1 Minutes of the Town of Lake George Special Meeting held on February 25, 2015 at the Town Center, 20 Old Post Road, Lake George, New York Members Present: Others Present: Dennis Dickinson, Supervisor Vincent Crocitto, Councilperson Marisa Muratori, Councilperson Dan Hurley, Councilperson Nancy Stannard, Councilperson Deb Foley, Town Clerk; Dan Davis, Jim Martino, Keith Oborne Deputy Supervisor Crocitto called the meeting to order at 1:05 p.m. INTERMUNICIPAL AGREEMENT FOR SHARING OF CODE ENFORCEMENT OFFICER Councilperson Muratori stated there has not been a signed contract. The board discussed the contract which states that the Town will reimburse the Village 50% of the Code Enforcement Officer s salary plus benefits, not including health insurance. Supervisor Dickinson requested that the Town attorney review this agreement and get it back to the Village prior to April 1, GATEWAY MAINTENANCE COSTS Dan Davis stated one of his concerns is if the under drain is basically the Town s responsibility where if anything fails that is already there, the Town will be responsible for opening that road and putting it back to the state it was prior. Supervisor Dickinson stated he feels we need a hold harmless for existing facilities. There was a discussion of keeping the sidewalks maintained and who would be doing this. There was a discussion as to whether to plow the sidewalks in the winter. Dan Davis questioned whether or not it is required to keep the sidewalks opened. Jim Martino provided the cost for equipment and manpower for snowblowing. February 24, 2015 Page 1

2 RESOLUTION TO PURCHASE DUMP BOX FOR TRUCK #38 Councilperson Crocitto stated the Highway Department Truck #38 is in need of a dump box. Dan Davis stated the truck itself is a very sound truck and by putting a stainless steel box on this, it would be around for another 10 years. He spoke to Randy Rath at the LGA who stated they would kick in $6, to put a Dickie John system which is a computerized ground speed system to give an idea of how many pounds per lane mile we are putting out. RESOLUTION # , Introduced by Councilperson Crocitto and seconded by Councilperson Stannard to purchase a dump box for truck #38 not to exceed $45, with the condition that Randy Rath be contacted to contribute their $6, GATEWAY RESOLUTIONS RESOLUTION # , Introduced by Councilperson Crocitto and seconded by Councilperson Hurley. Resolution by Town Board Town of Lake George Warren County to Maintain the 10 Minute Parking Zone Resolution of the Town Board of the MUNICIPALITY of the Town of Lake George Agreeing to Maintain and Repair a 10 minute parking zone on or along State Highway within the geographical jurisdiction of the MUNICIPALITY, such highway identified as US Route 9, State Highway 417, County of Warren. WHEREAS, the State of New York Department of Transportation proposes to reconstruct a State Highway identified as US Route 9, State Highway 417, County of Warren within the geographical jurisdiction of the MUNICIPALITY of the Town of Lake George, and WHEREAS, the MUNICIPALITY of the Town of Lake George approves of such project and desires to have a 10 minute parking zone on such highway within its geographical jurisdiction, and WHEREAS, the State of New York has agreed to provide as a part of the project the following items in connection with a 10 minute parking zone: February 24, 2015 Page 2

3 1. Pavement, curb, sidewalk and signage. Including all incidentals included in constructing the 10 minute parking zone Provided that the MUNICIPALITY of the Town of Lake George agrees to maintain and repair such 10 minute parking zone for a period of at least 10 years, and after 10 years, until such time as the COMMISSIONER, in his/her discretion, agrees that such 10 minute parking zone and /or maintenance of such 10 minute parking zone is no longer desired for such Highway. NOW, THEREFORE, the Town Board, duly convened, does hereby RESOLVE, the MUNICIPALITY of the Town of Lake George approves of the above-subject project; and it is hereby further RESOLVED, that the MUNICIPALITY of the Town of Lake George shall maintain and repair such highway 10 minute parking zone, and it is hereby further RESOLVED, that the Town Board of the MUNICIPALITY hereby authorizes the Supervisor of the MUNICIPALITY of the Town of Lake George to enter into and execute an Agreement with the State of New York and through the Commissioner of Transportation to commit the MUNICIPALITY of the Town of Lake George to maintain, at its own expense, the 10 minute parking zone on the above-identified project, such agreement to provide that the maintenance shall include the repair and replacement of materials and the control of snow and ice for the 10 minute parking zone, and it is hereby further RESOLVED that the Clerk of this MUNICIPALITY of the Town of Lake George is hereby directed to transmit five (5) certified copies of the foregoing resolution to the State Department of Transportation. Resolution by Town Board Town of Lake George Warren County to Maintain Highway Lighting Resolution of the Town Board of the MUNICIPALITY of the Town of Lake George Agreeing to Maintain, Repair and Energize a Highway Lighting System on or along State Highway within the geographical jurisdiction of the MUNICIPALITY, such highway identified as US Route 9, State Highway 417, County of Warren. 