We had modified some procedures on June 15th prior to our audit after a preinterview with the auditor who gave us recommendations at that time. Audits are now scheduled annually. Our members can have full confidence in the management procedures of their organization. Chamber dues are $5,000 ahead of last year which shows a level of confidence. The results of our audit along with the overall positive results of our membership survey will go a long way toward giving our chamber a wonderful start in TURKEY TROT 29th Year was Record Breaking! Our 29th Turkey Trot took off without a hitch and was the largest in its history with over 9,600 participants. We had our many volunteers for packet pickup on Wednesday at Dana Wharf Sportfishing and coordinated our Race Day requirements with students from our local high schools. Volunteers now sign up on line at our event web site. The City of Dana Point was again extremely supportive and has made the procedures for working out logistics so easy. Our Sheriffs were exceptional and made things run smoothly as they always do. Chotkevys, Diane Harkey TOWN CENTER UPDATE The City Council voted unanimously without the votes of Council Members Russ Chilton and Diane Harkey who were conflicted out, to support the Town Center plan with the traffic pattern to be determined at a later date Chamber Goals & Objectives 1. The results are in and we have three new members of the City Council: Lisa Bartlett, Steven Weinberg and Joel Bishop join Mayor Lara Anderson and Council Member Diane Harkey who will all be at the City Council s organization meeting on Wednesday, December 13th 6PM at the Community Center. We are ready to work with the City on business and community issues for a better Dana Point. CONGRATULATIONS TO PAT BATES the newly-elected 5th District Supervisor. We have known and worked with Pat since she was a member of the Assembly and we look forward to working with her on our local issues. THANK YOU OC SUPERVISOR TOM WILSON After 10 years our 5th District Supervisor Tom Wilson is leaving office because of term limits. We appreciate the help and support he has given the Chamber, the Harbor and our City. 2 Page 2 EXECUTIVE VIEWPOINT Kaytie & Penny It s been a challenging year. The Chamber has been through some difficulty which appears to be coming to an end. A bit of history - The Chamber was incorporated in 1947 with Seven (7) board members authorized. Over the years the number through bylaws revisions has fluctuated between and now the bylaws state Fifteen (15). When I accepted my position here ten and one-half years ago, I was told by Patti Short and the Chamber board that Fifteen (15) board members were authorized. During my tenure there has been no increase in the number of board members through the bylaws. The only legal procedure for increasing the number of board members is through an amendment to the Articles of Incorporation unless the Articles state that the bylaws prevail. Our articles do not state this. No amendment to the Articles has been required without an increase in the number of Board members during my tenure. In the Fall, when the number of Board members had dropped below a quorum, Eight (8) we believed that no chamber business could be conducted without going to court. MISSION STATEMENT The Mission of the Dana Point Chamber of Commerce is to promote business interests and protect the free enterprise system, to pursue a healthy economy and strive for a better quality of life in our community. We looked to an attorney to begin this procedure. While researching to prepare, he looked at our Articles and it was determined that no amendments had been filed over the years as required when an increase in the size of the board was made. Thus the Board had a quorum with Five (5) and met at its regular meeting on Thursday, October 12th. Votes were taken to begin the legal process of electing board members according to the bylaws for terms beginning January 2007, along with scheduling a member vote to amend the Articles of Incorporation to authorize an additional Eight (8) board members and reach Fifteen (15) authorized. At that time, we had not received a petition for a special meeting signed by Five (5) percent of the membership. The board decided that the special meeting would be set to take place at the Chamber s Annual Meeting/Installation and Awards Banquet on Sunday, January 14, This meeting would occur in the event that the chamber received a valid petition requesting the meeting. Chamber members will be receiving their ballots for the 2007 board elections and we ask that you return them promptly. There is one vote from the primary representative per business membership and one from each Associate Non-Business (residential) member. It s a Girl! My grandaughter Madeleine (Maddie) was born on Sunday, November 12th 6lbs. 6oz 19. Over 80 people attended this year s Turket Trot VIP Reception Donna Kalez is honored for Dana Wharf Sportfishing s sponsorship MY HISTORY WITH THE TURKEY TROT One of my first major responsibilities when I arrived here in June 1996 was to begin the administration of the Dana Point Turkey Trot. It was a relatively small, mostly local South OC event though we did have runners from many states. Over the years we have raised the standards and professionalism of the event to where it is now a premier event in the nation and attracts Elite Runners, the most in its history. It s known as America s Turkey Trot and has helped put Dana Point on the map. We had a good race management company. We made a change after a few years to bring a slightly higher level of experience with our next management company. The decision to go with our current race management company ICR has enabled us to breakout and become a race on the national map and a must do for many serious runners. Chip timing was added and we became a USA Track & Field certified race. We have done this while maintaining our local, family atmosphere. Our Hot to Trot for Kids with our 5th Marines distributing the finishers medals has always sold out and we ve allowed for that this year and we ll accommodate all. The proud children s faces are an inspiration when they finish this race. My negotiations to bring Second Harvest Food Bank on board, on a handshake and my word, as the charity five years ago was a good decision and has given them an opportunity each year to raise an unlimited amount of funds. As an example, a few years ago, they received a direct donation of $50,000 through an annual runner who noticed that they were now the charity. His company contributed this amount at the beginning of December of the year he ran. Last year, we helped them raise approximately $52,000. I m proud of my history with this event and that we have brought it to this level where we re known nationally and are the place to be on Thanksgiving. It involved critical decisions and collaborations with talented, experienced and professional individuals at