1 COUNCIL MEETING AUGUST 28, 2014 The regular meeting of Mayor and Council was held on the above date. The meeting was called to order at 7:00 PM by Mayor Filipek with the salute to the flag. Members of Council attending the meeting: Mr. Bollinger, Mr. Duncan, Mr. Hagerty, Mr. Tregear, Mayor Filipek. Absent: Mr. D Angelo, Mr. Sauter Mayor Filipek called for a reading of the minutes of the previous meeting. Mr. Bollinger moved to accept the minutes as presented and dispense with a reading of the same, seconded by Mr. Duncan. All voted in favor. COMMUNICATIONS: Charles Sauter, Borough Clerk read thank you cards from Mike McKenna, Solicitor, Planning Board for Fruit Basket received for his recent surgery from Mayor and Council. The family of Tom Mitchell for honoring him by lowering the Borough flags and the Police escort. Thank you from Colleen Scioli to Mayor and Council for acknowledging her Dad Pinky on his 100 th Birthday with a Proclamation and clock. COMMITTEE REPORTS: Mr. Bollinger- I have one item to report and that is the robbery at Sauter Park as two individuals held up a man and woman with a shot gun and stole their wallet and pocketbook. Thanks to the Philadelphia Police, U.S. Marshall s and Detective John Mader they were captured three days later. Mr. Duncan- No report. Mr. Hagerty- The Borough will be working on the Borough home at 1029 Alcyon Drive to bring up to code and prepare to rent. The Seniors held their Labor Day picnic on August 27 th, thanks to the Fire Department for the use of their grill and the members who helped cooking. Mr. Tregear- The Business Alliance meeting for the 3 rd Quarter will be held on September 24 th, notices and s will be sent after Labor Day. On the Finance Department I do have good news to report the S & P (Standard and Poors) raised our Municipal rating from a single A+ to a AA- ratings, this is good news for the Borough in terms of our General Obligation Notes, good job to the Finance Dept. and Borough Employees for holding the line with the

2 Budget and keeping down our expenses. Website we are continuing to keep updated to what is going on in town. Mayor Filipek- PUBLIC PORTION: Sgt. 1 st Class William Daisey, 857 Devenney Drive, read a letter to Mayor Filipek and Members of Council regarding a rental home at 861 Devenney Drive. Mr. Daisey s complaint is against the property, tenant, landlord and the Borough of Bellmawr. A lengthy letter with numerous complaints was stated, high grass, dog feces, generator for electricity, trash. Mayor stated grass will be cut on Friday. A lengthy discussion was held between Mr. Daisey and Mayor Filipek. Mary Tanealian, 22 Walnut Avenue, two complaints for Mayor and Council, 18 Walnut Avenue and Italia Pizzeria. Mrs. Tanealian read off many complaints against the property and Italia Pizzeria such as high grass, trash, rat problem, dumpster, parking and grease pit also presented many pictures to Mayor and Council to see the various concerns. Mayor Filipek stated he will contact the County Health Dept. and work with Jim Burleigh to resolve these problems. Resident who resides at 25 Walnut Avenue agreed with his neighbor that she is correct with all the problems stated and things needs to be fixed. We have a school in our area and do not need these problems where school children are concerned. He also stated he needs a Borough calendar so he knows when the meetings are and a blue recycling bucket for his beer cans. James Doyle, 121 Glenview Avenue his question was addressed to Councilman Tregear that he was in the Borough Hall and spoke to Tina regarding an sent regarding Bellmawr Against National Debt and if you received Mr. Tregear responded he did receive and sent a response within the last 24 hours. Bellmawr Business Alliance meeting being held on September 24 th at 8:30AM in the Courtroom is this meeting open to the public? Mr. Tregear responded yes but at this time he does not believe it is the appropriate time to address the members about National Debt but would schedule a speaker at a later date. Mr. Doyle sent a letter of determination to the IRS regarding the solution and stopping the debt. Mayor Filipek made a statement that before we adjourn I would like to thank everyone for coming out tonight and thank you for bringing your problems and concerns to us we do appreciate it. The only way we can take care of your concern is letting us know as you stated. I am listed in the telephone book or call and leave a message for me at the Borough Hall, if you have a problem I will have the problem addressed immediately as I have many faithful employees. Before adjournment the gentleman from Walnut Avenue asked

