Kranc Clerk City of Oshawa 50 Centre Street South Oshawa, ON LIH 327 RE: NOMlNATlONlREAFFlRMATlON REPRESENTATIVES ON DRINKING WATER SOURCE PROTECTION COMMITTEES ( ).OUR FILE: C14 Ms. Kranc, the Joint Health &Social Services, Finance & Administration, Planning and Works Committees of Regional Council considered the above matter and at a meeting held on January 26, Council adopted the following recommendations of the Committee: a) THAT Regional Council supports the nomination from the Township of Brock of local Councillor Keith Shier as the new Durham municipal sector representative to the South Georgian Bay-Lake Simcoe Source Protection Committee and forwards this nomination to the Chair of the Lake Simcoe Source Protection Authority for consideration by the watershed municipalities; b) THAT Regional Council reaffirms that John Presta, (Director of Environmental Services Region of Durham Works Department) will continue as the Region's representative on the Credit Valley- Toronto-Central Lake Ontario (CTC) Source Protection Committee and that the Chair of the Toronto Region Source Protection Authority be so advised; c) THAT Regional Council reaffirms that Bruce Craig (President of Lakefront Utilities, Town of Cobourg) continue as the municipal sector representative from the Ganaraska Source Protection Area on the Trent Conservation Coalition (TCC) Source Protection Committee and that the Chair of the Lower Trent Source Protection Authority be so advised; d) THAT Regional Council supports the ongoing involvement of Regional staff in municipal, planning and technical working groups assisting the Source Protection Committees; 100% Post Consumer

PURPOSE This report provides: a ' -. <, a) background on the SPC member appointment process; and b) recommendations for continued municipalsector representationon the three source protection committees affecting Durham Region. 2. BACKGROUND The Clean Wafer Act (CWA) 2006 requires the establishment of source protection committees (SPCs), which are responsible for delivering locallydeveloped, science-based assessment reports and source protection plans. The regulations to the Clean Water Act establish source protection regions (SPRs) that, in most cases, include several Conservation Authority (CA) areas. ConservationAuthorities have been legally constituted as source protection authorities (SPAS)for source protection planning purposes. As shown in the maps in Attachments 1,2 and 3, Durham Region is within three source protection regions: the CTC (Credit Valley~~orontolCentral Lake Ontario) region in the west; the South Georgian Bay-Lake Simcoe (SGB-LS) SPR in the north; and the Trent Conservation Coalition (TCC) SPR in the east. Under the regulation288107, each SPR established its first source protection committee (SPC) in Each source protection region affecting Durham has a source protection committee consisting of a Chair and 21 representatives from watershed stakeholders. 2.1 SPC Composition For each SPR, the lead source protection authority appoints the members of the SPC. By regulation, one third of the members must be "persons appointed to reflect the interests of the municipalitiesthat are located in whole or in part in the...source protection region."

5 Report No.:2011-J-3 Page No.: Conditions of Appointment The regulation stipulates that SPC members: must live, work, operate a business, rent or own property in the source protection region or be an employee of a municipality located in whole or in partwithin the source protection region; may not be a Board member or employee'ofa conservation Authority within that source protection region; and may not be a consultant hiredto represent a stakeholder group. 2.3 Duration of ~ppoint'ments The duration of the first round of SPC appointments made in 2007 was until the first source protection plan was approved (likely in late 2012) and potentially up to 8 years. SPC members' terms will begin to expire in a staggered fashion, 113 in each year, following Plan approval. 2.4 Municipal SPC Nominees Where municipal staff or a re-elected Councillor was appointed by a source protection authority in 2007 to serve as a SPC municipal representative, they can continue to serve on the SPC. However, where a councillor serving as a municipal sector representative on an SPC was not re-elected, the municipal councils who nominated that member inay wish to nominate a new representative. The source protection authoritywill then conduct a process to appoint a new SPC municipal member in accordancewith the regulatio'ns. 3. CONCLUSION The primary focus of the Clean Water Act and the drinking water source protection planning process is on protecting municipal drinking water sources. The Region will be chiefly responsible for implementingthe drinking water source protection policies resultingfrom the source protection planwhich is the final deliverable of the SPC process, due to the Ministry of the Environmentby August Therefore, the Region and Durham area municipalitiesshould continue to play an active role in the work of the source protection committees and various working groups. It is therefore recommended that RegionalCouncil nominate or reaffirm Durham municipal representatives to these committees as recommended on page 1and advise the relevant source protection authority accordingly.
