1 City Council Meeting Council Chambers Tuesday, November 20, :00 p.m. Present: Absent: Staff Present: Also Present: Mayor Steve Stotko Council Member George Schulenberg Council Member Tom Ollig Council Member Patty Fitzgerald Council Member Mike Henrich Mr. Adam Birkholz, City Administrator Ms. Raquel Kirchoff, City Clerk-Treasurer Mr. Justin Heldt, Chief of Police Mr. Tyler Bruns, Police Officer Mr. Dave Meyer, Maintenance Supervisor Mr. Josh Eckstein, Bolton and Menk, Incorporated 1) Mayor Stotko called the meeting to order at 6:00 p.m. a) The Pledge of Allegiance was taken. 2) Consent Agenda Mayor Stotko read the Consent Agenda. a) Approval of Minutes Approved the minutes of the Canvassing Board Meeting on November 15, b) Resolution R Assessment Certification of Unpaid Utility Charges Adopted Resolution R certifying unpaid utility charges and levying it as a Special Assessment to certain Winsted properties. c) Resolution R Assessment Certification of Abated Blight Properties Adopted Resolution R certifying the charges for the abatement of blighting conditions and levying it as a Special Assessment to certain Winsted properties. d) Road Closure Request Lewis Avenue West Saturday, December 8, 2018 Approved a request for road closure on Lewis Avenue West, from 3rd Street South to the West, from 8:00 a.m. to 3:00 p.m. on Saturday, December 8, 2018, for the Winsted Vintage Snowmobile Show, as approved by the Chief of Police. e) Parade Permit Winsted Winter Festival Approved a lighted parade sponsored by the Winsted Winter Festival on designated streets in the, as approved by the Chief of Police, on Saturday, December 8, f) Swap Meet Winsted Winter Festival Approved a Swap Meet for the Winsted Vintage Snowmobile Show on Saturday, December 8, g) Hay Ride Permit Winsted Winter Festival Granted a hay ride permit to the Winsted Winter Festival for Saturday, December 8, 2018 from 11:00 a.m. to 2:00 p.m. with the designated route as submitted to the Chief of Police. h) Security Bank & Trust Company Pledged Securities

2 Approved the Pledged Securities that Security Bank & Trust Company has purchased for the City of Winsted for the month of October, i) Building Permit Report October, 2018 Approved the Building Permit Report for the month of October, j) Financial Report September, 2018 Approved the financial report for the month of September, k) Claims Approved the claims list for November 20, Council Member Ollig motioned to adopt the Consent Agenda as presented. Council Member Schulenberg seconded the motion. Motion carried 4-0. Council Member Ollig abstained from Item h Security Bank & Trust Company Pledged Securities. 3) Public Hearings a) Public Hearing Industrial Boulevard Improvement Project Assessment Mayor Stotko opened the Public Hearing at 6:03 p.m. Mr. Josh Eckstein, Bolton and Menk, Incorporated, provided a presentation regarding the Industrial Boulevard Improvement Project and proposed assessment. Information reviewed included: History of the project to date. Completed improvements. Assessments. Final cost summary. Next steps Adoption and Certification of the Assessment Roll. No comments or questions were received at this time. Mayor Stotko requested to keep the Public Hearing for the Industrial Boulevard Improvement Project Assessment open during the Public Hearing for the Winsted Police Department Body Worn Cameras (BWCs) in case businesses affected by the assessments came to the meeting. b) Public Hearing Winsted Police Department Use of Body-Worn Cameras Policy Mr. Justin Heldt, Winsted Police Chief, reviewed the proposed Use of Body-Worn Cameras Policy for the Winsted Police Department. Mr. Adam Birkholz, City Administrator, stated that no comments were received prior to these Public Hearings. Mr. Glen Weibel, st Street North, Winsted, Minnesota, stated that he fully supports the use of BWCs. He stated that use of BWCs has proven what officers did at the time of the incident supported what officers said occurred, which he feels is very important. No other comments were received. Mr. Heldt stated that the public is able to comment on the proposed policy, and that the adoption of the policy would be considered at a December, 2018 City Council Meeting. Mr. Heldt further stated that he wants to ensure this policy is inclusive of everyone and that everyone has an opportunity to review it. The proposed policy was included in the public packet of City Council materials for tonight s meeting. Mr. Heldt encouraged the public to contact the Winsted Police Department for a copy of the proposed policy if needed, or to provide feedback regarding the proposed policy. Council Member Fitzgerald asked if a motion is needed to purchase the BWCs. Mr. Heldt stated yes. Council Member Ollig motioned to close the Public Hearing on the Winsted Police Department Use of Body-Worn Cameras. Council Member Schulenberg seconded the motion. Motion carried 4-0. The Public Hearing closed at 6:16 p.m.

