1 INVITATION TO BID TO OPERATE A CONCESSION AT THE BIGHT CULTURE MARKET RESTAURANT FACILITY, PROVIDENCIALES, TURKS AND CAICOS ISLANDS The Permanent Secretary for the Ministry of Tourism, Environment, Heritage and Culture invites interested parties to submit bids for the operation of the Bight Culture Market Restaurant, Providenciales. The successful bidder will manage and maintain the restaurant. The submission must be enclosed in a sealed envelope with the Envelope Label included (last page) firmly affixed to the front. The envelope must not carry any identification marks indicating the sender as this may result in immediate disqualification. Bids are to be submitted by 9:00 AM on Friday, 19 May 2017 addressed to: The Permanent Secretary Ministry of Tourism, Environment, Heritage and Culture The Harry Francis Building Pond Street Grand Turk Turks and Caicos Islands REQUESTED INFORMATION: 1. Project Concept. Describe the nature, scope, and services to be provided. When feasible, the historical and cultural values of TCI and socio-economic viability of the proposed project should be integrated in the business and operational plan. 2. Renovation plan*. Describe clearly any items that are proposed to be renovated/replaced, repaired, and provide complete list of materials needed to accomplish the renovation, including the timetable required to finish the work, needed manpower (man-days and required skills). *only submit a renovation plan if renovation work is proposed. Bids without such plans will be considered. 3. Operational and Management Plan. Describe how to run and manage the business in accordance with relevant laws of TCI. Include staff requirements and recruitment plan, including tentative operational plan (schedule). 4. Proof of capability to run and manage a small-medium enterprise. A valid business licence, proof of experience or certificate of attendance for training on SME. 5. Proof of availability of funds (letter from bank no older than 6 months in the name of the company, as evidence of good financial standing or bank statement) to renovate and operate the business. It should be noted, that the operational hours will be Monday to Sunday from 6am to 10pm and should comply with all rules and regulations regarding the operation of business. The successful

2 bidder will be responsible for water and power costs, any approved renovation and regular maintenance costs including, painting, and minor repairs. The site will be available for inspection during normal working hours. Bidders are advised to coordinate with DECR to inspect the site before submitting their bids. OTHER CONDITIONS: A Completed signed copy of the Certificate of Non-Collusion. A bid shall not be considered unless a completed and signed Certificate of Non-Collusion is included. BID EVALUATION CRITERIA: This section contains all the criteria that shall be used to review submissions and qualify bidders. No other factors, methods or criteria shall be used; however, clarification may be sought from the bidder for anything that is not comprehensible or understandable. The bidder shall provide all requested information to be considered for evaluation. Incomplete documents or omission of required information may be ground for disqualification. Evaluation will be in two stages. A bidder will be required to meet certain pre-qualification criteria. Final evaluation will be based on quality and benefits to the community. There is no obligation to accept the lowest or any bid. Pre-qualification Bids will be pre-qualified on the following items prior to being evaluated. Failure to pass any of the items may result in the bid not being considered for further assessment. No 1 2 Requirements Copy of the attached Certificate of Non-Collusion. Letter from bank no older than 6 months in the name of the company, as evidence of good financial standing or bank statement 25% TOTAL SCORE 100% The preferred bidder is the company submitting the bid with the highest total score whilst meeting all of the requirements above and that company will be invited to negotiate a contract with the Government. If agreement cannot be reached with the preferred bidder the bidder with the next highest total score will be considered as the preferred bidder. Negotiations will be undertaken with each subsequent preferred bidder until contractual agreement is reached.

4 CONDITIONS OF OPERATION FOR THE RENTAL OF THE BIGHT CULTURE MARKET RESTAURANT, PROVIDENCIALES Please be advised that the following conditions need to be adhered to for the concession of the Bight Culture Market Restaurant Facility: 1. The term of the concession agreement shall be valid for two (2) years, and can be renewed thereafter subject to satisfactory compliance of the terms and conditions of the contract. There will be an annual review of the agreement and any violation of the terms and conditions will be ground for cancellation or revocation of said agreement. 2. The monthly rental for the restaurant shall be $ DECR will prepare the Invoice payable to Account No. XXXX. Upon payment, a clear copy of the Official Receipt issued by the Treasury shall be submitted to DECR for record keeping. 3. The tenant shall pay the first month and last month rental at the start of the contract. All subsequent monthly rentals shall be paid within the first seven days of the month. 4. Operational hours shall be from 6:00 AM up to 10:00 PM ONLY. No activities in the Restaurant are allowed after 10:00 PM, unless authorized by the Director of DECR or higher authorities. 5. Days of operation will be Monday to Sunday. 6. No loud music or use of louder speakers beyond 75 decibels is allowed at all times, and no music with offensive lyrics can be played. 7. It is the responsibility of the tenant to pay the utility bills which includes water, power, telephone and internet incurred at the Restaurant. 8. Biodegradable materials must be used for packaging of any take-out or for disposal plates, cutlery, or cups. 9. Cleaning products must be eco-friendly except where mandated by Environmental Health Department. 10. Payment for usage of electricity and fresh water. 11. Hold keys to the toilets and provide them to customers upon request. 12. Maintain the cleanliness and hygiene of the toilets, on a daily basis. 13. Provide the toilets with the necessary toiletries such as toilet papers, hand soap, paper towels, and hand sanitizer. 14. Cleaning any mess made or trash left by Restaurant customers in or around the property of the Bight Culture Market. 15. The restaurant concession cannot be sublet. 16. Any violation of the conditions stated above shall be ground for the termination of the contract. We further certify that the principles described above have been, or will be, brought to the attention of all sub-contractors, suppliers and associated companies providing services or materials connected with the tender and any contract entered into with such subcontractors, suppliers or associated companies will be made on the basis of compliance with the above principles by all parties. I/we acknowledge that any breach of the foregoing provisions shall lead automatically to this tender being disqualified and may lead to criminal or civil proceedings. The Turks and Caicos Islands Government shall treat any tender received in confidence but reserves the right to make the same available to any other funding organisation or

6 statutory regulatory authority either having jurisdiction over the works or who may now or at any time in the future have statutory power to require disclosure of this tender.
