1 V. A. CITY OF WARRENVILLE CITY COUNCIL Minutes of Regular Council Held on Monday, May 18, 2015 At the Warrenville City Hall 28W701 Stafford Place I. OPENING CEREMONIES A. Call to Order Mayor Brummel called the meeting to order at 7:00 p.m. B. Roll Call Present: Mayor David Brummel, Ald. Stu Aschauer, Fred Bevier, Clare Barry, Kathryn Davolos, Leah Goodman, Michael Hoffmann, William Weidner, and Robert Wilson Absent: None Also Present: City Administrator John Coakley, Assistant City Administrator Jennifer McMahon, Finance Director Kevin Dahlstrand, Community Development Director Ron Mentzer, Senior Civil Engineer Phil Kuchler, Police Chief Raymond Turano, Attorney David Freeman, and City Clerk Emily Larson Also Absent: Treasurer Robert Johnson C. Pledge of Allegiance II. CITIZENS COMMENTS Pat O Conner, Warren Avenue, said he watches Channel 10 all the time and suggested that there be some country music added to Channel 10. Bob Siebert, Albright Court, noting that some of the dead trees on Butterfield Road have been replaced twice, asked who is paying for the replacement trees. Dan Leonard, Riverside Drive, said the VFW is hosting a Healing Field of Flags to honor all veterans and asked for volunteers to help put the flags together on Tuesday, May 19. The flags will be displayed from May 20 to 26, The VFW is having an open house on Memorial Day after the memorial service at noon. Bob Bulmash, White Oak Drive, suggested the City have a drop-off station for unused medical drugs as a way to help keep the environment clean. III. OFFICIALS AND STAFF COMMENTS A. Mayor Warrenville Road Bridge Closure

2 Minutes of May 18, 2015, Regular Council Meeting Page 2 of 8 Mayor Brummel reminded everyone that the Warrenville Road Bridge will be closed on May 21 through December. Detour signs will be posted. Bike Rodeo Mayor Brummel stated the Bicyclist and Pedestrian Advisory Commission s 10th Annual Bike Rodeo held on May 16, 2015, was a huge success. Over 100 kids came to have their bikes checked and 12 new bikes were given away. Mayors Fitness Challenge Mayor Brummel reminded everyone that citizens may still sign up for the fitness challenge on the City s website. Community Survey Mayor Brummel announced that Warrenville was number 40 out of 298 in a 2015 Safest Places in Illinois survey, and placed 12th out of 100 in the 2015 NICHE rankings for the best suburbs in the Chicago Metro area survey. He thanked Chief Turano and the Police Department for keeping the community safe. Johnson Elementary School International Day Mayor Brummel attended International Day at Johnson School and thanked the staff for providing a great cultural experience for the students. Coffee with the Mayor Mayor Brummel invited residents to meet him at City Hall on May 23rd, from 7:30 a.m. to 9:30 a.m., for an informal time to share information and answer any questions or concerns from residents. B. Clerk Drug Disposal Drop-off Clerk Larson noted that unused medical drugs can be taken to Fire Station #1 on Brookdale Road in Naperville, every Saturday morning. Concerts on the Commons Clerk Larson announced that the Warrenville Library sponsored Concerts on the Commons will start on June 3, at 7:00 p.m., and the first bank will be The Barefoot Hawaiian. Warrenville in Bloom Clerk Larson announced that Warrenville in Bloom s summer program is going to recognize residents front yards by placing a sign saying Curb Appeal Award. Residents may suggest a neighbor s yard or even their own. C. Treasurer No report. D. Aldermen

Goodman, along with Mayor Brummel and City Administrator Coakley, joined members of DuPage Mayors and Managers on a trip to Springfield to talk to our representatives and Senators and explaining our position regarding the proposed State budget cuts. Residents may go to the DMMC s website protectmytown.com and express your concerns. Concerts on the Commons Ald. Goodman said the Warrenville Library sponsored Concerts on the Commons are held every Wednesday from June 3 to August 26 and is a wonderful way to listen to great music and meet new people. Warrenville in Bloom Ald. Goodman urged residents to come to Warrenville in Bloom s Planting Pride Day on Saturday, May 23, at 8:30 a.m., and help plant annual flowers around the City. Shredding Day Chief Turano reminded everyone that the City will be holding a shredding day on May 23, from 9:00 a.m., to noon, at the Public Works facility on Mignin Drive. Vacation Watch Chief Turano urged residents to call the Police Department when going on vacation. Pertinent information is made available to officers who physically check on the property during that time frame. School is Out Chief Turano announced that school will be out in two weeks and urged residents and drivers to be mindful of kids who will be on the streets and sidewalks walking and riding their bikes around the City. Wilson, to approve the Consent Agenda as amended. ROLL CALL VOTE: Aye: Ald. Barry, Goodman, Weidner, Hoffmann, Bevier, Davolos, Aschauer, and Wilson Nay: None MOTION ADOPTED C Road Program Change Order No. 1 ALD. BEVIER MOVED, second by Ald. Barry, to accept Community Development and Planning Committee recommendation and approve Change Order No. 1 in the amount of $416,938.25, increasing the 2015 Road Program contract to $2,384,687.74, as it is required by circumstances not reasonably foreseen at the time the original contract was signed, is germane to the original contract as signed, and is in the best interests of the City. Discussion: Ald. Bevier said he will vote in favor of the motion but would have preferred to go out for bids on the change order. He said his main concern is that there are no hydrants in that area and would prefer to have the proposed hydrant put in service before the additional work is started. Senior Civil Engineer Kuchler explained that the water connection has not been completed at Batavia Road. He will take to the contractor is see if the installation of a hydrant can be expedited. Ald. Bevier said his preference would be to install the hydrant before phase two of the project is started. Senior Civil Engineer Kuchler said the connecting would be done when work is switched to the south side of the river during the month of June. Ald. Hoffmann said his concern is for the safety of the residents when the cross cuts are being done. The streets would be unpassable and emergency services would have a hard time getting to residents when the cross cuts are being made on Williams Road. He would prefer waiting until the bridge is open for emergency access. Senior Civil Engineer Kuchler explained that Iroquois Court would be open for emergency service vehicles and residents living south of Iroquois Court South on Williams Road would travel on the east side of Williams Road. Ald. Hoffmann asked where the cuts would be made on Williams Road. Senior Civil Engineer Kuchler said the cuts would be done between north Iroquois Court and south Iroquois Court. City Administrator Coakley stated that the contractors must always provide access for emergency service vehicles at any time during construction. He explained that this change order is due to unique circumstances and there are exceptions in the City Code and in the State statute to allow for some flexibility.