ICR. I m pleased with the belief in my judgment shown by a past chairman when we decided to partner with ICR on my professional r e c o m m e n d a - tion. 4 CITY NEWS by Christy Teague, City of Dana Point Economic Development Manager Business Registration Pilot Program When the Dana Point City Council approved its Strategic Plan in December 2005, a Business Registration Program was a goal to Foster a Vibrant Business Climate. On September 27, 2006, the City Council approved Business Registration as a Pilot Program for one year. Foster a Vibrant Business Climate is certainly a goal of both the City and the Chamber. The Dana Point Chamber of Commerce identified Business Registration in its 2006 Goals and Objectives. Why are both the City and the Chamber so interested in a Business Registration Program? Benefits of a Business Registration Program include: Communication with businesses through newsletters, traffic updates for construction at a block-by-block level, and to quickly share industry-specific information. Advise businesses of special events with related issues and impacts so they can plan accordingly. Identify number and locations of businesses by categories. Identify number of businesses by neighborhoods. Emergency point of contact information available. Information and involvement with the Orange County Sheriff s Department Business Watch program. Implementation of the NPDES Storm Water Permit Program which requires the City to meet regulatory and reporting requirements. The program is intended to be simple to address City Strategic Plan goals and to assist many City programs and departments, including: Police, Fire, Public Works, Planning, Code Enforcement and Economic Development. Online Registration and Renewal - Initial registrations will be conducted through the mail, through walk-ins and through the City s website. Effective Date City staff is currently setting up the Business Registration system and will begin reaching out to businesses in the next few weeks. Though the City Council decided to make the Business Registration Program voluntary, I hope you will choose to include your business in the Business Registration Pilot Program. 5 CONTACT SUPERVISOR TOM WILSON ELECTED OFFICIALS ASSEMBLYWOMAN MIMI WALTERS 73RD DISTRICT asp?dist=73&lan g=1 Dear Friends, It is with mixed emotions that I write this last column for the Chamber newsletter as your county Supervisor. I have truly loved this job and the work we have done together. The infamous El Toro battle, the Dana Point Harbor Revitalization, Laguna Canyon Road Improvements, the ongoing South Court saga, Rancho Mission Viejo, Domestic Violence training for mandated reporters, Senior Transportation programs, 241 South, the LaPata extension, San Juan Creek, Aliso Creek, and so many other worthwhile projects. I have enjoyed working with, and learning from, all of you. I am sorry that I won t be seeing most of you on a regular basis. It has been my pleasure to meet and work with so many interesting and amazing people in the Fabulous Fifth. So many of you, with passion for one cause or another, have given selflessly to protect and enhance the quality of life for all the folks in the Fifth District. As for me, I will be continuing my work in water quality and clean beaches, and of course, will not be losing interest in the projects I have been involved with as your Supervisor. In the meantime, and until another wonderful opportunity presents itself, I will be taking my calls by the pool, with a fine cigar, spending more time with Nancy and the grandkids. Thanks for the Memories! -Tom The American Dream by Assemblywoman Mimi Walters When our Founding Fathers wrote the Fifth Amendment, they did not intend for government to use its power to take one person s home to give it to another person. Last year, in the infamous Kelo vs. City of New London decision, the U.S. Supreme Court disagreed. The Court decided that it was not outside the scope of government s power to take a person s home and give it to another person who could generate more revenue. There have been two distinct reactions to that decision. Among average citizens, there has been a firestorm of opposition that has not yet subsided. Among local governments, we have seen a noticeable increase in property rights abuses. While the Kelo decision outraged the average American, it simultaneously emboldened local government officials who are experimenting with new and creative ways to use their recently granted powers. In California, on November 7th, we have the opportunity to put an end to government s experimentation with scope of its power over private property owners. The average citizen has the opportunity to stand-up to government and say, No, you have overstepped your bounds, by voting for Proposition 90, the Protect Our Homes Initiative. If Proposition 90 passes, local governments will never again be able to take one person s home and give it to another person. Furthermore, if the government damages or devalues your property, it will be required to give you just compensation for your loss. It is time for the people of California to check the power of government by passing Proposition 90. Page 5

Take November to put your lists together, make your holiday reservations and then take time to have fun!! Our restaurants stand ready to help you through the holidays with great food and wonderful atmosphere. Bring your out of town guests out to the harbor and enjoy the food and ambiance. Afterwards, get your christmas wish list up to date while you stroll through the terrific stores and boutiques. Our stores are not tourist trinkets. Our shops cater to their customers looking for those special gifts. Art, jewelry, collectibles, chocolates, all things woody and aloha, Tommy Bahama, house décor, specialty bath salts & lotions, ladies wear and shoes, perfumes, marine items & clothing, fishing items, seashells and stained glass can all be found! One, two, three say cheese!! The harbor is a terrific spot to take your family christmas photo either on land or by sea. You can charter a boat to take you out past the breakwater and use the harbor as a perfect backdrop to make all those people back east shoveling snow jealous of your shorts and sunglasses!! We are currently planning for the holiday events in the harbor. This year s theme is a yo ho ho holiday. We will kick off our holiday events with holiday in the harbor on Friday, December 1st from 3:30pm-8:30pm. There are many fun activities planned including Photos with Santa, performances by the Jackstraws, Abbit the Average, Heebie & Jeebie, and the Zany Shoppers as well as holiday crafts, people painting and a caricature artist. Boat rides with Santa will be Saturday & Sunday December 2nd & 3rd from 10am-3pm and the 32nd annual boat parade of lights will be on Friday & Saturday December 9th & 9th and 15th & 16th at 7:30pm. This year we are excited to announce new trophy categories and cash prizes.
