Clerk Date: February 21, 2019 Re: Appointment to the Niagara Escarpment Commission Recommendation: That the following names be submitted to be considered for appointment by the Lieutenant Governor in Council to the Niagara Escarpment Commission (NEC): Mr. Brad McRoberts, CAO, Town of South Bruce Peninsula Ms. Laurie Golden, Councillor, Municipality of Northern Bruce Peninsula Ms. Megan Myles, Councillor, Municipality of Northern Bruce Peninsula Ms. Debbie Myles, Deputy Mayor, Municipality of Northern Bruce Peninsula Background: We have been advised that the term of our current representative on the Niagara Escarpment Commission (NEC) will expire on July 19, The Niagara Escarpment Commission plays an integral role in the protection and maintenance of the Niagara Escarpment. We are being asked to put forward the names of at least three individuals whom we wish to be considered for appointment by the Lieutenant Governor in Council to the NEC. The submission of candidates names, from municipalities that lie in whole or in part of the Niagara Escarpment Planning Area is provided for under the Niagara Escarpment Planning and Development Act. The Act states that candidates for Commissioners from municipalities must either be elected officials or persons employed by such a municipality (upper tier or lower tier). The Municipality of Northern Bruce Peninsula and the Town of South Bruce Peninsula are both municipalities that fall within the Niagara Escarpment Planning area and were invited to submit the names of candidates they wish to be considered to represent the area on the NEC. The Act states that candidates for Commissioners from municipalities must be either elected officials or persons employed by such a municipality (upper tier or lower tier). The Niagara Escarpment Commission plays an integral role in the protection and maintenance of the Niagara Escarpment. I am confident that the list of submitted candidates will match the high standard of previous submissions from your municipality. Niagara Escarpment Commissioners are entitled to a $472 per diem for each meeting day and a further half-day per diem for meeting preparation. In addition, Commissioners are entitled to travel costs, currently 40 cents per kilometre, and normal out-of-pocket expenses. The new candidates on your list will have to be reviewed by and apply for appointment as a Commissioner through the Public Appointments Secretariat (PAS). The candidates will be required to set up an account on the PAS website The website provides information on the process of selection and how to apply for a public appointment. Clerk Date: February 21, 2019 Re: Council and Staff Relations Policy Report Recommendation: That the Council and Staff Relations Policy, be adopted effective March 1, Background: Section 270 (1) 2.1 of the Municipal Act, 2001 provides that a municipality shall adopt and maintain a policy with respect to the relationship between Members of Council and the officers and employees of the municipality. The intent of this Policy is to ensure that the relationship between Members of Council and the Officers and Staff of the County is co-operative and supportive with a clear understanding of the respective roles and responsibilities. The Policy was reviewed by Mr. Michael Kennedy, Hicks Morley with no changes being suggested. Financial/Staffing/Legal/IT Considerations: There are no financial, staffing, legal or IT considerations associated with this report. 8 Policy: Council and Staff Relations Department: Office of the CAO Effective Date: March 1, 2019 Revision Date: Review Date: 1. Coverage This Council and Staff Relations Policy applies to all Members of the Council of the County of Bruce and all members of Staff of the County of Bruce. 2. Purpose The purpose of this Policy is to set out a general standard to ensure that Council and Staff share a common understanding of their respective roles and responsibilities as well as a common basis for their relationship, and to set out acceptable standards to govern their relationship and to which all Members of Council and Staff are expected to adhere to and comply with. The purpose of this Policy is to establish a policy to govern the relationship between Members of Council and County Staff in accordance with paragraph 2.1 of subsection 270(1) of the Municipal Act, Definitions (a) (b) (c) (d) (e) (f) CAO means the Chief Administrative Officer of the County. Clerk means the Clerk of the County Council means the Council for the County County means The Corporation of the County of Bruce Member means a Member of Council Policy means the Council and Staff Relations Policy Page 1 of 5 Page 8 of 12

9 (g) Staff means any of the following: i. A person, not including Members of Council, who performs work for the municipality for wages; ii. A person who supplies services to the Municipality for wages; iii. Such other persons as may be prescribed who perform work or supply services to the municipality for no monetary compensation. (h) Warden means the Head of Council 4. Statement of Principles A. This Policy is intended to set a high standard for relations between Council and Staff in order to provide good governance and instill a high level of public confidence in the administration of the County by its Members as duly elected public representatives and its Staff as public administrators. B. The following key statements of principle are intended to guide Council and Staff and to assist with the interpretation of the Policy: Council and Staff shall recognize that positive internal relations are central to the collective ability of Members and Staff to provide good governance and instill a high level of confidence in the administration of the County; Members and Staff shall relate to one another in a respectful, professional and courteous manner; Members and Staff shall understand and respect each other s respective roles and responsibilities; and Members and Staff shall work together in furtherance of the common goal of serving the public good. The above statements are key principles that are intended to facilitate an understanding, application and interpretation of the Policy these principles are not operative provisions of the Policy. 5. General Obligations In all respects, Members and Staff shall: (a) (b) (c) Relate to one another in a courteous, respectful and professional manner; Maintain formal working relationships in order to promote equality and discourage favourtism, which includes but is not limited to using proper titles and avoiding first names during public meetings or formal business dealings; Understand their respective roles and responsibilities, and appreciate and respect the roles and responsibilities of the other; Page 2 of 5 Page 9 of 12