Davolos will be voting for this motion and project has already been delayed for a year and to wait to go out for bid would only increase the cost. She feels the project must go forward to lessen the inconvenience to the residents. Mayor Brummel reiterated that emergency vehicles would have access to residents at any time during construction for any project in any part of the community. Ald. Goodman thanked Attorney Freeman for his memo that clearly explained that the change order that is necessary and was no foreseeable at the time the contract was signed, the change order is germane to the original contract as signed, and the changer order is in the best interest of the unit of State of local governments and authorized by law. Ald. Hoffmann asked if this project was in the original contract. Senior Civil Engineer Kuchler said the 2015 Road Program is the original contract and the sewer and water is germane to the 2015 Road Program because that section of Williams Road will be resurfaced and they have sewer and water extension included in the contract. ROLL CALL VOTE: Aye: Ald. Davolos, Aschauer, Hoffmann, Bevier, Wilson, Barry, Goodman, and Weidner Nay: None MOTION ADOPTED D. Proposed TIF #4 ALD. HOFFMANN MOVED, second by Ald. Bevier, to accept Community Development and Planning Committee recommendation and assign Aldermen Davolos and Bevier to work with staff to implement the next step recommendations outlined in the May 7, 2015, proposed TIF #4 memorandum from Community Development Director Mentzer. Discussion: Ald. Hoffmann asked if this motion is approved tonight, what would be the cost to the City to implement the next step for a TIF #4. Community Development Director Mentzer said there would no cost to the City for this action. The two aldermen and staff would interview consultants who have previously done work for the City, determine who would be the best consultant to work to define the proposed TIF #4 area and the land planning associated with the Route 59 and Route 56 subarea, negotiate a proposal with the firm best suited for that work, and that recommendation would be brought back to the City Council for discussion and decision to move forward. All of this work would be done by staff at no cost. If the Council decides to move forward, then there would be a cost involved. Once approved there would be a minor cost for the TIF attorney to verify whether certain parcels are legally able to be included in the proposed TIF boundaries or not.

7 Minutes of May 18, 2015, Regular Council Meeting Page 7 of 8 Ald. Hoffmann asked if someone would explain how a TIF works. Community Development Director Mentzer explained that when a TIF is established there is a base assessed valuation established for that area and that is the frozen base value. If there is a growth in the value of the property in that area the total valuation in that area will increase. The assessor will capture that increase and assess higher taxes due to the increase values and then more taxes would be collected, if the TIF is there the increase in taxes that are collected between what would have been collected off of the base, the frozen level, and what s collected from the increased level, the growth in the EAV, that increase tax revenue comes to the TIF allocation account that the City controls through the TIF Act. Under the TIF Act, the City may use those funds for very specific purposes. One allowable use for TIF funds is to construct public infrastructure to attract economic growth and private investments. Ald. Hoffmann asked if a TIF raises the amount of money that a property owner outside the TIF has to pay. Community Development Director Mentzer said there is a written opinion by staff and the Attorney stating there is a very minimal increase. Ald. Hoffmann commented that when there is a tax freeze for over 20 years, that area is not paying its fair share and the surrounding areas must make up the difference. He feels this is not fair to the taxpayers outside the TIF area and the statute should be changed before Warrenville spends any more money on a TIF district. Ald. Weidner called for the question. ROLL CALL VOTE: Aye: Ald. Hoffmann, Goodman, Barry, Wilson, Aschauer, Weidner, Bevier, and Davolos Nay: None MOTION ADOPTED VII. REGULAR AGENDA A. TIF District #4 ALD. BARRY MOVED, second by Ald. Bevier, to direct the aldermen and staff working on the next steps for the proposed TIF District #4 to also conduct an assessment and make a recommendation on the TIF #3 boundaries and whether or not to remove properties owned by Alderman Hoffmann. Discussion: City Administrator Coakley said is requesting the same aldermen and staff consider the matter of the Hoffmann property in TIF #3 and bring a recommendation back to the City Council. There would no cost associated with this unless some legal advice is sought. There is a memo dated May 12, 2015 on the TIF #3 boundaries and an opinion from Attorney Freeman that outlines the requirements of the TIF Act regarding disclosure and abstain from all participation and communication pertaining to the TIF District where an elected official owns real property.
