1 MINUTES OF THE LANCASTER COUNTY PLANNING COMMISSION DATE: TUESDAY, MAY 29, 2018 I. Call to Order: Chairman Haverstick opened the Public Meeting at 2:30p.m. MEMBERS: Commissioners Scott Haverstick, Terry Martin, William Shaffer, Alice Yoder, Roni Ryan, Benjamin Bamford and Edward Fisher were present. Commissioners Gretchen Karr and Ismail Smith-Wade-El were not present. Call to Audience No one from the audience addressed the Planning Commission regarding an item not on the agenda. III. Approval of the Minutes of Prior Meeting - May 14, 2018: Commissioner Shaffer moved to approve the minutes as submitted. Commissioner Yoder seconded the motion. The motion passed unanimously (Commissioner Fisher was not present to vote). 1

2 IV. Appointments, Presentations and Reports: A. Scheduled Public Presentations: 1. The Quarry Industry in Lancaster County by The Pennsylvania Aggregate and Concrete Association Mr. Cowhey introduced Mr. Travis Rohrer, of Rohrer s Quarry, talked about the importance and future of the quarry industry. Mr. Cowhey said that he suggested that they present this today before the Commission as we are working on the comprehensive plan update. Mr. Rohrer was accompanied by several members of the Pennsylvania Aggregates and Concrete Association and gave a presentation to the Commission. The Pennsylvania Aggregates and Concrete Association represents the aggregates, ready mixed concrete and cement industries on issues of mining, transportation infrastructure and other critical regulatory matters before the Pennsylvania General Assembly. PennDOT and PA Turnpike Commission is our biggest consumer in Pennsylvania, freight is a biggest expense in construction, PA produce 84 metric ton of crush stone every year. They also talked about zoning and planning issues the industry faces at local government and DEP level. B. Committees and Task Forces: None. C. Reports and Presentations from LCPC Staff: 1. Executive Director: No report. 2. Division Directors: Community Planning Tool - Tiny Homes a. Mr. Dean Severson, Director for Community Planning, said staff is working on a tiny homes community planning tool to provide guidance to municipalities. This is a draft document and staff is asking the Commission to review and provide feedback. This will be presented at a later meeting for approval to be used as a model tool for municipalities. Gwen Newell, Senior Community Planner, said this report is one in a series of Community Planning Tools that have been created to assist municipal officials in a variety of planning topics and to craft tools to implement the goals of local plans. It is the intent of this tool to provide recommendations for specific planning issues relevant to many County municipalities. The LCPC staff is always available to 2

3 assist municipal officials and to tailor the recommendations of the Community Planning Tool to local needs. Staff encouraged municipalities to analyze and amend their regulations to allow Tiny Homes in applicable zoning districts. Ignoring this growing housing type can lead to unregulated dwelling units that can become a safety hazard to residents and pose a possible unnecessary burden on municipal services. Tiny Homes already exist, or will be coming soon to your community. This guidance hopes to address issues and concerns relating to Tiny Homes. Commissioner Yoder suggested that these types of the tools and other resources should be updated periodically and be available online. Staff responded once it s approved it will be posted on the LCPC website. b. Mr. Bob Bini, Director for Transportation Planning, noted that 30 days comment period of the Transportation Improvement Program is still open and staff had received only few comments so far. He said comment period is open till June 8, c. Mr. Scott Standish, Director for Countywide Planning, distributed preliminary draft of Places2040 as it was updated based on the comments received. He referred to an article that was printed in the Lancaster Newspaper by Jeff Hawkes. Recently held regional municipal meetings were a good opportunity for staff to discuss the draft plan with municipal officials. Staff is working on setting up plan implementation team that will identify role of staff, the Lancaster County Planning Commission members as well the Partners for Place. Chairman Haverstick commended staff for their work on drafting plan and said he is very pleased with the outcome. V. Previously Postponed Planning Matters for Discussion and Action: A. 4 VI. New Planning Matters for Discussion and Action: A. Lancaster County Comprehensive Planning Items: None. B. Community Planning Reviews: 1. #29-232, East Hempfield Township, Proposed rezoning of a property located along State Street and Miller Road (Acct # ) from Agricultural Holding Zone (AH) to Low-Density Residential Zone (RL) Mr. Jon Beck, Township Director of Development Services addressed the Commission in response to their questions. The LCPC suggested adding a note that when development occurs on this site, the Applicant/Developer should strongly consider connecting the development to the multiple streets surrounding the site. After discussion, Commissioner Ryan moved to recommend approval of the above review, as amended. Commissioner Bamford seconded the motion. The motion passed unanimously. 2. #29-233, East Hempfield Township, Proposed amendment to the Zoning Ordinance to permit "Cluster Developments" use in the Low-Density Residential Zone (RL) and to modify the lot design standards, minimum setbacks and to create a new minimum building separation for cluster developments The LCPC suggested adding as comment that the cluster development provisions as proposed by the Applicant to be revised to require a minimum of nine dwelling units per acre. After discussion, Commissioner Shaffer moved to recommend approval of the above review, as amended. Commissioner Bamford seconded the motion. The motion passed unanimously. 3. #30-137, West Hempfield Township, Proposed rezoning of four parcels of land totaling acres along Marietta Avenue, Rt 23, from Rural Agriculture (R) to Traditional Village (TV) Commissioner Ryan moved to recommend approval of the above review. Commissioner Yoder seconded the motion. The motion passed unanimously. 4. #30-138, West Hempfield Township, Proposed revisions to the Urban Growth Area Map 4

5 Mr. Andrew Stern, Township Manager addressed the Commission and responded questions. He said County s recommendation will go before the Township Planning Commission for their approval. The LCPC suggested that all of area 6 should be incorporated into the UGA and pedestrian connectivity should also be considered with any development that occurs within the UGA. Chairman Haverstick referred to a letter received from Mayor Lutz regarding an adjacent parcel in which he expressed his concerns regarding safety miscellaneous issues. Upon inquiring for detail, Mr. Jeff Helm clarified that the referenced parcel is not affected by the above request. After discussion, Commissioner Martin moved to recommend approval of the above review, as amended. Commissioner Bamford seconded the motion. The motion passed unanimously. C. Subdivision and Land Development Plan Items Approvals/Reviews: 1. Requests for Modifications/Waivers: None. 2. Subdivision and Land Development Plans: None. 3. 6 F. Additions to the Agenda (with 24-hour Public Notice): None. VII. Old Business: None. VIII. New Business and Discussion Items: Commissioner Shaffer gave an update on the Marticville railroad bridge in Conestoga and Martic townships. He said both Townships received $1 million from insurance, $ has already been used for cleanup and necessary repairs. Engineering study of the damage indicated that the bridge is stable but the portion of the center section where the fire occurred has been damaged that still needs to be repaired. He said the estimated cost of replacing and repairing that part is estimated to be $1.5 million which is in addition to the remaining insurance funds. He asked involved staff to find ways to provide additional funds for necessary repairs. Commissioner Shaffer also said pedestrian bridge opening ceremony in Providence Township will be held on June 9, 2018 at 11:00 a.m. He asked all to attend. IX.
