1 Reference: C.N TREATIES-IV.4 (Depositary Notification) INTERNATIONAL COVENANT ON CIVIL AND POLITICAL RIGHTS NEW YORK, 16 DECEMBER 1966 GUATEMALA: NOTIFICATION UNDER ARTICLE 4 (3) The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following: The above action was effected on 10 November (Translation) (Original: Spanish) Sir, New York, 10 November 2014 I have the honour to transmit to you, in follow-up to my letter No. J/1/1483 of 13 October 2014, a notification from the Government of Guatemala in accordance with article 4, paragraph 3, of the International Covenant on Civil and Political Rights. As you will recall, on 21 September 2014, the President of the Republic of Guatemala, in the Council of Ministers, declared a state of alert in the municipality of San Juan Sacatepéquez, Department of Guatemala, by Government Decree No As the conditions that gave rise to the declaration of the state of alert still prevailed, the President of the Republic of Guatemala, by Government Decrees Nos of 2 October 2014 and of 16 October 2014, twice extended the state of alert in the municipality of San Juan Sacatepéquez, Department of Guatemala, for an additional 15 days. I wish to inform you that the state of alert that was implemented in the territory of the municipality of San Juan Sacatepéquez, Department of Guatemala, was lifted by Government Decree No of 31 October I cordially request your good offices in communicating the contents of this notification and the attached documents to the other States parties. 2 - 2 - Ministry of Foreign Affairs Guatemala, Central America DH/ Guatemala, 24 October 2014 Sir, I have the honour to write to you in follow-up to letter No of 8 October 2014, whereby you were informed, in accordance with article 4, paragraph 3, of the International Covenant on Civil and Political Rights, that on 2 October 2014, by Government Decree No , Mr. Otto Pérez Molina, President of the Republic of Guatemala, in the Council of Ministers, declared an extension of the state of alert in the municipality of San Juan Sacatepéquez, Department of Guatemala, for a period of an additional 15 days. In this connection, I am transmitting herewith a copy of Government Decree No of 16 October 2014, whereby Mr. Otto Pérez Molina, President of the Republic of Guatemala, in the Council of Ministers, decreed an extension of the state of alert declared in Government Decree No , which had been extended by Government Decree No , for an additional 15 days, in view of the persistence of the conditions that prompted the issuance of those Decrees. 3 - 3 - Office of the President of the Republic Extension, for an additional 15 days, of the period of the state of alert declared by Government Decree No of 21 September 2014, which was extended by Government Decree No of 2 October 2014, issued by the President of the Republic in the Council of Ministers and expiring on 20 October Guatemala City, 16 October 2014 Whereas Government Decree No The President of the Republic By Government Decree No of 21 September 2014, the President of the Republic, in the Council of Ministers, declared a state of alert in the municipality of San Juan Sacatepéquez, Department of Guatemala, Whereas In the municipality of San Juan Sacatepéquez, Department of Guatemala, the conditions that prompted the declaration of the aforementioned state of alert still prevail and are jeopardizing the constitutional order, governance and security of the State, affecting individuals and families and endangering the lives, liberty, justice, security, peace and full development of the people, thereby making it necessary to extend the state of alert, Therefore In exercise of the functions conferred on him by articles 138 and 183 (f) of the Political Constitution of the Republic of Guatemala, and on the basis of article 139 of the Constitution and articles 1, 2, 8 and 34 of Decree No. 7 of the National Constituent Assembly (Public Order Act), In the Council of Ministers, Hereby decrees: Article 1. Extension. The period of the state of alert declared by Government Decree No of 21 September 2014, which was extended by Government Decree No of 2 October 2014, issued by the President of the Republic in the Council of Ministers and expiring on 20 October 2014, is hereby extended for an additional 15 days. Article 2. Justification. The aforementioned state of alert is being extended in view of the persistence of the conditions that prompted the issuance of the relevant Government Decree. Article 3. Entry into force. The present Decree shall enter into force immediately and shall be published in the Official Gazette (Diario de Centro América).

Guatemala City, 31 October 2014 Whereas Government Decree No The President of the Republic In accordance with the provisions of the Political Constitution of the Republic of Guatemala, it is the obligation of the State and its authorities to afford the residents of the nation the full enjoyment of the rights guaranteed under the Constitution; and, by Government Decree No of 21 September 2014, a state of alert was declared in the municipality of San Juan Sacatepéquez, Department of Guatemala, Republic of Guatemala, which was extended by Government Decrees Nos of 2 October 2014 and of 16 October 2014, Whereas During the state of alert declared in the municipality of San Juan Sacatepéquez, Department of Guatemala, Republic of Guatemala, the appropriate actions and measures were taken to safeguard the lives, integrity, security and property of its people. The circumstances that led to the declaration no longer obtaining, it is appropriate to issue the legal provision to lift the state of alert, Therefore In exercise of the functions conferred under articles 138 and 183, paragraph (e), of the Political Constitution of the Republic of Guatemala, and on the basis of articles 1 and 34 of Decree No. 7 of the Constituent Assembly, Public Order Act, In the Council of Ministers, Hereby decrees: Article 1. The extension of the state of alert declared in the municipality of San Juan Sacatepéquez, Department of Guatemala, Republic of Guatemala, is repealed. Article 2. Government Decree No of 16 October 2014 is repealed. Article 3. Entry into force.
