefully it is accurate) they are expanding the parking lot that is desperately needed for Middle Road School and then putting back the basketball courts. Deputy Mayor Aagre- There was a couple of options, one I guess they are going with is the basketball courts have been removed and they are putting additional parking in the front and where the old town hall was there is going to be basketball courts and some other park equipment.

6 Charles Hoffman- These lots 1 and 1.01 this is where I was told that actually each one of those buildings K-Mart and Pathmark where separate entities in themselves as far as property taxes and so forth were concerned, correct? Attorney Gorman- That was correct. At the present time there is one owner of all that property. Mr. Hoffman- The whole thing or just those 2 pieces? Attorney Gorman- The present owner of the property as I understand it owns Fridays, all the components of the shopping center and the bank. Mr. Hoffman- When you make reference to the Hazlet Town Center is this Re-Development going to rename this? Mayor Kiley- I don t think a renaming issue has come up yet. It is more of what they are planning on doing with that plaza to improve it. Attorney Gorman- The developer can call it whatever he wants. Mr. Hoffman- I understand that was just wondering if it was part of the overall equation that is all. Attorney Gorman- I think that is what they are choosing to call it. Deputy Mayor Aagre- The developer is choosing to call it that. Mr. Hoffman- We still have everything remaining next to the old Bradlees building it still has not been removed. Administrator Pino- I checked up on that about three weeks ago with the engineer and we did not get a response from the DEP or the owner of the property on any of that. Mr. Hoffman- Any movement on LED Street lighting? Administrator Pino- Waiting on JCP&L to do a complete inventory on every fixture we have. I think every town in Monmouth County is now asking for the same. Mr. Hoffman- I have some strong thoughts on replacing ordinance 723 or whatever the right number was about the administration of Deputy Mayor Aagre-Mobile Home Parks 273. Mr. Hoffman- Trailer Parks, excuse me. Is this the first time that the verbage COAH overlay the trailer parks has become a fact of life in writing? Attorney Gorman- Our Mobile Home Parks are not part of our COAH plan because they are not recognized as being eligible units at COAH.

7 Mr. Hoffman- I understand but I believe the intent of that item of the Land Use thing was that this is something that could be done in relation to the real estate involved. Is this the first time that this has ever come to light in all honesty? Attorney Gorman- I am not sure what your question is but the township would love and has advocated from the beginning that the Mobile Home Parks count toward our Affordable Housing Obligation. Deputy Mayor Aagre- In the Master Plan Overlay is there a portion of that. Committeeman Glackin- It is not the first time. It has come up it has been introduced a couple of different ways. Mr. Hoffman- You say you have submitted plans and I appreciate that fact but because there is no ruling have you been able to pressure any of these developers to put COAH into their units? Mayor Kiley- Yes absolutely. Mr. Hoffman- The gentleman is clearing the property next to Walgreens and I forget the number of units involved. Mayor Kiley- He has six affordable. Mr. Hoffman- he is bound to do that? Mayor Kiley- Absolutely. Mr. Hoffman- This idea of widening that piece of road. Attorney Gorman- They have approvals and whatever those approvals say that is what they are required to do. Mr. Hoffman- Is there still not easement? Isn t there always easement from the center of the road to a certain extent? Deputy Mayor Aagre- Right of Way it is 10 foot from pavement to property line could be more depending on the area. Mr. Hoffman- Could this be used for a way to try and widen that out get some more traffic signs in there. Deputy Mayor Aagre- 10 feet is a requirement of certain grass area, sidewalk and a buffer between the property lines. In that 10 feet it is typically 4,5, and 2 or something like that so it eats up. If we took that away and brought it to the property line then those elements would have to be on their property which of course is not part of their approval. Mr. Hoffman- What you are saying is easement is easement but it is there not necessarily for road expansion but it is there for curbing.

8 Deputy Mayor Aagre- No easement if it was part of road expanding it would be on a map and it would be a dedicated width part of whatever sale of the property. It was not there at the time of this purchase or planned. Mr. Hoffman- I greatly appreciate the fact that you have decided according to Mr. Pino to expand the flag program and that you did see fit to include Florence Avenue on it. Etiquette says if you put them up they have to be lit up at night. Are you going to reinstate the program overall? I think it is something you should think about I realize it costs money but it is really something. Mayor Kiley It is something that we are going to discuss. You are right it does cost money and those plaques people wanted plaques put up in memory of loved ones but plaques start to get tarnished. If residents wanted to participate in this and replace those and replace those flags then it is something we can manage the cost of. There is some discussion about it that we have to have. Mr. Hoffman- My other community pride have you spoken to the owner/ operator of Dunkin Donuts? Mayor Kiley- No I have not but I will follow up.
