Background: On Wednesday, September 25, 2012, an accident occurred when an implement of husbandry crashed into the Clark Road Bridge at the New River, Bridge No. 58C The effects of the crash include damage to the bridge of a sufficient level of severity as to warrant closure of the bridge and implementation of a detour route around the area. This results in potential delays in emergency response to local residents and any nearby businesses. The Department has already incurred costs for assessing the bridge, developing and implementing a detour plan, and developing a scope of work for repairs. In the interest of time, traffic concerns, and the concern for adequate emergency response for local residents and nearby businesses, the Department would like to expedite the repairs to the bridge under the auspices of Section of the Public Contract Code: (a) In cases of emergency when repair or replacements are necessary, the governing body may proceed at once to replace or repair any public facility without adopting plans, specifications, strain sheets, or working details, or giving notice for bids to let contracts. The work may be done by day labor under the direction of the governing body, by contractor, or by a combination of the two. b) In case of an emergency, if notice for bids to let contracts will not be given, the public agency shall comply with Chapter 2.5 (commencing with Section 22050). 3 In cases of emergencies when repair or replacements are necessary, the county, pursuant to Public Contract Code Section 22035, may proceed at once to replace or repair any public facility without adopting plans, specifications, strain sheets, or working details, or giving notice for bids to let contracts. The work may be done by day labor under the direction of the board of supervisors, by contractor, or by a combination of the two. If notice for bids to let contracts will not be given, the county shall, pursuant to Public Contract Code Section 22035, comply with the requirements set forth under Public Contract Code Section County Counsel Coordination: This item has been reviewed by the Office of County Counsel as part of Action Request No. AR Fiscal Impact: There will be no impact to the General Fund. Risk Management is being contacted to research reimbursement from the insured's carrier. O.# RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF IMPERIAL FOR DECLARATION OF STATE OF EMERGENCY FOR CLARK ROAD BRIDGE AT NEW RIVER IN IMPERIAL COUNTY; BRIDGE NO. 58C-0162 RESOLUTION NO. WHEREAS: Bridge No. 58C-0162 is located on Clark Road over the New River; and WHEREAS: As the result of an accident which occurred on September 25, 2012, the subject bridge received significant damage; and WHEREAS: The subject bridge as a result of the accident has become a public hazard due to its instability and possibility of failure warranting immediate road closure and emergency repairs; and WHEREAS: Continued closure of the bridge will cause delays in emergency response to local residents and businesses; and WHEREAS: The Department of Public Works has already incurred costs for assessing the bridge, developing and implementing a detour plan, and developing a scope of work for repairs; and WHEREAS: Imperial County wishes to repair the bridge on an Emergency basis under the auspices of the Public Contract Code exemption Section 22035; THEREFORE, THE BOARD OF SUPERVISORS FINDS as follows: 1. The Board of Supervisors finds that the accident of September 25, 2012 caused damage to the Clark Road Bridge over the New River. 2. The Board of Supervisors finds that the Clark Road Bridge over the New River is in need of immediate repair and continues to need immediate repair and pursuant to Imperial

5 BOS APPROVED: M. 0. # County Code section , such immediate repair is necessary for the safety of residents of the County of Imperial. 3. The Board of Supervisors finds that the County continue to proceed to repair or replace the bridge without adopting plans, specifications, strain sheets, or working details, or giving notice for bids to let contracts. 4. The Board of Supervisors finds that the work may be done by day labor, by contractor or by a combination of the two. THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Imperial do hereby: 1. The Board of Supervisors finds that emergency repair work was necessary and continues to be necessary at the Clark Road Bridge over the New River and the County may repair or replace the bridge and take any directly related immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts. 2. The Board of Supervisors hereby ratifies all work done associated with the repair work in this area. 3. The Board of Supervisors hereby authorizes the Director of Public Works to proceed with the repairs under an emergency basis pursuant to Imperial County Code section and Public Contract Code section and This resolution is hereby PASSED AND ADOPTED by the Board of Supervisors, County of Imperial, State of California, this day of, 2012 by the following roll call vote:
