2 I. Overview The City Commission adopted a Future Land Use Map (FLUM) amendment that became effective in February 2016 for the Pines of Sarasota (the Pines). The FLUM for the 24.66± acre site was changed from Community Office/Institutional to Metropolitan Regional Site No. 10. The Pines intends to implement their recently completed master plan that provides for a mixed use project that includes assisted living, skilled care, thrift shop, residential, office and retail uses. As this area would include a mixture of uses, the Pines requested that the Downtown Edge (DTE) zone district be identified as the implementing zone district for Metropolitan Regional Site No. 10. When Ordinance No was adopted, the City Commission authorized the processing of a zoning text amendment (ZTA) identifying DTE as the implementing zone district for the site. Development Review Committee (DRC) staff reviewed the proposed text and did not have any comments. II. Analysis Sec. IV Standards for review. In reviewing an application for a text amendment, the Planning Board and City Commission shall consider whether the proposed amendment: (1) Is consistent with and furthers the goals, objectives and action strategies of the comprehensive plan; (2) Furthers the purposes of these regulations and other city ordinances, regulations and actions designed to implement the Sarasota City Plan; and (3) Would be in the public interest and serve a valid public purpose. Responses (1) Is consistent with and furthers the goals, objectives and action strategies of the comprehensive plan. This Metropolitan Regional site is currently without an implementing zone district. As part of its comprehensive plan amendment application, the Pines of Sarasota requested that DTE be identified as the implementing zone district. That request was supported by staff, and the City Commission authorized the processing of this Zoning Text Amendment. However, this Zoning Text Amendment does not actually rezone the site to DTE the Pines of Sarasota would need to Page 2 of 28

3 file such application and go through the public hearing process with both the Planning Board and City Commission at a future date. This Zoning Text Amendment is consistent with the following components of the Sarasota City Plan. Future Land Use Chapter Metropolitan Regional Land Use Classification Existing and Planned Primary Uses embraced by this classification which are identified on the Future Land Use Plan Map as follows: 10. 4 (2) Furthers the purposes of these regulations and other city ordinances, regulations and actions designed to implement the Sarasota City Plan. The table located in Section VI 101 of the Zoning Code requires updating as it does identify an implementing zone district for Metropolitan Regional Site No. 10. As identified in the staff report for the Pines of Sarasota (14 PA 03), the Metropolitan Regional land use classification, along with the DTE zone district, would allow for implementation of the Pines of Sarasota master plan and redevelopment from the previous concrete plant use that was located on the site. Note: this proposed ZTA was reviewed by members of the Development Review Committee (DRC) and no members had any comments regarding the proposal. (3) Would be in the public interest and serve a valid public purpose. The proposed text revision serves the public interest as the Zoning Code would identify an implementing zone district for the Pines of Sarasota site that is consistent with and furthers the Metropolitan Regional land use classification. While this approval does not rezone the site, it would allow for it to occur in the future upon submittal of an application by the landowner. This site was previously a concrete plant and redevelopment of the site has been envisioned since at least 1998 as the site was not designated as Production Intensive Commercial (i.e., industrial) on the Future Land Use Map. 5 III. Recommendation Staff recommends that the text in this Section be amended to identify the DTE zone district as the implementing district for Metropolitan Regional Site No. 10. Motions for the Planning Board for Application 18 ZTA 02 (Recommended Motion) Move to find 18 ZTA 02 consistent with the Sarasota City Plan (2030) and find that it satisfies the Standards for Review in Zoning Code Section IV 1206 and recommend approval to the City Commission; or Move to find 18 ZTA 02 inconsistent with the Sarasota City Plan (2030) and find that it does not satisfy the Standards for Review in Zoning Code Section IV 1206 and recommend denial to the City Commission; Move to continue the petition if further information is required by the Planning Board. or IV. 6 Sec. VI 101. Purpose. The initial implementing zone districts are identified in the Sarasota City Plan, as zone districts which have an intent and purpose that is conceptually consistent with the intent of the future land use classifications. The intent, specific uses and development standards reflected by those districts were examined and implementing zone districts, defined below, have been developed to achieve consistency between these factors and the future land use classifications. While it is the intent of the city to eventually eliminate all non implementing zoning districts the city also recognizes that the Sarasota City Plan, is a long range plan and the city commission may elect to rezone certain zoning lots while allowing a non implementing zone district to remain in effect for others. Therefore, this article contains the non implementing zone districts that remain in effect. However, the non implementing zone districts shall no longer be used as a basis for future rezonings. In order to carry out the intent of and purpose of the Sarasota City Plan; the city is hereby divided into the following implementing zone districts. 28 NOTICE OF PUBLIC HEARING APPLICATION NO. 18-ZTA-02 Notice is hereby given that the PLANNING BOARD/LOCAL PLANNING AGENCY of the City of Sarasota, Florida will meet on Wednesday, February 14, 2018 at 6:00 p.m. in the Commission Chambers, City Hall, 1565 First Street. Starting at 6:00 p.m. or as soon thereafter as possible, the Planning Board/Local Planning Agency will open the scheduled Public Hearings in the order they appear on the Agenda. The Planning Board will be making a recommendation to the City Commission regarding the below application. ZONING TEXT AMENDMENT APPLICATION NO. 18-ZTA-02 - PROPOSED ZONING TEXT AMENDMENT TO THE ZONING CODE IDENTIFYING THE DOWNTOWN EDGE (DTE) ZONE DISTRICT AS THE IMPLEMENTING ZONE DISTRICT FOR THE METROPOLITAN REGIONAL SITE NO. 10 (PINES OF SARASOTA) FUTURE LAND USE MAP CLASSIFICATION AS IDENTIFIED IN COMPREHENSIVE PLAN AMENDMENT APPLICATION NO. 14-PA-03 WHICH WAS APPROVED BY THE CITY COMMISSION IN DECEMBER 2015, AS MORE PARTICULARLY DESCRIBED IN SAID APPLICATION. Said proposed application is on file in the Department of Planning and the Office of the City Auditor and Clerk at City Hall at the above address for public inspection from 8:00 a.m. to 5:00 p.m., Monday through Friday and is available on the city s website at by clicking on Public Records Access under City Services. This is a public hearing; therefore, all interested persons will be entitled to personally testify at the hearing or to submit documents or letters. If a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