4 WHEREAS, the State of New York Department of Transportation proposes to reconstruct a State Highway identified as US Route 9, State Highway 417, County of Warren within the geographical jurisdiction of the MUNICIPALITY of the Town of Lake George, and WHEREAS, the MUNICIPALITY of the Town of Lake George approves of such project and desires to have a highway lighting system on such highway within its geographical jurisdiction, and WHEREAS, the State of New York has agreed to provide as a part of the project the following items in connection with a street lighting system: 1. Underground duct system, including conduit, pull boxes, hand holes and drainage pockets. 2. Electrical conductors (wires). 3. Meter socket, meter pedestal, service panel and all appurtenances. 4. Foundation for light standards. 5. Light poles, luminaires, and banner arms. Provided that the MUNICIPALITY of the Town of Lake George agrees to maintain, repair and energize such highway lighting system for a period of at least 10 years, and after 10 years, until such time as the COMMISSIONER, in his/her discretion, agrees that such lighting and /or maintenance of such lighting system is no longer desired for such Highway. NOW, THEREFORE, the Town Board, duly convened, does hereby RESOLVE, the MUNICIPALITY of the Town of Lake George approves of the above-subject project; and it is hereby further RESOLVED, that the MUNICIPALITY of the Town of Lake George shall maintain, repair and energize such highway lighting system, and it is hereby further RESOLVED, that the Town Board of the MUNICIPALITY hereby authorizes the Supervisor of the MUNICIPALITY of the Town of Lake George to enter into and execute an Agreement with the State of New York and through the Commissioner of Transportation to commit the MUNICIPALITY of the Town of Lake George to maintain, at its own expense, the lighting system on the above-identified project, such agreement to provide that the maintenance shall include the repair and replacement of equipment and the furnishing of electric current for the lighting system, and it is hereby further RESOLVED that the Clerk of this MUNICIPALITY of the Town of Lake George is hereby directed to transmit five (5) certified copies of the foregoing resolution to the State Department of Transportation. 5 There was a discussion Supervisor Dickinson questioned the landscape maintenance agreement wherein the Town would pick up the cost of the landscaping and stormwater for the Gateway project. Supervisor Dickinson stated his concern is taking over the old infrastructure because we are adding to it. Keith Oborne stated it was his understanding that anything that is new is the Town s responsibility. Keith Oborne stated that 90% after everything is completed, will be picked up by DOT. The existing infrastructure that is there is DOT s. RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Muratori. Resolution by the Town Board Town of Lake George Warren County to Maintain Gateway Features and Stormwater Resolution of the Town Board of the MUNICIPALITY of Town of Lake George Agreeing to Own, Maintain, and Repair Gateway Related Landscaping Features on the US Route 9 between Route 9N and the Town Line in the Town of Lake George, County of Warren. WHEREAS, the State of New York Department of Transportation proposes to reconstruct a state highway under project P.I.N , and WHEREAS, the MUNICIPALITY of the Town of Lake George approves of such project and desires to have gateway related landscaping features on the approach to such bridge, and WHEREAS, the State of New York has agreed to provide as a part of the project the following items in connection with such gateway features: sidewalks, maintenance strips, benches, concrete pad(s) for benches, planting bed(s), plant materials, turf areas, multiuse path along Route 9L, retaining wall on Old Military Road, retaining wall at STA to STA , stone veneer and ornamental fence at the Route 9/9L intersection retaining wall, stormwater treatment practices, WHEREAS, the MUNICIPALITY of the Town of Lake George has agreed to provide as a part of the project the following items in connection with such gateway landscaping: Not applicable. Provided that the MUNICIPALITY of the Town of Lake George agrees to maintain such landscaping features for a period of at least 10 years, February 24, 2015 Page 5

