2 TENDER NOTIFICATION NO. STS/26/ADGP/KSRP/ DATED: The Tenders are invited in Two Cover System " as per the Karnataka Transparency in Public Procurement Act, 1999 and Karnataka Transparency in Public Procurement Rules, 2000 through e-procurement portal of Government of Karnataka ( for supply and installation of the following Solar street lights (Double light) required for KSRP Battalions/Training Schools. Manufacturer/ Authorised dealer willing to participate in this tender shall necessarily register themselves with the above mentioned e-procurement portal. Note: (1) In the event of the specified date of opening of First Cover (Technical Bid) being declared a holiday for the purchaser, the First Cover (Technical Bid) shall be opened on the next working day. (2) Completed tenders shall be uploaded through e-tendering system by the Tenderers using their user ID. I. Technical Bid: The Technical Bid should contain the following information about the tenderer namely:- A. Details of the Tenderer: (Appendix A) B. EARNEST MONEY DEPOSIT: (Appendix B) a) Total EMD of Rs.75,000/- is to be paid online through any of the following 4 modes: a. Credit Card b. Direct Debit c. National Electronic Fund Transfer (NEFT) d. Over the Counter (OTC) e. Details of the payment modes are mentioned in the bid document ( e-payment ) b) The EMD will remain valid for a period of 180 days from the date of submission of tender. c) Any other modes of payment shall not be acceptable.

The tenderer should have executed a similar project of Karnataka State Govt. Departments/Karnataka Police or any other State Police/Central Police Organization/Defence Services in the Country in last 3 years. 2. Capabilities of the tenderer with respect to personnel, equipment and manufacturing facilities Documentary evidence in this regard from the appropriate authorities to be enclosed. Details of all such projects undertaken by the tenderer during last 3 years to be furnished along with details of permanent employees on the rolls of the firm. 3. Financial status and capacity The bidder should have annual turnover of Rs lakhs from the sale of items and allied items. Audited balance sheet certified by a chartered accountant for the last three completed financial years , and to be enclosed. 4. Should be an income tax assesses 5. Should not have been black listed by any state government /central government or its agencies. 6 To mention the status of the firm Income tax returns filed for the last three years , and to be enclosed. Self declaration to be enclosed. Authorisation certificate in case of a dealer II. Financial bid :- Price should be uploaded online through e-procurement portal only. III. Evaluation Criteria: Based on the lowest evaluated price for the items subject to meeting the pre-qualification criteria and approval.

4 IV. Tender processing fee: Tender processing fee of Rs.550/- shall be paid separately online through e-procurement portal before bid submission V. Security Deposit: 5% of the purchase order value shall be paid in the form of DD drawn in favour of Additional Director General of Police, Karnataka State Reserve Police, payable at Bangalore by the successful bidder. VI. The tenderers should give demo after opening of Technical Bid and before opening of Commercial Bid on the date of calling. VII. The General terms and conditions are given in Appendix D. VIII. We agree that the EMD may be forfeited by the purchaser if we: (a) Withdraw our tender during the period of tender validity specified by us in the Tender Form. (b) Do not accept the correction of the Tender Price. (c) Do not sign the Agreement within the specified time limit in case we are successful and notification of award has been communicated. 8 INSTRUCTIONS: The Tenderer should provide the details mentioned above based on its own technical capability. Technical capability of the tenderer parent company or its subsidiary or any associate company will not be considered for assessment of the qualification parameters of the tender. The tender should not have been black listed by any state government/ central government or any of its agencies. If it is found that the tenderer has not disclosed the above information during Bid stage and such information has been found after the award of the contract Additional Director General of Police, Karnataka State Reserve Police, will impose a penalty of 10% on total cost of the scheme besides forfeiting the performance security. Such Tenderer will also be black listed for all further of our contracts. Signature

9 APPENDIX-D GENERAL TERMS AND CONDITIONS OF TENDER: 1) Tenderers should not be associated or have been associated in the past, directly or indirectly with a firm or any of its affiliates which have been engaged by the purchaser to provide consulting services for the preparation of the design, specifications and other documents to be used for the procurement of the goods to be purchased under this Invitation of Tenders. 2) Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka. 3) The tenderers should mention proper specification for the items they intend to supply. Their rates should be legibly indicated in both words and figures. The tenderer should furnish his full address and affix his signature on each page of the tender form. 4) The tenders which do not accompany EMD are liable to be rejected. The EMD of the unsuccessful tenderers will be refunded soon after the tenders are finalized. The EMD of the successful tenderers will be refunded only after the completion of supplies and verification of items. The tenderer who do not give demo of the items is liable to be rejected. 5) The successful tenderer should complete his supplies within the stipulated period as per the supply order issued by Additional Director General of Police, Karnataka State Reserve Police. 6) For the fulfillment of contract, the successful tenderer is required to execute an agreement on Stamp Paper of value Rs.100/- 7) The successful tenderer should enter into an agreement with the Department duly assuring his complete supplies within the stipulated period and failure on the part of the supplier to deliver any or all the items or to perform the services within the period(s) specified in the contract, the purchaser shall, without prejudice to its other remedies under the contract, deduct from the Contract Price, as liquidated damages, a sum equivalent to 0.5% of the delivered price of the delayed items or unperformed services for each week or part thereof of delay until actual delivery or performance, up to a maximum deduction of 10% of the contract price. Once the maximum is reached, the purchaser may consider termination of the contract pursuant to General Conditions of Contract. 8) The items have to be supplied and installed in the Karnataka State Reserve Police Battalions located in Bengaluru, Mysuru, Shivamogga, Hassan, Mangaluru, Shiggavi, Belagavi, Kalaburagi, Munirabad & Vijayapura.

