2 Introduction Established in 2000, the Good Governance Programme is a series of short courses, presented each year on the campus of the University of Pretoria, dealing with issues pertinent to good governance, with a special focus on the needs in the Southern African sub-region. Each course is presented by local and international experts, with a balance between academics and practitioners. There is a general course on good governance, presented each year in July, and other specialised courses throughout the year dealing with a range of relevant topics. Courses are aimed primarily at government officials, legal practitioners, managers and staff of human rights institutions, NGOs, intergovernmental organisations, academics and other interested parties from Africa and abroad. Approximately 30 participants are accepted on each course. International Law January During this two-week course, participants are given an overview of some of the most important aspects of international law. The following aspects are covered: A general overview Sources of law Law of treaties Doctrine of state and individual responsibility The United Nations and the African Union Specific issues dealing with trade, economic relations, labour, refugees and human rights in contemporary international law Socio-Economic Rights 9-13 March Focus is placed on the role of socio-economic rights in modern democratic states and the enforcement thereof. Issues that are covered include the following: Introduction to socio-economic rights The recognition of socio-economic rights at global, regional and national levels The scope and contents of specific rights State reporting obligations on socio-economic rights under international human rights law The role of the SA Human Rights Commission in monitoring the implementation of socio-economic rights The role of budgeting in realising socio-economic rights Litigating socio-economic rights Election Observation 8-12 March January 8-12 March This course holistically evaluates the institution of election observation, its value and its application with specific reference to African democracies. The following issues are dealt with: Observation missions Short and long term observers The phases of an election Analysis of electoral acts, constitutions and relevant legislation Cultural sensitivity on the continent Re-evaluation of the concept of free and fair elections Human Rights in Africa May The course focuses on regional human rights norms and its application in Africa. The course covers issues such as: A general introduction to human rights law and the role players in the development and enforcement of human rights norms in Africa The United Nations system Human rights treaties and their status in Africa European human rights systems Inter-American human rights systems The African Union and human rights The African Commission on Human and Peoples Rights as well as the African Court on Human and Peoples Rights Protection of refugees Good Governance: General Course July May July In this general course on good governance, emphasis is placed on the linkage between human rights, public administration and effective and responsible service delivery. The following topics are covered: ICT and good governance Good governance and the private sector Anti-corruption measures in both public and private sectors Policy and policy implementation Ethical governance Good governance and the financial services sector Gender and good governance Politics and good governance Introduction to human rights The Management of Human Rights Institutions September 6-10 September The focus of this course is the contribution of nongovernmental organisations and national human rights institutions in monitoring and implementing the principles of good governance. The following topics are dealt with: The establishment of NHRIs and NGOs and their institutionalised structure Projects and the principles of project management
3 Funding and financial management Management of scarce resources Utilisation of human resources Documentation and information management Imaging and public relations Institutional evaluation The Management of HIV/AIDS The objective of the course is to analyse the existing legal framework, government policies and social structures in place for the prevention, care and management of HIV/ AIDS. The following topics are dealt with: Introduction and overview AIDS and governance Living with HIV/AIDS, stigma, counseling and discrimination Regional programmes and challenges HIV/AIDS and human rights Corporate imperatives in managing HIV Government service impact HIV/AIDS and the youth Gender Equality September 7 11 September The latest developments with regard to gender equality and the implications thereof for the women of Africa are examined in this course. Issues dealt with are: The development and implementation of human rights instruments Policies and best practices aimed at promoting gender equality at global, regional and national levels Gender-based violence and harmful practices Contemporary developments impacting on gender equality such as HIV/AIDS, participation in decisionmaking, the role of women in peace-keeping, women as refugees Case studies on gender and sex discrimination Gender mainstreaming Development and Human Rights December 30 November 4 December The intricate relationship shared between two traditionally opposing concepts, development and human rights is explored in this course. The course focuses on the following issues: Definitions of development, including the rhetorics of development, classic versus radical definitions, Western and African definitions The World Bank and IMF models of development The role players, the duty bearers, beneficiaries and bystanders in the development process The impact and value of international programmes such as Structural Adjustment Programmes and Poverty Reduction Programmes Women in development, gender mainstreaming in development International trade in the development process International Criminal Prosecutions 29 November 3 December The focus of the course is on the management and prosecution of international criminal activities and the relevance of their prosecution within Africa. The course covers topics such as: The current status of international criminal justice, historical perspectives (from Tokyo, Nuremberg and the Geneva Conventions) and the relationships between national and international jurisdictions International courts and tribunals: the ICTY, ICTR, ICC, ICJ, etc State responsibility (ICJ) vs individual accountability (ICC, ICTR, etc) Terrorism and its prosecution Practical considerations such as investigation, principles of international prosecutions, defence counsel, witnesses, court management, judicial proceedings and appeals International Humanitarian Law November 2 11 November Principles of humanitarian law essential to good governance are dealt with in this course. The course covers issues relating to: The historical development of international humanitarian law Types of conflict Geneva and Hague law Prisoners of war and occupation Humanitarian assistance Customary law War crimes and the repression thereof Dr Edward Kwaka Legal Counsel at the World Intellectual Property Organisation (WIPO), Geneva
