Means the agreement that results from the acceptance of a bid by IDT. Means a sector, sub-sector or industry that has been designated by the DTI in line with national development and industrial policies for local production, where on local produced goods or locally manufactured goods meet the stipulated minimum threshold for local production and content. means a document that has been signed by the Chief Financial Officer or other legally responsible person nominated in writing by the Chief Executive, or senior member / person with management responsibility (close corporation, partnership or individual). means an enterprise with a specified total annual revenue of less than the amount stipulated below per sector if and only if a certificate has been received issued by a registered auditor, accounting officer into. section 60(4) of the Close Corporation Act or an accredited verification agency. Functionality Means the measurement according to predetermined norms, as set out in the tender documents, of a service or commodity that is designed to be practical or useful, working or operating, taking into account, among other factors, the quality, reliability, viability and durability of a service and the technical capacity and ability of the tenderer. In the service of the state Person Qualifying Small Entity Service Level means: an employee of any municipality who has a performance contract with the municipality and is employed on a permanent, temporary or short term basis. an employee or public servant of any national or provincial government as defined in terms of Public Services Act. a member who is a councillor of any municipal council as defined in the Local Government Municipal Structures Act (Act No 117 of 1998); is a politician serving in any provincial legislature; or is a politician serving in the National Assembly or the National Council of Provinces; a member of the board of directors of any municipal entity; an employee and a member of a government owned entity as defined in the Public Finance Management Act (Act No 1 of 1999); and / or such other meaning ascribed to it by National Legislation from time to time. Includes a juristic person. Means a qualifying small entity that qualifies for measurement under the QSE B-BBEE scorecard with a turnover of between R5-R35 million. Shall have the same meaning assigned as Contract Page 5

The same meaning is assigned as Bid above. Means the arrangement through which the property of one person is made over or bequeathed to a trustee to administer such property for the benefit of another person. Means any person, including the founder of a trust, to whom property is bequeathed in order for such property to be administered for the benefit of another person. Page 6

7 INVITATION TO SUBMIT EXPRESSIONS OF INTEREST A CALL FOR PROFESSIONAL SERVICE PROVIDERS IN THE BUILT ENVIRONMENT TO SUBMIT EXPRESSIONS OF INTEREST TO BE ON A PRE-APPROVED PANEL OF PROFESSIONAL SERVICE PROVIDERS IN THE EASTERN CAPE REGION OF THE IDT FOR A PERIOD OF 36 MONTHS Independent Development Trust in the Eastern Cape Province hereby calls for Expression of Interest from suitably qualified and experienced service providers from the built environment profession to establish a pre-approved panel of Professional Service Providers (PSPs) for infrastructure projects in Eastern Cape to be utilised for a period of 36 months. The following categories of professional service providers are invited Project Managers; Quantity Surveyors; Architects; Civil & Structural Engineers; Electrical Engineers & Mechanical Engineers and Health and Safety Consultants Only PSPs/ consultants who are professionally registered with relevant professional bodies are eligible to submit expressions of interest. Entities with multi disciplines must submit individual bids per discipline. Proposals will be evaluated in terms of the Mandatory Requirements and Generic Functionality Criteria as follows: PHASE ONE - MANDATORY REQUIREMENTS/ DOCUMENTATION 1. Failure to complete all supplementary information and return of full document will result in the document being deemed null and void (eliminated). 2. Service providers must submit Valid Tax Clearance Certificate (TCC) / SARS PIN with their BIDs, in order to be considered. 3. Submit a detailed full CIPC certificate or other authentic proof of company ownership document and originally certified ID copies of all directors ( ID s not older than 3 months from bid closing date) 4. Valid Proof of Professional registration (including those of the residential partner). 5. Submit proof of registration with National Treasury Central Supplier Database ( CSD) 6. Notarised Joint Venture Agreement where applicable 7. Notarised Consortium Agreement where applicable 8. Professional Registration for the chosen category (with at least one professionally registered director) 9. Minimum Professional Indemnity of R Submit Valid COIDA or FEM certificate 11. All the attached Standard Bidding Documents (SBD 4, 8 & 9) forms are to be fully completed and submitted PHASE TWO EVALUATION CRITERIA Service Providers are to obtain a minimum of 60 points of the total functionality points to be eligible to be in the database/panel for a period of 3 (three) years Page 7

