(c) Public official means an officer... an employee of an agency in whom is vested the authority by law, rule, or regulation, or to whom the authority has been delegated, to appoint, employ, promote, or advance individuals or to recommend individuals for appointment, employment, promotion, or advancement in connection with employment in an agency.... (d) Relative... means an individual who is related to the public official as father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, son-in-law, daughter-inlaw, brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister, half brother, or half sister.
(2)(a) A public official may not appoint, employ, promote, or advance, or advocate for [the same] in or to a position in the agency in which the official is serving or over which the official exercises jurisdiction or control any individual who is a relative of the public official. An individual may not be appointed, employed, promoted, or advanced in or to a position in an agency if [same] has been advocated by a public official, serving in or exercising jurisdiction or control over the agency, who is a relative of the individual.... (NOTE) This subsection does not apply to persons serving in a volunteer capacity who provide emergency medical, firefighting, or police services. Such persons may receive, without losing their volunteer status, reimbursements for the costs of any training they get relating to the provision of volunteer emergency medical, firefighting, or police services and payment for any incidental expenses relating to those services that they provide. See CEO 13-1 (temporary employment of relative permitted in emergencies under , F.S.)
Ethics Commission can impose fines for violations Collection of fines: Salary deductions Garnishments Section , F.S.
As of May 1, 2013, all constitutional officers are required to complete 4 hours of ethics training annually that addresses, at a minimum: Art. II. 8 of the Florida Constitution (Sunshine Amendment), The Code of Ethics for Public Officers and Employees, and The public records and Government in the Sunshine laws of Florida Section , F.S.
A sheriff travels to a law enforcement conference in his agency vehicle. Following the conference he drives to North Carolina for a week of vacation. While agency policy precludes using an agency vehicle for personal use, he contends he is on duty 24-7 and may be called to return at any moment to attend official business. He may be subject to a complaint for misuse of public position. Section (6), F.S.
A sheriff speaks at a conference sponsored by a civic organization on the Opioid epidemic. They pay for hotel and present him with a $100 gift certificate to Bass Pro Shops. He must report the expenses on CE Form 10. He cannot accept the gift certificate.
Sheriff s spouse is an owner of an art gallery. The agency purchases several paintings to be displayed in the lobby. Purchase of the art violates section (3) due to a conflicting employment or contractual relationship.
Deputy conducts private surveillance on unfaithful spouses for compensation. His work is off-duty. A conflict of interest arises under section (7)(a) because it may compromise criminal investigations.
A sheriff has delegated authority to a promotional board. The board selects the sheriff s son as the top candidate for sergeant. The sheriff signs the personnel action form and related documents appointing the son as a sergeant. The anti-nepotism law prohibits the promotion.