10 (d) (e) Work together to produce the best results and outcomes for the County and always for the collective public interest of the County; and Act in a manner that enhances public confidence in local government. 6. Roles and Responsibilities of Members Members acknowledge and agree that: (a) (b) (c) (d) (e) (f) (g) (h) (i) (j) (k) Council as a whole is the governing body of the County and that it comprises a collective decision-making body; They are representatives of the entire County; Staff serve the whole of Council rather than any individual Member; They govern, provide political direction and make decisions as the County; They will respect the administrative and managerial chain of command by: (i) Directing any questions or concerns in relation to the administration or management of the County to the Warden or the CAO for their consideration; (ii) Giving direction to Staff only as Council and through the CAO; and (iii) Refraining from becoming involved in the management of Staff. They shall use Staff time effectively, which includes but is not limited to only referring essential matters to Staff for reports; They ensure any requests for information to Staff that were not received at a meeting of Council are made in writing and circulated in writing to all Members; They understand that Staff will undertake significant projects only if they have been directed to do so by Council through the CAO; Whenever possible, they shall notify Staff if an action or position of Staff is to be questioned or criticized at a public meeting to ensure Staff has sufficient time to formulate an intelligent, informed and helpful response for the consideration of Council and that any such questioning or criticism shall be undertaken with courtesy, respect and professionalism, and in no event shall there be any attempt to humiliate, berate, disparage or denigrate Staff and that they shall refrain from publicly criticizing members of Staff in relation to their intelligence, integrity competence or otherwise; They shall request advice from the Clerk about the appropriate wording of motions, amendments and formal directions of Staff; They shall request information regarding meeting agendas or minutes from the CAO or Clerk; Page 3 of 5 Page 10 of 12

11 (l) (m) (n) (o) (p) As individual Members, they have no greater access to records or information held by the County than any member of the public and that they cannot access records or information otherwise protected from disclosure by the Municipal Freedom of Information and Protection of Privacy Act or in accordance with the process set out in that statute; They shall recognize Staff are not expected to provide information or take action outside of regular administrative business hours, except in extenuating circumstances; Certain members of Staff are statutory officers and have specific statutory authorities, duties, powers and responsibilities that cannot be interfered with or derogated from; They shall at all times comply with the County s Code of Conduct for Members of Council; and They shall at all times comply with any policies relating to Council that the Council may implement from time to time. 7. Roles and Responsibilities of Staff Staff acknowledge and agree that: (a) (b) (c) (d) (e) (f) (g) (h) Council is the collective decision-making and governing body of the County and is ultimately responsible to the electorate for the good governance of the County; They shall implement Council s decisions and establish administrative practices and procedures to carry out Council s decisions and any duties specifically assigned to them by Council; They shall assist Council in their decision-making process with respect to its decision, policies and programs by providing Council with information based on professional expertise, research and good judgment in a professional and timely manner; They shall serve the whole of Council rather than any individual Member; That all Members are equal and shall be treated as such and always with courtesy, respect and professionalism; They shall respond to inquiries from Council and provide appropriate and timely follow-up to such inquiries as necessary; They shall ensure any responses to requests for information by a Member that were not received at a meeting of Council are circulated to all Members; They shall refrain from becoming involved in the policy and decision-making process of Council, outside of ensuring that Council is provided with the information necessary Page 4 of 5 Page 11 of 12

12 in order to make their decisions and that Council is aware of any issues that may impact such decisions; (i) (j) (k) (l) (m) They shall diligently and impartially implement Council s decisions; They shall notify management or the CAO, as appropriate, of any issues that may impact the County and of ongoing activities in each department; They shall not speak publicly on any matter respecting any Council decision or policies without authorization to do so, and without limited the generality of the foregoing, shall not publicly criticize any decision or policy of Council; They shall refrain from publicly criticizing decisions of Council or Members in relation to their intelligence, integrity, competence otherwise; and They shall at all times comply with any policies relating to Staff that Council may implement from time to time. 8. Complaints The Clerk shall be responsible for receiving complaints and/or concerns related to this Policy. Upon receipt of a complaint and/or concern, the Clerk shall notify: a. In the case of Staff and Officers, other than the CAO, the CAO b. In the case of the CAO, Council; or c. In the case of a Member of Council, the Integrity Commissioner Where there is a discrepancy between the Council and Staff Relations Policy and the applicable Code of Conduct, the applicable Code of Conduct prevails.