9 1 BACKGROUND 1.1 IDT as an entity IDT is a Schedule 2 Public Entity governed by applicable legislative frameworks and a Deed of Trust. The organization is accountable to Parliament through the Minister of Public Works who is the Executive Authority. The mandate of the IDT is to support and add value to the development agenda of government as indicated in the mission statement; The IDT manages and delivers integrated social infrastructure programme on behalf of government. In pursuit of this mandate, the IDT primarily operates as a strategic partner in the management, integration and implementation of certain government development programmes. The IDT has representation in all provinces and is organized on the basis of regional offices. These offices have the authority to call for bids, conduct evaluation of bids and make recommendations to the Management Bid Adjudication Committee (MBAC) for award of bids. A copy of IDT the last Annual Report is available on request. Additional information with regards to the structure and functional activities of IDT can be obtained from IDT website ( 1.2 Project Background The Independent Development Trust (IDT) has been appointed as the Implementing Agent by various National and Provincial Department Clients to implement Social Infrastructure Service Delivery Programs within the Eastern Cape Province, these includes but not limited to School Building Programme, Water and Sanitation, Fencing Programme, Special Schools Programme and Alternative Construction Methodology Programmes utilising conventional methods, however Alternative Building Technologies (ABTs) could be considered on sites with no access to deliver the materials. 1.3 Project Purpose The IDT invites suitably qualified professional consultants from various disciplines (e.g. Project Managers, Architects, Quantity Surveyors, Civil & Structural Engineers, Electrical Engineers, Mechanical Engineers, Health and Safety Consultants), wishing to be on IDT database/panel PSP s for undertaking of infrastructure related works in the Eastern Cape Region, to submit proposals for expression of interest. The request for quotation will be issued to service providers on this panel on a rotation basis. The Database/panel will be valid for 36 months and will be subject to budget and project availability. 10 2 SCOPE OF WORK 2.1 PROJECT MANAGERS The Construction Project Manager is required to be registered with an appropriate professional body (i.e. South African Council for the Project and Construction Management Profession (SACPCMP) or any another recognized professional body in the project management field) and to have the relevant qualifications, skills, experience and capacity to deliver the scope of work within the required timeframe. The Project Managers shall perform the following standard services under the following stages, as per The South African Council for the Project and Construction Management Professions (SACPCMP) Guideline Scope of Services and Recommended Guideline Tariff of Fees for Persons Registered in terms of the Project and Construction Management Professions Act 2000, Act No 48 of Stage 1 Inception Stage 2 Concept & Viability Stage 3 Design Development Stage 4 Documentation & Procurement Stage 5 Contract Administration & Inspection Stage 6 Close out 2.2 ARCHITECTS Architects are required to be registered with an appropriate professional body (i.e. South African Council for the Architectural Profession (SACAP) or any another recognized professional body in the Architectural field) and to have the relevant qualifications, skills, experience and capacity to deliver the scope of work within the required timeframe. The Architects shall perform the following standard services under the following stages, as per The South African Council for the Architectural Profession (SACAP) Framework for the Professional Fees Guideline in respect of services provided by person(s) registered in terms of the Architectural Professions Act 2000, Act No 44 of Stage 1 Inception Stage 2 Concept & Viability (concept design) Page 10