3 Mayor Filipek if he could ask one more question. Mayor Filipek said sure. The question was what is going on out on Creek Road at the old dump. Mayor responded it is not a dump and not a landfill, seven years ago I promised that the landfill would be covered and now it is completely covered and capped and no more leakage into Timber Creek. I am fighting for a road from 295 onto Creek Road to the project and Bass Pro would be there in a year also Restaurants, a park and walking for seniors and all kind of stores but no one will come without a road. I have been fighting for four years with the State of NJ, D.O.T for a road off of Route 295, and not for the State to build but the Developer. This would be a definite plus for the Borough of Bellmawr. Another Gentleman in the audience spoke about the Route 295 Direct Connect; Mayor stated that the State does not have the funding for this project, Second Phase. Mayor Filipek will be having a meeting after Senator Norcross is elected to Congress with the Congressman and the new Commissioner of the State of New Jersey Department of Transportation. OLD BUSINESS: No Old Business. NEW BUSINESS: Borough Clerk makes a Motion to accept Resolution #08: through #08: RESOLUTION: #08: GRANTING SENIOR CITIZEN/DISABILITY DEDEUCTIONS FOR THE 2014 TAX YEAR THAT DID NOT APPEAR ON THE 2014 TAX DUPLICATE. RESOLUTION: #08: GRANTING VETERAN/WIDOW OF VETERAN DEDUCTION OF $ FOR THE 2014 TAX YEAR. RESOLUTION: #08: ADDING PRO-RATED AMOUNT FOR 2014 TAXES IN THE AMOUNT OF $ DUE TO THE FACT THAT THE PROPERTIES WERE SOLD AND WERE RECEIVING A SENIOR CITIZEN/DISABILITY DEDUCTION. Resolution #08: through #08: moved by Mr. Bollinger, seconded by Mr. Duncan. All voted in favor. RESOLUTION: #08: APPOINTING EMERGENCY MANAGEMENT COORDINATOR FOR THE BOROUGH OF BELLMAWR. 4 RESOLUTION: #08: AUTHORIZING SHARED SERVICE AGREEMENT BETWEEN THE BOROUGH OF RUNNEMEDE AND THE BOROUGH OF BELLMAWR, COUNTY OF CAMDEN, STATE OF NEW JERSEY, RELATIVE TO THE RENTAL OF EQUIPMENT AND MANPOWER FOR RECYCLING COLLECTION FOR THE BOROUGH OF RUNNEMEDE. RESOLUTION: #08: AUTHORIZING SHARED SERVICE AGREEMENT BETWEEN THE BOROUGH OF RUNNEMEDE AND THE BOROUGH OF BELLMAWR, COUNTY OF CAMDEN, STATE OF NEW JERSEY, RELATIVE TO THE MAINTENANCE OF MUNICIPAL FLEET FOR THE BOROUGH OF RUNNEMEDE. Resolution #08: through #08: moved by Mr. Bollinger, seconded by Mr. Tregear. All voted in favor. RESOLUTION: #08: AUTHORIZING LEASE AGREEMENT WITH CELLCO PARTNERSHIP d/b/a VERIZON WIRELESS, 296 LEAF AVENUE. Moved by Mr. Hagerty, seconded by Mr. Tregear. All voted in favor. RESOLUTION: #08: AUTHORIZING THE PROPER OFFICIALS OF THE BOROUGH OF BELLMAWR TO EXECUTE A LEASE TERMINATION AGREEMENT WITH METRO PCS FOR TOWER AT WARREN AND CARTER AVENUES. Moved by Mr. Tregear, seconded by Mr. Hagerty. All voted in favor. RESOLUTION: #08: AUTHORIZING SHARED SERVICES AGREEMENT WITH THE BOROUGH OF WESTVILLE, WESTVILLE REGIONAL WATER LABORATORY AND THE BOROUGH OF BELLMAWR RELATIVE TO WATER TESTING. Moved by Mr. Bollinger, seconded by Mr. Duncan. All voted in favor. RESOLUTION: #08: AMENDING THE 2014 CAPITAL BUDGET. Moved by Mr. Tregear, seconded by Mr. Hagerty. All voted in favor. RESOLUTION: #08: AUTHORIZING PAYMENT OF BILLS- AUGUST ORDINANCE: #07:09-14 FIRST READING AND INTRODUCTION. ORDINANCE TO AMEND ARTICLE X1, CHAPTER , SCHEDULE 1 OF THE CODE OF THE BOROUGH OF BELLMAWR. (NO PARKING BOTH SIDES OF COOLIDGE AVENUE FROM CREEK ROAD TO LEAF AVENUE).

5 ORDINANCE: #07:10-14 FIRST READING AND INTRODUCTION. ORDINANCE TO AMEND ARTICLE X1, CHAPTER , SCHEDULE 1 OF THE CODE OF THE BOROUGH OF BELLMAWR. (NO PARKING KARR DRIVE FROM CREEK ROAD TO THE DEAD END OF THE STREET). Moved by Mr. Bollinger, seconded by Mr. Duncan. All voted in favor. APPLICATION FOR SPECIAL PERMIT FOR SOCIAL AFFAIR: DEPTFORD TOWNSHIP FOP LODGE 72-COMEDY SHOW- OCTOBER 18, :00 PM-12 MIDNIGHT-BELLMAWR BALLROOM- 29 LEWIS AVENUE.
