The Town Council will hear public comments on amendments to Chapter 11 Marine Activities, Structures Ways Article 1 Section 11-1 and 11-4 regarding definitions, and will take any appropriate action. NEW BUSINESS HEARING/ 79. The Town Council will consider setting a public hearing for August 6, 2018, regarding amendments to the Zoning Ordinance dealing with the Aquifer Protection Overlay (APO) and the Shoreland Protection Overlay (SPO) standards, and will take any appropriate action. (Town Manager Eldridge) 80. The Town Council will consider setting a public hearing for August 6, 2018 regarding ordinance amendments to Chapter 15 Traffic and Vehicles, Sec , regarding No Parking areas on Jordan Avenue and Longfellow Avenue, and will take any appropriate action. The Town Council will consider approving A Resolution Authorizing an Appropriation of $75,000 from Available TIF Revenues for the Purpose of Funding Site Evaluation and Preliminary Design of a Downtown Parking Structure, and will take any appropriate action. 3 Brunswick Town Council Agenda July 16, 2018 Council Notes and Suggested Motions MANAGER S REPORT a) Financial update: Copies of the financial reports are included in your packet. b) Nomination papers availability: Nomination papers for Town Council and School Board will be available at the Clerk s office on July 27 th, and will be due on September 7 th. c) Animal Control: Town Manager Eldridge will update the Town Council on the Town s response to the rabies outbreak. d) DownEast magazine s Best of Maine local winners: DownEast Magazine s annual readers poll produced numerous Brunswick category winners. The Brunswick Inn Pejepscot Historical Society Skillins (tie) Curtis Memorial Library Bowdoin College Wilbur s of Maine Chef Cara Stadler Crystal Spring Farm Brunswick-Topsham Land Trust s Farmers Market Gelato Fiasco PUBLIC HEARING 78. Notes: This is the required public hearing to consider proposed ordinance amendments to Chapter 11 Marine Activities, Structures and Ways. Dan Devereaux, Marine Resource Officer and Harbor Master, along with the Rivers & Coastal Waters Commission, request to add aquaculture to the list of definitions in Article 1, using the same definition as the Maine Department of Marine Resources. The second request is to add criteria for winterization of mooring buoys in order to improve public safety by removing navigational hazards created by winterization techniques that are less visible to boaters. A copy of a memo from MRO Devereaux, as well as a redlined version of the proposed amendments, are included in your packet. Motion to adopt proposed ordinance amendments to Chapter 11 Marine Activities, Structures and Ways. NEW BUSINESS 79. Notes: The Town Council is asked to set a public hearing for August 6, 2018, regarding amendments to the Zoning Ordinance regarding the Aquifer Protection Overlay (APO) and the Shoreland Protection Overlay (SPO) standards. Staff has identified errors in the APO and SPO standards. These errors have been verified and 3

4 corrected in the draft amendments, which were reviewed by the Planning Board on March 6, 2018, who unanimously voted to recommend to the Council at a public hearing on March 27, A copy of a memo from Jared Woolston, Town Planner, the draft amendments, and an detailing staff correspondence with the Brunswick- Topsham Water District regarding the APO error are included in your packet. Town Planner Jared Woolston will be present at the meeting to answer any questions. Motion to set a public hearing for August 6, 2018 to consider amendments to the Brunswick Zoning Ordinance regulating the Aquifer Protection Overlay (APO) and the Shoreland Protection Overlay (SPO) standards. 80. Notes: The Town Council is asked to set a public hearing for August 6, 2018, to consider ordinance amendments to Chapter 15 - Traffic and Vehicles, Sec regarding extensions to current no parking areas. The Police Department has reviewed two locations for no-parking extensions due to constituent or motorist complaints. The first is to designate no parking on the south side of Jordan Avenue between Edwards Field and Wheeler Park, due to a curve in the road where motorists are unable to easily view oncoming traffic when cars are parked in this area. The second is to extend the no parking area abutting the crosswalk on the south side of Longfellow Street at the Coffin Street Extension to give better visibility to motorists of the crosswalk and pedestrians. A copy of a memo from Commander Waltz and the proposed ordinance changes are included in your packet. (Town Manager Eldridge) Motion to set a public hearing for August 6, 2018 to consider ordinance amendments to Chapter 15 - Traffic and Vehicles, Sec regarding an extension to the No Parking on the south side of Jordan Avenue between Edwards Field and Wheeler Park, and an extension to the No Parking area abutting the crosswalk on the south side of Longfellow Street at the Coffin Street Extension. 81. Notes: Over time, several conceptual alternatives regarding parking in the downtown have been discussed, including developing the BDC lot on Weymouth Street, developing the MDOT lot on Cedar Street, and exploring a downtown parking structure. In order to have a parking structure option ready for potential funding, a site selection/feasibility study is needed. Funding for such a study was included in the budget at $40,000 from TIF revenues, and the Town recently issued an RFP. Responses to the RFP were reviewed and the cost of the preferred proposal exceeded the amount appropriated. The Town would like to let the $40,000 budget appropriation lapse back to the TIF and then appropriate the full $75,000 from the TIF for this project. A copy of a memo from Town Manager Eldridge and the resolution appropriating $75,000 are included in your packet. Motion to adopt A Resolution Authorizing an Appropriation of $75,000 from Available TIF Revenues for the Purpose of Funding Site Evaluation and Preliminary Design of a Downtown Parking Structure. 4

5 82. Notes: This item is to confirm the Town Manager s appointment of Justin Hennessey as the Tax Assessor, as required under section 302(a) of the Brunswick Town Charter. A copy of a memo from Manager Eldridge, Mr. Hennessey s resume, and the position description are included in your packet. Motion to confirm the Town Manager s appointment of Justin Hennessey as Tax Assessor. 83. Notes: The Town Council is asked to provide a letter supporting the Maine Department of Transportation s (MDOT s) recommendations for the replacement of the Frank J. Wood Bridge. A copy of a draft letter is included in your packet. Motion to authorize the Town Council Chair to send a letter on behalf of the Town Council to the Maine Department of Transportation (MDOT) supporting MDOT s recommendation for the replacement of the Frank J. Wood Bridge. 84. Notes: The Town Council will vote for a representative to the Maine Municipal Association s (MMA) Legislative Policy Committee (LPC), due by August 2, A copy of a memorandum from Maine Municipal Association, the ballot, and a candidate profile are included in your packet. * *Public comment will be limited to Brunswick residents and for a maximum of 2 minutes* Motion to cast Brunswick s vote for Peter Joseph, Freeport Town Manager, for MMA s Legislative Policy Committee. 85. Notes: The Council Chair may appoint an additional member of the Council or another elected or appointed official to serve on Maine Municipal Association s Legislative Policy Committee, which meets once a month in Augusta from January through May. Councilor Kathy Wilson has served on this committee for the past two years. A copy of a memo from Maine Municipal Association is included in your packet. Motion to appoint to MMA s Legislative Policy Committee. 86. Notes: The Town Manager is requesting that the Town Council ratify a three-year contract for the Brunswick Emergency Communications Officers Association (BECOA). A copy of a memo from Town Manager Eldridge and a redlined version of the contract are included in your packet. Motion to ratify the three-year contract between the Town of Brunswick and the Brunswick Emergency Communications Officers Association (BECOA) for July 1, 2017 to June 30,

6 87. Notes: At this time the Appointments Committee will make nominations to fill vacancies on Town Boards and Committees.
