1 ASOTIN CITY COUNCIL MINUTES March 24, 2014 Asotin City Hall, 121 Cleveland Street, Asotin WA CALL TO ORDER: Mayor Bonfield called the City Council Meeting to order at 5:30p.m. PLEDGE OF ALLEGIANCE: 5:33pm Councilmember Appleton Led the Pledge of Allegiance. The purpose of the public hearing is to review the Department of Commerce Community Development Block Grant (CDBG) Planning Grant Contract # in order to assess the project s performance. Those wishing to make oral or written statements on this matter may do so during the hearing. No Comments. Mayor Bonfield Closed the Public Hearing at 5:31pm. 5:40pm NOTICE IS HEREBY GIVEN that a public hearing will be held by the Asotin City Council at Asotin City Hall, located at 121 Cleveland Street, Asotin, WA on Monday, March 24, 2014 at 5:40pm. The purpose of the public hearing is a proposed Emergency Ordinance of the City Council of the City of Asotin, Washington Issuing a three month Moratorium with respect to the acceptance or processing of applications or issuance of permits, and approvals, and uses or activities associated with the producing, processing, or retailing of Marijuana and Marijuana-Infused Products. Mayor Bonfield started the Public Hearing at 5:46pm. No Comments. Mayor Bonfield closed the Public Hearing at 5:47pm. ORAL COMMUNICATIONS- PUBLIC COMMENT: Matt Carlson, Regional Stormwater Program Coordinator presented a Resolution Authorizing the purchase of a Vactor Truck in the amount of $462, for use by greater Asotin Urban area Regional Storm Sewer and Surface Water Management Public Utility. When the budget for 2014 was considered, a Vactor truck purchase was contemplated and provided for in the equipment repair and replacement account. Since the budget process the actual purchase price of the Vactor Truck has increased therefore requiring a budget amendment. Matt Carlson would ask that Mayor Bonfield be authorized to sign the increase to the 2014 budget to purchase the Vactor Truck. Councilmember Bly made a motion to authorize Mayor Bonfield to sign the Resolution that increases the budget to purchase the Vactor Truck for use by the greater Asotin Urban area Regional Storm Sewer and Surface water management public utility. Seconded by Councilmember Tucker. There was no discussion. All Aye. Motion carried. Councilmember Appleton asked Matt Carlson when Stormwater will be sweeping the street in the City of Asotin. Matt Carlson stated this week to next week City of Asotin streets will be completed. Page 1 of 5

2 CONSENT CALENDAR: The Council was presented with the following consent agenda: a. Minutes of March 10, 2014 Regular Meeting b. Expense Checks # $14, c. Payroll Checks # $13, d. EFT IRS $4, Councilmember Appleton made a motion to approve the consent calendar. Seconded by Councilmember Bly. There was no discussion. All Aye. Motion carried. Excused Councilmember s Mervin Schneider Unexcused Councilmember s - None OLD BUSINESS: 1. Building Permits Bill Frye, City of Asotin Building Inspector, discussed with the council the letter that was received by Asotin County for the outstanding building permits. Councilmember Bly checked into International Building Codes use of a Church and it is similar to the use of a Community Center. Bill Frye, stated there are outstanding building permits from Bill Frye stated building permits can be open for only 360 days. There can be an extension granted, however, there have not been any extensions applied for on the outstanding permits. Bill Frye wants to know if there was any occupancy permits issued on these old open permits. In once instance, the house is now selling and the original building permit is still open. The letter stated from Asotin County they would charge the City of Asotin $65.00 to follow up on those outstanding permits. Asotin County has already received their money for the permits. The City needs to be reimbursed or finish the job. Bill Frye asked the council if they had any questions about the city taking over the building permits. Bill Frye stated according to the resolution that was created by Asotin County they adopted $85.00 per square foot. That is $8, for a building permit. Bill Frye stated it should be.85 cents per 100 square foot. As far as the church, Bill Frye stated he will go through the church with the Fire Chief for an inspection. The only issue is handicap bathroom access. That issue has been resolved by opening the bathrooms in the park. Resident, Ron Crossin asked if the International Building Codes were going to be used. Bill Frye said yes. Bill Frye stated the Building Inspector does not inspect Electrical or Fire issues. Those are inspected by other professionals. Bill Frye told the council he has been in the building business for 30 years and 20 years as a Building Inspector. Bill Frye stated he really avoided taking the position, but agreed he would do it, as the position right now is part time. Bill Frye stated he will be paid a percentage of the building permit. Resident, Charlotte Tuttle asked when the City will start issuing Building Permits. Bill Frye stated, April 11 th. Asotin County will need to be responsible for the open building permits. There should be three that are open since they were issued in The City of Asotin will write a letter to Asotin County addressing each issue. NEW BUSINESS: 1. Recreation and Conservation Office (RCO) approved the updated City of Asotin Parks and Recreation Element of the Comprehensive Plan. City of Asotin is eligible to participate in all RCFG Grant Programs. Mayor Bonfield explained now the City of Asotin will be eligible to apply for the Marina planning grant. Mayor Bonfield talked with Dan Haws today and discussions will now be where do we go from here. Page 2 of 5