11 2.2.3 Stage 3 Design Development Stage 4 Documentation & Procurement Stage 5 Construction Stage 6 Close out 2.3 QUANTITY SURVEYORS Quantity Surveyors are required to be registered with an appropriate professional body (i.e. South African Council for the Quantity Surveying Profession (SACQSP) or any another recognized professional body in the Quantity Surveying field) and to have the relevant qualifications, skills, experience and capacity to deliver the scope of work within the required timeframe. The Quantity Surveyor shall perform the following standard services under the following stages, as per The South African Council for the Quantity Surveying Profession (SACQSP) Guideline Tariff of Fees respect of services provided by person(s) registered in terms of the Architectural Professions Act 2000, Act No 49 of Stage 1 Inception Stage 2 Concept & Viability Stage 3 Design Development 2.34 Stage 4 Documentation & Procurement Stage 5 Construction Stage 6 Close out 2.4 ENGINEERS (Civil & Structural, Electrical and Mechanical) Engineers are required to be registered with an appropriate professional body (i.e. Engineering Council of South Africa (ECSA) or any another recognized professional body in the Engineering field) and to have the relevant qualifications, skills, experience and capacity to deliver the scope of work within the required timeframe. 12 The Engineers shall perform the following standard services under the following stages, as per Engineering Council of South African (ECSA) Guideline for services and process of estimating fees for person(s) registered in terms of the Engineering Professions Act 2000, Act No 46 of Stage 1 Inception Stage 2 Concept & Viability (often called Preliminary Design) Stage 3 Design Development (also termed Detailed Design) Stage 4 Documentation & Procurement Stage 5 Contract Administration and Inspection Stage 6 Close out 2.5 OCCUPATIONAL HEALTH & SAFETY CONSULTANT The Occupational Health and Safety Consultant is required to be registered with an appropriate professional body (i.e. South African Council for the Project and Construction Management Profession (SACPCMP) or any another recognized professional body in the Occupational Health and Safety field) and to have the relevant qualifications, skills, experience and capacity to deliver the scope of work within the required timeframe. The Occupational Health and Safety Consultant will be responsible for the development and monitoring of a comprehensive project specific health and safety plan. The consultant will also be required to assess and make recommendations on the designs produced by the Architects and Engineers. Assessment and analysis of potential risks attached to the project, i.e. undertake the baseline risk assessment on behalf of the IDT (as the client) in terms of Construction Regulation 5(1)(a). Attend professional design team meeting to inform the professional team, and in specific, the designer of the risks to be considered during the conceptualization of the project. Development of a project specific health and safety specification. Evaluation and approval of the contractor s health and safety plan. Site Visits and regular monitoring audits. Attend technical meetings for presentation of the audit report. Page 12

13 Assist the IDT to undertake Independent investigations on any accidents due to construction work undertaken. Conduct a final compliance audit on completion of the project and submit a close out report. 3 NOTES 3.1 Appointments for projects will be as and when required and will be dependent on project and budget availability. Service providers will be provided with an opportunity to provide cost/pricing once they are part of the panel of service providers as and when required. The project deliverables and their due dates for that particular project will be confirmed and agreed upon prior to signing of the contracts. 3.2 Packaged proposals to render more than one service will not be accepted. 3.3 Applicants are however free to submit separate proposals for any discipline they wish to be involved in provided they meet the required criteria. 3.4 If applicants chose to tender for more than one discipline, they are required to obtain a document for each discipline tendering for. 3.5 Joint Ventures are eligible to submit expression of interest, provided that they satisfy stated criteria in the Expression of Interest. Each party to a joint venture is to submit the requisite documents and / or information as requested in item 4 below. An agreement or Heads of Terms recording the arrangement between the parties to the joint venture is to be submitted. A lead consultant is to be appointed and noted in the submission. 3.6 Applicants are to ensure that they have adequate resources to undertake the work under stringent timeframes. 3.7 Tenderers are required to take cognisance of the role of the other professionals that might be involved on the project. 3.8 The IDT reserves the right to ask tenderers to replace any member/s of the proposed team if they do not meet the IDT requirements. 14 4 PRESENTATION OF PROPOSALS The bidder s submission must provide the IDT with sufficient information to enable the employer to make a sound and fair evaluation of the proposal. The evaluation of proposals will be on the following basis: - Phase 1 - MANDATORY REQUIREMENTS/ DOCUMENTATION Service providers must submit Valid Tax Clearance Certificate (TCC) / SARS PIN with their BIDs, in order to be considered. Submit a detailed full CIPC certificate or other authentic proof of company ownership document and originally certified ID copies of all directors ( ID s not older than 3 months from bid closing date) An Original and Valid BBBEE status level verification certificate or a certified copy thereof, substantiating the bidding entities BBBEE ratings. Only certificates issued by verification agencies accredited by the South African Accreditation System (SANAS), or by registered auditors approved by the Independent Regulatory Board of Auditors (IRBA) will be accepted. An EME must submit a sworn affidavit confirming the following: o o o Annual Turnover Revenue of R10 million or less; and Level of Black Ownership Any misrepresentation in terms of the above bullet points constitutes a criminal offence as set out in the BBBEE Act as amended. A copy of the bidder s Professional Indemnity Insurance Certificate indicating the maximum value per claim in an insurance period, the applicable excess, the expiry date. A minimum cover of R2m is required for all PSP s except OHS (R1m) & Social Facilitators. Certificates of the Companies membership/s to industry bodies. A company/corporate brochure/profile alternatively a brief summary of the entity s background. CSD Phase 2 FUNCTIONALITY CRITERIA Bidders must clearly indicate the relevant previous experience of the company and its proposed key personnel as outlined below: - PREVIOUS EXPERIENCE A schedule of completed contracts of similar nature (discipline bidding for) in relation to building construction works. The following details must be included in the schedule: - Full description of the project Page 14