10 9) The Additional Director General of Police, Karnataka State Reserve Police through a sub-committee arrange for negotiations of the rates after opening of tenders in order to obtain competitive rates for the best quality of materials with the L1 quoted firm. 10) The items supplied will be subject to scrutiny/verification both by the Chairman and Members of the Departmental Purchase Committee and experts in the concerned fields for quality. 11) In respect of equipment quoted for, the supplier should indicate the period of warranty against any manufacturing defects along with bid documents. 12) The rate quoted should be valid for one year. 13) After finalisation of the tender, orders will be placed with the approved tenderer. If the tenderer fails to supply the articles within the specified period, the department may resort to cancellation of the said order and to place an order with the next lowest tenderer. In such an eventuality, the defaulting firms/tenderer will be required to make good any loss which the Department may incur besides paying specified penalty. 14) The prices quoted should be inclusive of all taxes, but the taxes should be indicated separately. 15) In respect of items quoted for, the supplier should indicate the period of warranty against any manufacturing defects along with bid documents. 16) The tenderers including the manufacturers should furnish a certificate to the effect that the price quoted by them is comparable/almost comparable to the factory s price or manufacturer s price list and that the price quoted is not unreasonably high on the bond paper of value Rs.10/-. 17) The tenderers should indicate the rates for article for I.S.I mark quality wherever I.S.I specifications have been laid down, in such cases the tenderer should furnish an attested photo copy of valid I.S.I License along with the tender, failing which such offers will be rejected. In case authorized dealer quote on behalf of their manufacturers, the authorization letter from their manufacturer should be enclosed to the quotation. In respect of ISI specification articles, the tenderer should indicate against each quoted item the relevant ISI numbers. Test certificates from authorized laboratories may also be enclosed with the Tender. 18) The tenderers (Agent/Dealer) should furnish full and clear address of the manufacturing unit vis-à-vis the product they intend to quote. Failure to do so, their quotation will be liable for rejection.

11 19) The tenderers should bear the testing charges if any, which will be intimated at a later date. The tenderer should make his own arrangements to deliver the items. 20) The tenderers who have registered with Director of Industries and Commerce, Bangalore, Government of Karnataka as a Small Scale Industries Unit, shall enclose to the quotation a copy of the valid S.S.I. Certificate issued by the Industries and Commerce Department, duly attested by a Gazetted Officer for claiming the purchase preference as per new Industrial Policy of the Government. 21) The tenderers should indicate full particulars about the make, brand, name of the manufacturer and detailed specification of the material offered by them. 22) A declaration to the effect that I declare that I am the manufacturer/ authorised dealer of manufacturer/holder of Ex-stock of the stores intended for should be duly signed by the tenderer in each case and same should be furnished along with the Quotation. 23) The tenderers should intimate whether the tenderer is a manufacturer/ authorised dealer and to furnish the documentary proof to that effect without fail. 24) The Court of Bangalore shall alone have jurisdiction to dispute arising out of or in respect of the contract. 25) Failure on the part of the firm whose offer has been accepted and proposed order placed to complete the formalities like execution of the agreement and remittance of security deposit within the time given will empower the Additional Director General of Police, Karnataka State Reserve Police to forfeit the deposits remitted against the tender notice to the department by the said firm. 26) Each article tendered will be considered as a separate and distinct tender in itself and rates for each item should be quoted separately in the e-procurement platform. 27) In case of articles rejected as not being in accordance with the approved sample or has been received in damaged condition the tenderer should be prepared to take them back and replace them by correct material within a week without additional cost to this department. 28) In matters of dispute regarding supply not being in conformity with the approved quality or the performance of the terms or any other matter, the decision of the Additional Director General of Police, Karnataka State Reserve Police shall be final on both the parties. 29) The Additional Director General of Police, Karnataka State Reserve Police is empowered to ask for further guarantee from tenderer to the extent considered necessary, in case the value of the orders placed in individual case is very heavy.

12 30) The Tender is not transferable. 31) The Department will increase/decrease the quantity, if necessary, without assigning any reason. 32) The Tender Inviting Authority will open the Technical bid in this office on Technical Bid open Date & Time. After opening of Technical bid, tender scrutiny and evaluation committee will evaluate the tenderer's capacity on the basis of criteria specified in the tender document and on this basis prepare a list of qualified tenderers and the same will be presented before the Tender Accepting Committee. 33) Tenderer should furnish support centers in Karnataka with name of city, full address, name of the contact person, telephone no, fax no & details. 34) Payment will be made only after satisfactory supply and installation by the successful tenderer. 35) The Additional Director General of Police, Karnataka State Reserve Police reserves the right either to accept or reject or postponed or extend or cancel any tender. The decision of the Additional Director General of Police, Karnataka State Reserve Police will be final.