6 NOW, THEREFORE, THE TOWN BOARD, duly convened, does hereby RESOLVE, the MUNICIPALITY of the Town of Lake George approves of the above-subject project; and it is hereby further RESOLVED, that the MUNICIPALITY of the Town of Lake George shall maintain such landscaping features, and it is hereby further RESOLVED, that the TOWN BOARD of the MUNICIPALITY hereby authorizes the SUPERVISOR of the MUNICIPALITY of the Town of Lake George to enter into and execute an Agreement with the State of New York and through the Commissioner of Transportation to commit the MUNICIPALITY of the Town of Lake George to maintain, at its own expense, these landscaping features on the above-identified project, and it is hereby further RESOLVED that the Clerk of this MUNICIPALITY of the Town of Lake George is hereby directed to transmit five (5) certified copies of the foregoing resolution to the State Department of Transportation. RESOLUTION TO APPROVE LIBRARY SERVICE CONTRACT WITH THE CALDWELL-LAKE GEORGE LIBRARY RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Hurley. WHEREAS, the Caldwell-Lake George Library is a free association library registered by the Board of Regents of the University of the State of New York and is located at 336 Canada Street, Lake George, New York ( Library ); and WHEREAS, the Library provides important services to the residents of the Town and is considered a valuable Town resource; and WHEREAS, the Library occasionally encounters unexpected maintenance and repair requirements which are not provided for in its annual budget; and WHEREAS, in exchange for Library services, the Town wishes to assist the Library in addressing such maintenance and repair needs; WHEREAS, the Town is authorized to do so by Education Law Section 256. 7 NOW, THEREFORE, BE IT RESOLVED, that the Town Board finds library services to be an important and valuable Town resource; and be it further RESOLVED, that, to advance the ongoing provision of such services, the Town Board authorizes and directs the Town Supervisor to executed a one-year service agreement with the Library in a form acceptable to Town Counsel and substantially similar to the proposed agreement reviewed by the Board; and be it further RESOLVED, that the Town Supervisor, Town Clerk and Town Counsel are hereby authorized to undertake any additional acts necessary to effectuate the purpose of this Resolution. RESOLUTION TO RESCIND RESOLUTION # RESOLUTION # , Introduced by Councilperson Crocitto and seconded by Councilperson Hurley to rescind Resolution # as the program the Mayor set up to pay for drivers of the Fire Department was not needed any longer. COMPREHENSIVE PLAN IMPLEMENT FINANCIAL GOALS At the Association of Town s Meeting, it was suggested that the implementation of financial goals be added. Councilperson Muratori had a conversation with Paul Cummings from Chazen Companies who is facilitating the Comprehensive Plan on behalf of the Town. This will ensure sufficient cash flow and will establish goals and objectives. The board will look into this and discuss it further. February 24, 2015 Page 7

8 WATER QUALITY IMPROVEMENT PROJECT RESOLUTION RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley. RESOLVED, to approve the Municipal Resolution that kicks off the funding for the MS-4 Project. Councilperson Stannard questioned the logo on the new Town website. She stated that the logo with all the colors that the Town Board did not approve is the logo on the website and questioned if the Town paid the $ for this logo. Councilperson Muratori stated we absolutely paid zero money for that logo and if the board would like to go back to the black and white, she will do this. Councilperson Muratori brought up increases for part-time employees. Councilperson Stannard stated that this has nothing to do with the money; however, during the budget process it was decided to give 3% raises to all full-time employees. At that point, the part-time employees were not getting the 3% and feels we should wait until the next budget process. Michelle Martino and John O Leary were the only two part-time employees who already received a 3% raise. Part Time Employee Raises Resolution # Motion was made by Councilperson Muratori and seconded by Supervisor Dickinson to give the remaining part-time employees who did not receive a 3% increase, a 3% raise retroactive to January 1, 2015 for a total of $2, February 24, 2015 Page 8