3 Council Member Fitzgerald motioned to approve the purchase of six (6) Axon Body 2 Body-Worn Cameras, equipment, included 5-year data plan/contract, and Computer Integration Technologies (CIT) setup for an amount not to exceed $31, Council Member Schulenberg seconded the motion. Motion carried 4-0. Council Member Fitzgerald motioned to close the Public Hearing on Industrial Boulevard Improvement Project Assessments. Council Member Schulenberg seconded the motion. Motion carried 4-0. The Public Hearing closed at 6:20 p.m. Council Member Ollig motioned to adopt Resolution R to approve the Assessment of the Industrial Boulevard Improvement Project. Council Member Schulenberg seconded the motion. Motion carried ) No Old Business 5) New Business a) Winsted Public Works Department Maintenance Worker Positions Mr. Birkholz stated that Mr. Dave Meyer, Maintenance Supervisor, would be presenting information regarding the hiring of two part-time employees to work some On Call coverage for the Public Works Department. Mr. Meyer stated that one of the positions is intermittent and the other is permanent part-time. Mr. Meyer stated that the three full-time Public Works employees work a one week on call schedule, once every three weeks. The proposed permanent part-time position, filled by Mr. Brent Mickolichek, will be placed into the on-call rotation, making on-call shifts once every four weeks, instead of once every three weeks. Mr. Meyer explained that the on-call employee is responsible for checking the wells on Saturday and Sunday and for being available if there is a Public Works need outside of regular hours. Mr. Meyer explained that the intermittent position would be available to take a 24 hour portion of the on-call shift if an employee in the regular rotation cannot work and cannot find a substitute. Council Member Ollig asked if these positions affect the budget. Mr. Meyer stated no, because the on-call wages are already included in the budget for the three full-time employees. Mr. Meyer stated that while on call, the employee is paid a set amount for checking the wells on the weekend and for being on call at night. If the employee is called to come in, they are paid an hourly wage for the time they work, with a one hour minimum. Council Member Ollig asked if the City s insurance would cover incidents and/or injuries related to the part time employees while they are on call if they occur. Mr. Birkholz stated that it should. Council Member Schulenberg asked why this request is occurring at this time. Mr. Meyer stated that he has talked with the Mayor in the past to alleviate some of the on-call time for the full-time Public Works employees. Mayor Stotko stated that this has nothing to do with hiring part-time help to help the Public Works Department with other duties. Mr. Meyer stated that was correct, except that Mr. Mickolichek and Mr. Nicholas Schlechter, who would fill the intermittent part-time position, are also on the Public Works snow plow list, which is separate from these on-call positions. Council Member Fitzgerald stated that Mr. Meyer had been talking with prior City Administrator, Mr. Daniel Tienter, to create job descriptions to add these positions. When Mr. Tienter resigned, Mr. Meyer spoke with Ms. Fitzgerald. Ms. Fitzgerald contacted the City s Human Resources attorney who stated that the positions should be posted. That posting then occurred. It has taken time to complete the process with the turnover in the City Administrator position. Mayor Stotko asked Mr. Meyer if he considered having employees other than the three current full time Public Works employees on call full time in the future. Mr. Meyer stated that could be a possibility if there were enough fully trained individuals. Council Member Ollig stated that the City

4 Council would want to revisit that topic if the Public Works Department did consider that in the future. Mr. Meyer agreed. Council Member Ollig motioned to approve a conditional offer of employment for Mr. Brent Mickolichek for the position of Permanent Part-Time Maintenance Worker with the Winsted Public Works Department. Council Member Fitzgerald seconded the motion. Motion carried 4-0. Council Member Fitzgerald motioned to approve a conditional offer of employment for Mr. Nicholas Schlechter for the position of Intermittent Maintenance Worker with the Winsted Public Works Department. Council Member Schulenber seconded the motion. Motion carried 4-0. b) Mr. Glenn Weibel Mr. Glenn Weibel, st Street North, Winsted, Minnesota, addressed the City Council regarding the following topics from comments he received while campaigning as a candidate for Mayor of the in the 2018 General Election. Grass Lake Road Development Park School Zone signage at the Winsted Elementary School Winsted Police Department Officers Communicating with Children while on Patrol to Build Relationships Plugged Street Drains City Council Interaction with Winsted Residents City Administrator Visits to Local Businesses Winsted s Need for Housing Winsted Municipal Airport Runway The City Council Members thanked Mr. Weibel for his comments. Council Member Fitzgerald requested that as Mr. Weibel continued to talk with people, that he encourage them to attend City Council Meetings. 6) ORGANIZATION REPORT a) Winsted Arts Council Ms. Julie Guggemos provided the following information regarding the Winsted Arts Council. The Winsted Arts Council was formed in 2008 and created from a Blandin Community Leadership Program Winsted has great organizations like the Winsted Arts Council, Winsted Library, the Winsted Police Department, the Winsted Volunteer Fire Department, a great school system, wonderful parks, and much volunteer spirit that keeps Winsted vibrant and a great place to live. The Winsted Arts Council hosts after school art programs for children This helps to fill the void of the public school recently eliminating arts programming. The Winsted Arts Council is working toward providing more opportunities for adults to include those with disabilities and the age groups that are not children or seniors. Dervish - the Irish Band is returning to the Blue Note Ballroom in Winsted in March, 2019

5 Jig Jam, another Irish Band, was hosted by the Winsted Arts Council and Winsted Lions at Mill Reserve Park in the summer of The Winsted Arts Council welcomes all membership dollars. The Winsted Arts Council Board consists of President Julie Guggemos, Vice President Mike Cummings, Secretary Tom Specken and Treasurer Jim Fowler The City Council Members thanked the Winsted Arts Council for its work in and for the community. 7) No Open Forum 8) City Administrator Updates and Announcements a) Planning Commission Vacancy Mr. Birkholz stated that the Planning Commission has a vacancy. Interested residents should contact City Hall for more information. b) Brush Site Closed Mr. Birkholz stated that the Winsted Brush Site is closed for the season. Residents may dispose of their Christmas trees at the Public Works Building site. c) County State Aid Highway (CSAH) 5 Mr. Birkholz stated that the City will host an Open House regarding future plans related to CSAH 5 on Tuesday, November 27, 2018, from 5:00 7:00 p.m. in the Vollmer Room at City Hall, st Street North, Winsted, Minnesota. d) 2019 Budget Work Sessions Mr. Birkholz stated that 2019 Budget Work Sessions are scheduled for Wednesday and Thursday, November 28-29, 2018, from 9:00 a.m. 4:00 p.m. 9) Adjournment Council Member Schulenberg motioned to adjourn the meeting.
