1 (3.1 ) MINUTES PUBLIC HEARING MEETING City of Cranbrook Minutes of the Public Hearing held on Monday, September 14, 2015 at 6:00 p.m., in the Council Chamber, 40-1 oth Avenue South, Cranbrook, BC. Veg, Senior Planner Media Mayor Pratt called the Public Hearing to Order at 6:06 p.m. Mayor Pratt read a statement to the public regarding protocol and conduct of the meeting. OCPAMEND BYLAW 3829/15 Mayor Pratt stated that the Public Hearing would hear comments regarding the proposed "City of Cranbrook Official Community Plan Amendment Bylaw No. 3829, 2015". He advised that the bylaw proposes to change the OCP by changing the land use designation of the subject property from "Medium Density Residential" to "Park/Institutional/Recreation". Mayor Pratt further advised that the subject property is located at st Avenue North and is known as Sonja's Garden. Mayor Pratt invited comments regarding proposed "City of Cranbrook Official Community Plan Amendment Bylaw No. 3829, 2015". 1 September 14, 2015 (Public Hearing)

2 Janice Ivan, Executive Director, Canadian Mental Health Association (CMHA) of the Kootenays and applicant for the proposed development, spoke to Council regarding the proposed development at Sonja's Garden. She provided Council with an overview of the services provided by CMHA noting the identified need for affordable housirlg for seniors and adults. She also advised they have determined a need for more services, notably for seniors and families in the community. Ms. Ivan advised the original Sonja's Garden project approved in 1996 was for a two-phase project, with the second housing units to be completed as a future phase. She advised that the proposed addition in both services and affordable housing units was a good mix for the development. Mayor Pratt asked a second time if anyone wished to speak to the proposed "City of Cranbrook Official Community Plan Amendment Bylaw No. 3829, 2015". Dan Hicks, 1001 B 22 rd Ave. N spoke to Council regarding the proposed amendment and provided an overview of the second letter dated September 14, 2015 he submitted for Council's consideration. He raised the following concerns regarding the proposed development: Loss of neighborhood green space and erosion of townhouse values - elimination of the areas "suburban green-space park-like townhouse ambience" Suggestion for CMHA to acquire the adjacent properties to the west and north for the proposed additions. Move the two proposed apartment buildings back from 22 nd Avenue and plant xeriscape gardens - move the location of the proposed buildings westward to 21 st Ave. N. Request that the proponent revive the gardens by constructing two xeriscape gardens on the green spaces fronting 22 nd Avenue. Residential zoning variation rather than instit\.ltional rezoning - no further densification of the site be allowed. 3 Gary Lancaster, 1817 Mt. Connell Crescent spoke to Council supporting the proposed development noting that he was an advocate for seniors, many of whom are experiencing significant challenges finding suitable low income housing. He commented that the Golden Life housing development has a current wait list of over 200 seniors waiting to get in. He advised that he felt the addition of the two new buildings would provide for a good mix in the overall development. Robin Lowe, former resident at Sonja's Garden spoke to Council supporting the proposed development noting that she works at the Golden Life Management and sees a need for additional housing and services for seniors, as well as single parents and young families. David Manarey, 1005 B 22 nd Avenue North, spoke to Council expressing concerns with the proposed development, particularly with regard to viability of the project, possible devaluation of surrounding properties and concerns regarding some activities which have occurred in the area. He advised he supported D. Hicks letter, specifically the creation of new green space and the possibility of moving the two buildings westward towards 21 st Avenue North. Jo-Anne Gauthier, resident of Sonja's Garden, spoke to Council supporting the proposed development particularly with regard to addressing a need for more low income housing for seniors and persons with disabilities. She indicated support for the diversity the proposal would create, including having families in the complex. She advised she felt the proposal would make it easier for people to access services. Mike Gauthier, resident of Sonja's Garden, spoke to Council supporting the proposed development. He commented the new buildings would offer an addition 6 units for wheelchairs and more affordable housing for seniors. He also advised that both he and his wife Jo-Anne are members of the Board for People First in Cranbrook. Mayor Pratt asked a third and final time if anyone wished to speak to the proposed "City of Cranbrook Official Community Plan Amendment Bylaw No. 3829, 2015". 4 ZONING AMEND BYLAW 3830/15 Mayor Pratt stated that the Public Hearing would hear comments regarding the proposed "City of Cranbrook Zoning Amendment Bylaw No. 3830, 2015". He advised that the Bylaw proposes to add a new zone "Comprehensive Development Zone 6: CD-6 Sonja's Garden Housing Development" and rezone the property from Medium Density' Multiple Family Residential Zone: R-5 to Comprehensive Development Zone 6: CD-6 Sonja's Garden Housing Development. He advised the proposed Official Community Plan and Zoning amendments are to enable the development of two (2) new buildings adding a total of eighteen (18) one (1) bedroom apartment-style units and adding social services program and office space uses, as permissible uses on the subject property. Mayor Pratt further advised that the subject property is located at st Avenue North and is known as Sonja's Garden. Mayor Pratt invited comments regarding proposed "City of Cranbrook Zoning Amendment Bylaw No. 3830, 2015". Mayor Pratt asked a second time if anyone wished to speak to the proposed "City of Cranbrook Zoning Amendment Bylaw No ". Mayor Pratt asked a third and final time if anyone wished to speak to the proposed "City of Cranbrook Zoning Amendment Bylaw No. 3830, 2015". 5 ZONING AMEND BYLAW 3831/15 Mayor Pratt stated that the Public Hearing would hear comments regarding the proposed "City of Cranbrook Zoning Amendment Bylaw No. 3831,2015". He advised that the Bylaw proposes to add a new use "storage" to the C-2 Highway Commercial Zone specific to the referenced properties only. Additional provisions to regulate the storage use are also being proposed. The new regulations include: the storage use be located completely within an enclosed building or within a covered structure enclosed on a minimum of three sides; permit screening up to 2.7 metres in height for the open side of the three sided structure; the storage use be limited to a total gross floor area of 1506 m 2 ; the storage of automobiles, vehicles, RV's, boats, trailers, and heavy equipment will be prohibited; the use shall meet all applicable Provincial Health and Safety regulation and Fire regulations and shall be subject to fire and safety inspection. The purpose of the proposed amendment is to enable the development of a storage facility within the portion of the building located on the property. Mayor Pratt further advised that the subject property is located at 300-1st Avenue South. Mayor Pratt invited comments regarding proposed "City of Cranbrook Zoning Amendment Bylaw No. 3831, 2015". Mayor Pratt asked a second time if anyone wished to speak to the proposed "City of Cranbrook Zoning Amendment Bylaw No ". Kurt Swanson, rd Street South, spoke to Council in support of his application for the zoning amendment. He noted concerns submitted to Council regarding a potential increase in traffic in the back alleyway and the potential hours of operation. He advised that the hours of operation of the storage facility would be from 6:00 a.m. to 9:00 p.m. and that the majority of the access to the facility would be via the front door with a swipe key card access system.