SCAT Machine Project by US Army Corp of Engineers (USARCE) and Bureau of Land Management(BLM) Mayor Bonfield stated this is updated information for the SCAT Machine that is located by the Marina which uses the Cities Waste Water Treatment Plan. KELTIC ENGINEERING, INC: 1. Second Street Department Of Ecology Stormwater Drainage Project The SEPA environmental checklist comment period ended March 5, There were no public comments collected. A determination of Non- Significance was issued on February 18, Since no comments were received, there will be no further action on this determination. Keltic Engineering, Inc is waiting on submitting the final design packet to the Department of Ecology until the property issue with Asotin County is settled. 2. Shoreline Master Program Update Project #G A kick-off meeting will be held on April 16 th with the City of Asotin, Keltic Engineering, Inc team, and the Department of Ecology. The first deliverables for the shoreline master plan are due to Department of Ecology by March 31 st and they are available for council review. Eric Hasenoehrl distributed a copy of the preliminary jurisdiction map of the shorelines and the City of Asotin Public Participation Plan. This Public Participation Plan is a 3-4 page document that details how the City will keep the public informed on the progress of the Master Plan Update. The plan is an overview of how the City will advertise, hold public meetings, when those public meeting will be held, and who the stakeholders are, people who are either directly affected by the project, have an interest in it, or is an agency that is required by the state to review the plan documents for compliance. Department of Ecology is requesting that there be a link on the City s website that the public can see the different documents that are in progress if they would want to review them. City Clerk/Treasurer, Tiffany Rogers stated the City will place those documents on the website. Councilmember Appleton made a motion to approve the City of Asotin Public Participation Plan for the Shoreline Master Plan. Seconded by Councilmember Van Pelt. There was no discussion. All Aye. Motion carried. PUBLIC HEARING: None CLERK S REPORT: 1.Tiffany Rogers, Clerk/Treasurer reported there were 61 Past Due Utility Notices for March POLICE REPORT: 1. Acting Police Chief, Scott Coppess introduced School Resource Officer, Monte Renzelmen to the Council. Scott Coppess stated Emergency Hire, Erik Spaulding was going to be here for introductions as well, but he had a family emergency. 2. Acting Police Chief, Scott Coppess asked that the Mobile Radar Trailer be removed from surplus. Councilmember Appleton stated the reason it was going to be surplus was due to the batteries not keeping a charge. Acting Police Chief, Scott Coppess stated there is a power cord that can be used and the City can ask the closest resident if they could use their power. Acting Police Chief, Scott Coppess stated, most of the time it s a resident that is asking for the trailer to be by their house, and they are more than willing to let the police use their electricity to slow traffic by their residents. They have completed three lights, and will complete the last light next week. Mayor Bonfield reported that there is still an interest to have a daycare at the Asotin Methodist Church. Previously the church would not allow the daycare to use the kitchen, which placed a hold on the daycare location at the church. Asotin School District is going to allow the daycare to use the school kitchen for meals. The Daycare needs a letter from the City stating the city will allow them to open a daycare and that there is a need in Asotin for a day care. Mayor Bonfield asked the council if they were accepting to having a daycare located at the Asotin Methodist Church and if it was ok to have Mayor Bonfield write a letter stating such issue. All councilors responded by saying yes. RESOLUTIONS & ORDINANCES: 1. Second Reading of Ordinance # being an ordinance repealing ordinance ,09-434, Asotin Municipal Code Section and (G) of Chapter 5.08 Commercial Solicitors and Itinerant Merchants. Tabled by City Attorney Jane Richards to conduct additional research. Page 4 of 5

Second Reading of Ordinance # Creating a new Title 4 Special Events, Chapters to the Asotin Municipal Code for the purpose of regulating Special Events so that the use of public streets, right-of ways, parks, and resources during such events can occur with the safety and health of the participants in mind, the protection of public property considered, and the impact on non-participating citizens minimized. Councilmember Bly made a motion to approve the Second Reading of Ordinance # Creating a new Title 4 Special Events, Chapters to the Asotin Municipal Code for the purpose of regulating Special Events so that the use of public streets, right-of ways, parks, and resources during such events can occur with the safety and health of the participants in mind, the protection of public property considered, and the impact on nonparticipating citizens minimized. Seconded by Councilmember Tucker. There was no discussion. All Aye. Motion carried. 3. Resolution # A Resolution Establishing a New Fund Number 126 for the City of Asotin Building Department. Councilmember Bly made a motion to approve Resolution # A Resolution Establishing a New Fund Number 126 for the City of Asotin Building Department. Seconded by Councilmember Appleton. There was no discussion. All Aye. Motion carried. 4. Resolution # A Resolution Adopting a Public Records Request Policy Tabled by City Attorney Jane Richards to conduct additional research. Resident, Lynn Jarvis asked the council if they had seen the benches. Councilmember Appleton stated he has not seen anybody sitting on the benches. Resident Elaine Greene, Lynn Jarvis and Councilmember Tucker stated they have seen people sitting on them. Mayor Bonfield stated she has been seeing people sitting on tables daily. Mayor Bonfield stated the bike racks should be finished next week. She also stated there are two more benches that will be installed by the bridge. Seconded by Councilmember Bly. There was no discussion. All Aye. Motion carried. Mayor Bonfield will write a letter to the Asotin County Commissioners asking for mediation.
