5 Unofficial Translation/GMAC Ministry of Commerce No. 222 MOC Kingdom of Cambodia Nation Religion King Prakas On Creation of Committee for Control of the Use of Invoice for Self-Certification of Origin of Goods Senior Minister, Minister of Commerce - Having seen the Constitution of the Kingdom of Cambodia - Having seen Royal Decree NS/RKT 0913/903 dated 24 September 2013 on Appointment of Royal Government of the Kingdom of Cambodia - Having seen Royal Code 02/NS/94 dated 20 July 1994 promulgating the Law on Organization and Functioning of the Council of Ministers - Having seen Royal Code NS/RKM/0196/16 dated 24 January 1996 promulgating the Law on Establishment of Ministry of Commerce - Having seen Sub-decree 131 OrNKr.KB dated 19 March 2014 on Organization and Functioning of the Ministry of Commerce - According to the Decision of the ASEAN Leaders on Simplification and Subsequent Improvements of Procedures of Issuance of Certificate via electronic system in According to the Decision on Appointment of National Representative for the ASEAN Policy- Security Community Council, ASEAN Economic Community Council and ASEAN Social-Cultural Community Council on 18 October Notification 999 dated 14 July 2014 of the Royal Government Decide Article 1 The Committee for Control of the Use of Invoice for Self-Certification of Origin of Goods shall be created with its abbreviation as CCUI (គ.គ.វ.ប). Article 2 This Committee is created for the purpose of promoting the implementation of procedures of the rules of origin through the use of invoice for self-certification of origin of goods, aimed at facilitating the trade of goods which originates from ASEAN and Cambodia in line with the purpose of implementing the plan of ASEAN Economic Community to be successful and implement trade facilitation in the world framework. 6 Unofficial Translation/GMAC of Ministry of Commerce 7- Mr. Ho Siv Yong, Director of Import-Export Department of Ministry of Commerce 8- Dr. Song Vintak Director of Department of International Cooperation of Ministry of Health 9- Mr. Om Dararith, Director of Department of Commercial Registration of Ministry of Commerce 10- Mr. Kong Ratha Director of Department of Economic Integration and ASEAN of the Ministry of Commerce 11- Mr. Aun SoKhorn Deputy Director of Private Sector Development of Ministry of Commerce 12- Mr. Ros Dara Deputy Director of Planning, Technical Affairs and International Cooperation of General Department of Customs and Excise 13- Mr. Heng Chhunhy Deputy Director of Protection of Crops, Hygiene and Phytosanitary of Ministry of Agriculture, Forestry and Fishery 14- Mr. Suon Sothoeun Deputy Director of Department of Production and Livestock Treatment 15- Mr. Ki Senghor Deputy Director of Department of Small and Medium Enterprise of Ministry of Industry and Handicraft 16- Mr. Chuon Sokchea Deputy Director of Department of International Cooperation and ASEAN Affairs of the Ministry of Mines and Energy 17- Mr. Hing Tun, Deputy Director of Department of Mines and Construction of Ministry of Mines and Energy 18- Mr. Ok Sophal Vice Director of Department of Medicine, Medical Equipment, Makeup and Food of the Ministry of Health 19- Mr. Uy Khema Head of Bureau of Information and Wrap-Up of the Ministry of Industry and Handicraft 20- Mr. Bun Chamroeun Head of Bureau of Directorate-General of Camcontrol 21- Mr. Un Chantha Head of Bureau of Inspection and Registration of Ministry of Commerce Secretary Article 4 The Committee for Control of the Use of Invoice for Self-Certification of Origin of Goods has the following duties: - Prepare various conditions in accordance with the Rules of Origin in the framework of ASEAN and the world which is determined by trade partners for a basis in evaluating and choosing producers or exporters who are qualified and eligible for using invoice for self-certification of origin of goods. - Conduct a visit to production base to evaluate the qualification in accordance with the criteria determined under the rule of issuance of certificate of self-certification of origin of goods. - Prepare a list of name of producers or exporters who are qualified enough for submission to the Minister of Commerce for review and decision for eligibility for the use of invoice for selfcertification of origin of goods. - Conduct an inspection and provide recommendations for the Minister of Commerce for a decision to delist any producer or exporter who fails to comply with the regulations, Rules of Origin, and procedures of issuance of a certificate as stipulated in Trade Agreement. - Provide comments for the Minister of Commerce for a fine to be imposed on any producer or exporter who has violated the regulation in effect. - Prepare technical documents including various criteria and any necessary legal instrument, aimed at controlling the use of invoice for self-certification of origin of goods to be effective and consistent with the regulations in effect.

7 Unofficial Translation/GMAC - Compile documents related to the list of producers or exporters and invoice of self-certification of origin of goods so that they are included in the National Center of Commercial Information and provide the information to the ASEAN secretariat and import countries. - Cooperate with the private sector and trade partners in opening training courses for producers or exporters on Rules of Origin and on procedures of the use of invoice for self-certification of origin of goods. - Prepare an annual action plan. Article 5 The Import-Export Department of the Ministry of Commerce is the secretariat of the CCUI. The secretariat shall assist CCUI in fulfilling the duties as stated in Article 4 above. Article 6 The members of the CCUI shall attend a meeting at the invitation of the chair. In case the chair is absent, the vice chair shall lead the meeting on behalf of the chair in order to ensure the regularity of the task. Article 7 CCUI shall have at least 4 meetings per year. The chair or vice chair of the committee can call a meeting if necessary. Article 8 CCUI shall have the right to use the stamp of the Ministry of Commerce in fulfilling its task. Article 9 The cabinet, Director General, General Inspector, Director of relevant Departments of the Ministry of Commerce and concerned persons as stipulated in Article 3 shall implement this Prakas from the date of signature. 10 使用发票来自动申报原产地证的管理委员会的任务如下 : - 根据原产地证明的规则和东盟 世界的贸易规定, 整理和安排其他相关的条款, 以此为基础来选择有资格的使用发票来自动申报原产地证的生产商或出口商 ; - 到生产基地检查工作, 以便评估生产商的资格符不符合原产地证的自动申报手续的规则 ; - 整理 安排有资格的生产商或出口商的名单, 并上报商业部长检查和决定批准使用发票来自动申报原产地证 ; - 监督和检查, 并提供意见给商业部长, 以便决定删除名单内任何不遵照原产地证的规则和贸易协定内规定的程序的生产商或出口商 ; - 提供意见给商业部长关于惩罚任何违反现有法律条例的生产商或出口商 ; - 整理 安排技术资料包括相关标准资料和必要的法律文件, 旨在有效的执行原产地证的自动申报手续, 并符合现有的法律文件 ; - 汇集生产商或出口商的相关资料 单据和原产地证的申报资料, 以便输入到国家商业新闻中心, 并将这些新闻发送给东盟秘书处和进口的国家 ; - 与私人企业和相关伙伴合作, 培训生产商或出口商关于原产地证明的规则和使用发票来自动申报原产地证的程序 ; - 整理 安排年度的计划 第 5 条 : 商业部的进 - 出口管理局是 KKVB 的秘书处 秘书处需协助 KKVB 完成以上第 4 条说明的义务 第 6 条 : 如果有主席的邀请参加会议,KKVB 的会员需要参加会议 如果主席缺席, 副主席需代表主席召开会议, 以便确保正常的工作 第 7 条 : KKVB 需要在每年至少召开 4 次会议, 在必要的情况下, 委员会主席或副主 席可以组织召开会议 第 8 条 :