15 Service rendered Name of Employer / client and their representative contact details Cost of the works Fees obtained for services Date of completion For PSP s that have previously been appointed by IDT, please state the number of outstanding close out reports and their current status and also list the number of IDT projects successfully closed out. A schedule of current contracts. The following details must be included in the schedule: - Full description of the project Service rendered Name of Employer / client and their representative contact details Cost of the works Fee to be obtained for services Expected date of completion CAPABILITY Provide information on the individuals who will be assigned to projects (entire company organogram and likely project specific organogram). The following must be addressed: - Organogram (Company and likely project specific) Role/s and responsibility/ies on the project Relevant Qualifications (bidders are to include copies of the relevant qualifications of individuals) Relevant registration with professional bodies (bidders are to include copies of the relevant registration certificates of individuals) Number of years of relevant experience in the industry and in the proposed role Detailed CV s for each member of the team noting their specific relevant project experience, project description, role and responsibility and project value. A percentage estimate of the time planned to be dedicated for a project for each person. LOCALITY The physical address of the Companies Head Office is to be Eastern Cape Based. 16 5 ASSESSMENT CRITERIA TECHNICAL The technical assessment will be based on the following criteria. PSP s who qualify to be in the panel will be invited to respond to projects specific bidding for price and BBBEE in line with project scope, complexity and value in accordance with the IDT SCM Policy. The evaluation criteria referred to above will be defined by the Bid Specification Committee in accordance with the IDT SCM Policy. Page 16

17 SBD 4 DECLARATION OF INTEREST 1. Any legal person, including persons employed by the state¹, or persons having a kinship with persons employed by the state, including a blood relationship, may make an offer or offers in terms of this invitation to bid (includes an advertised competitive bid, a limited bid, a proposal or written price quotation). In view of possible allegations of favouritism, should the resulting bid, or part thereof, be awarded to persons employed by the state, or to persons connected with or related to them, it is required that the bidder or his/her authorised representative declare his/her position in relation to the evaluating/adjudicating authority where- - the bidder is employed by the state; and/or - the legal person on whose behalf the bidding document is signed, has a relationship with persons/a person who are/is involved in the evaluation and or adjudication of the bid(s), or where it is known that such a relationship exists between the person or persons for or on whose behalf the declarant acts and persons who are involved with the evaluation and or adjudication of the bid. 2. 29 SBD 9 CERTIFICATE OF INDEPENDENT BID DETERMINATION 1 This Standard Bidding Document (SBD) must form part of all bids¹ invited. 2 Section 4 (1) (b) (iii) of the Competition Act No. 89 of 1998, as amended, prohibits an agreement between, or concerted practice by, firms, or a decision by an association of firms, if it is between parties in a horizontal relationship and if it involves collusive bidding (or bid rigging).² Collusive bidding is a pe se prohibition meaning that it cannot be justified under any grounds. 3 Treasury Regulation 16A9 prescribes that accounting officers and accounting authorities must take all reasonable steps to prevent abuse of the supply chain management system and authorizes accounting officers and accounting authorities to: a. disregard the bid of any bidder if that bidder, or any of its directors have abused the institution s supply chain management system and or committed fraud or any other improper conduct in relation to such system. b. cancel a contract awarded to a supplier of goods and services if the supplier committed any corrupt or fraudulent act during the bidding process or the execution of that contract. 4 This SBD serves as a certificate of declaration that would be used by institutions to ensure that, when bids are considered, reasonable steps are taken to prevent any form of bid-rigging. 5 In order to give effect to the above, the attached Certificate of Bid Determination (SBD 9) must be completed and submitted with the bid: ¹ Includes price quotations, advertised competitive bids, limited bids and proposals. ² Bid rigging (or collusive bidding) occurs when businesses, that would otherwise be expected to compete, secretly conspire to raise prices or lower the quality of goods and / or services for purchasers who wish to acquire goods and / or services through a bidding process.
