According to 5.5(a) in the NFPA Regs, the final results show this TIA HAS NOT achieved the ¾ majority vote needed on both Question 1 (Technical Merit) and Question 2 (Emergency Nature). 12 Eligible to Vote 0 Not Returned Technical Merit: Emergency Nature: 1 Abstentions (Belio) 2 Abstentions (Belio, Schamel) 6 Agree (w/comment Cline) 5 Agree (w/comment Cline) 5 Disagree (Brown, Clark, Croushore, Holmes, 5 Disagree (Brown, Clark, Croushore, Menig) Holmes, Menig) There are two criteria necessary to pass ballot [(1) simple majority (2) affirmative ¾ vote]. Both questions must pass ballot in order to recommend that the Standards Council issues this TIA. (1) In all cases, an affirmative vote of at least a simple majority of the total membership eligible to vote is required. [12 eligible 2 = = (7)] (2) The number of affirmative votes needed to satisfy the ¾ requirement is 9. Technical Merit: (12 eligible to vote - 0 not returned - 1 abstentions = = 8.25 = 9) The number of affirmative votes needed to satisfy the ¾ requirement is 8. Emergency Nature: (12 eligible to vote - 0 not returned - 2 abstentions = = 7.5 = 8) An appeal relating to a proposed Tentative Interim Amendment shall be filed no later than 5 days after the notice of the Technical Committee TIA ballot results are published in accordance with (c) and In the case that a Correlating Committee is also being balloted, appeals need to filed 5 days after the notice of the Correlating Committee TIA ballot results are published. Final ballot comments are attached for your review. Ballots received from alternate members are not included, unless the ballot from the principal member was not received. Attachment

7 TECHNICAL COMMITTEE LETTER BALLOT PROPOSED TENTATIVE INTERIM AMENDMENT LOG NO To Revise of the 2014 and Proposed 2017 Editions of NFPA 70, National Electrical Code Question 1: I agree with the TECHNICAL MERITS of the Proposed TIA to revise section AGREE X DISAGREE* ABSTAIN* _I feel the suggested change makes the statement ambiguous, as in (B) it is stated that Fiber Optic Cables shall be installed in compliance with Parts 1 and V of article 770. There are no specifics as to what could modify Chapter 7 requirements. There should be more specific information in Article 650 as to what requirements can modify or supersede Chapter 7 articles. Question 2: I agree that the subject is of an EMERGENCY NATURE. AGREE X DISAGREE* ABSTAIN* _I do not feel that this request meets the criteria for an emergency Nature as stated in Section 5.4. This TIA wording restates that fact. Question 2: I agree that the subject is of an EMERGENCY NATURE. X AGREE DISAGREE* ABSTAIN* The reason for the TIA is that an AHJ does not agree about the wording of This TIA amounts to a formal interpretation of existing Code.
