1 Peace River Regional District REPORT To: Chair and Directors Date: January 4, 2015 From: Jo-Anne Frank, Corporate Officer Subject: Charlie Lake Sewage Local Service Area Establishment Amendment Bylaw No. 2194, 2015 RECOMMENDATION: That Charlie Lake Sewage Local Service Area Establishment Amendment Bylaw No. 2194, 2015 be read a first, second and third time this 12 th day of February, BACKGROUND/RATIONALE: The attached bylaw sets out the following amendments to the Charlie Lake Local Service Area Establishment Bylaw No. 678, 1990: 1. Service Area Boundary Amendment The Regional District s proposed Development Cost Charge (DCC) Program and Bylaw No sets out a Planning Area based on anticipated future land use patterns and development over the next 20 years. During the Ministry of Community, Sport and Cultural Development s review of DCC Bylaw No. 2146, they advised that the Charlie Lake Sewage Local Service Area boundaries should mirror the DCC Planning Area boundaries so as to also reflect the anticipated 20 year growth area. The attached bylaw, once adopted, will establish this. 2. Cost Recovery In preparation of Charlie Lake Sewage Local Service Area Parcel Tax Roll Direction and Imposition Bylaw No. 2195, 2015, it was noted that Bylaw No. 678 only establishes Cost Recovery in relation to the annual operating and debt servicing costs. Since it is intended that the parcel tax also fund new anticipated capital work for the maintenance and upgrading of the service over time, the word capital has been added. The section has also been updated by removing references to the repealed Municipal Act and replacing with appropriate Local Government Act references. 2 PEACE RIVER REGIONAL DISTRICT Bylaw No. 2194, 2015 A Bylaw to amend Charlie Lake Sewage Local Service Area Establishment Bylaw No. 678, 1990 WHEREAS "Charlie Lake Sewage Local Service Area Establishment Bylaw No. 678, 1990", was adopted by the Peace River Regional District Board on July 31, 1990; AND WHEREAS the Board deems it appropriate and necessary to amend Bylaw No. 678, 1990; AND WHEREAS the written consent of at least 2/3 of the participants of the service has been obtained pursuant to section 802 of the Local Government Act; NOW THEREFORE the Regional Board of the Peace River Regional District, in open meeting assembled, enacts as follows: 1. Citation This by-law may be cited for all purposes as "Charlie Lake Sewage Local Service Area Establishment Amendment Bylaw No. 2194, 2015". 2. Enactments (a) That Charlie Lake Sewage Local Service Area Establishment By-law No. 678, 1990 be amended by deleting Schedule A and replacing it with the attached Schedule 'A' which forms part of this bylaw. (b) That Charlie Lake Sewage Local Service Area Establishment By-law No. 678, 1990 be amended by deleting section 3 (Cost Recovery) in its entirety and replacing with the following: Cost Recovery 3. The operating, capital and debt servicing cost of providing the Service shall be recovered by one or more of the following: (a) imposition of fees and other charges; (b) parcel taxes imposed in accordance with Division 4.3 of the Local Government Act; (c) revenues raised by way of agreement, enterprise, gift, grant or otherwise; and, (d) revenues raised by other means authorized by the Local Government Act or another Act. 1
