To permit a minimum rear yard setback of 1.52 metres to an accessory building (cabana). 2. To permit a minimum interior side yard setback of 1.2 metres to an accessory building (cabana). 3. To permit a maximum lot coverage of 34.97% (30% dwelling, 4.97% cabana). By-law Requirement(s): 1. A minimum rear yard setback of 9.0 metres is required. 2. A minimum interior side yard setback of 1.5 metres is required. 3. A maximum lot coverage of 30% is permitted. Official Plan: VOP 2010 designation: Low-Rise Residential. The proposal conforms to the Official Plan Policies. Comments: The Owner is proposing to construct an accessory building (cabana) in the rear yard with the variances noted above. The Development Planning Department has no objection to the proposed variances. The dwelling maintains the required maximum lot coverage, and the increase is due to the cabana. The Development Planning Department has no objection to the reduced interior side yard setback. The proposed cabana is largely unenclosed, which mitigates the impact on the adjacent properties. The Planning Department has no objection to the reduced rear yard setback, subject to the applicant appropriately screening the rear wall of the proposed cabana from the neighbouring property with year-round landscaping. Urban Design and Cultural Heritage Division Comments: Staff has reviewed the application and has no built heritage concerns. The subject property is located in an area that is indicated to have archaeological potential. Therefore, the owner is advised that the following standard archaeological clauses will be applied going forward: i. Should archaeological resources be found on the property during construction activities, all work must cease and both the Ontario Ministry of Tourism, Culture and Sport and the City of Vaughan s Planning Department shall be notified immediately. ii. In the event that human remains are encountered during construction activities, the proponent must immediately cease all construction activities. The proponent shall contact the York Regional Police Department, the Regional Coroner and the Registrar of the Cemeteries Regulation Unit of the Ministry of Government and Consumer Services. 23 The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: The Development Planning Department supports the proposal, subject to the condition(s) below: Condition(s): That the Owner appropriately screens the proposed cabana with year-round landscaping to be shown on a Landscape Plan, and provide an accompanying letter of intent for review and approval. The Landscape Plan shall show the species and height of the proposed landscaping, to the satisfaction of the Development Planning Department. Other Comments: The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit. An air conditioning unit and/or pool equipment shall be setback a minimum of 1.2 metres from the interior side lot line; and may encroach a maximum of 1.5 metres into the required rear yard or exterior side yard of 9.0 metres and 4.5 metres respectively. Conditions of Approval: If the committee finds merit in the application, the following conditions of approval are recommended. 27 COMMENTS: PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
