Subordinate Legislation (Regulations, Rules, etc.) (Note: The instruments of subordinate legislation shown below are listed in the chronological order of their being made, and not in numerical order, because SL No. 8 of 2014 was made out of turn.) A. Subordinate legislation notified on the Queensland Legislation website on 3 February SL No. 8 of 2014: Transport and Other Legislation Amendment Regulation (No. 1) 2014 As stated in its Explanatory Notes, the policy objective of this Regulation is to ensure that, with the commencement in Queensland of the Heavy Vehicle National Law Act 2012, containing the Heavy Vehicle National Law ( the Law ) which regulates vehicles with a gross vehicle mass of more than 4.5 tonnes, there is no overlap in the legislative provisions which regulate heavy vehicles. This objective is effected by this Regulation s: making consequential amendments to remove provisions that regulate heavy vehicles that will be covered by the national law; inserting references to the Law where relevant; making a number of miscellaneous amendments of a machinery nature, arising out of the consequential amendments, to enhance the operation of the legislation ; repealing the Transport Operations (Road Use Management Fatigue Management) Regulation 2008 (SL No. 296 of 2008), as fatigue management of drivers of heavy vehicles will be regulated under the Heavy Vehicle National Law; repealing the Transport Operations (Road Use Management Mass, Dimensions and Loading) Regulation 2005 (SL No. 188 of 2005), since a substantial part of that Regulation deals with matters applying only to heavy vehicles that will be covered by the national law, with the remaining provisions dealing with light vehicles being transferred into the Transport Operations (Road Use Management Vehicle Standards and Safety) Regulation 2010; and, merging provisions relating to vehicle standards exemptions and dimension exemptions into the same provisions, thus providing consistency in the processes for applying for, deciding and issuing these exemptions where possible.

3 1 7 February 2014 page 3 In summary, this Regulation amends the following Regulations and Standard, in addition to repealing the two Regulations specified above: Police Powers and Responsibilities Regulation 2012; Queensland Civil and Administrative Tribunal Regulation 2009; State Penalties Enforcement Regulation 2000; Tow Truck Regulation 2009; Traffic Regulation 1962; Transport Infrastructure (Rail) Regulation 2006; Transport Operations (Passenger Transport) Regulation 2005; Transport Operations (Passenger Transport) Standard 2010; Transport Operations (Road Use Management Accreditation and Other Provisions) Regulation 2005; Transport Operations (Road Use Management Driver Licensing) Regulation 2010; Transport Operations (Road Use Management Road Rules) Regulation 2009; Transport Operations (Road Use Management Vehicle Registration) Regulation 2010; and, Transport Operations (Road Use Management Vehicle Standards and Safety) Regulation Pursuant to s2 (Commencement), this Regulation commenced on 10 February 2014 on the commencement of Part 4 [Amendment of Transport Operations (Road Use Management) Act 1995] of the Transport and Other Legislation (Heavy Vehicle National Law) Amendment Act 2013 (Act No. 26 of 2013). B. Subordinate legislation notified on the Queensland Legislation website on 7 February SL No. 12 of 2014: Animal Care and Protection Amendment Regulation (No. 1) 2014 As described in its Explanatory Notes, the objective of this Regulation is to recognise the prior experience of some Queensland pig producers in pig husbandry procedures who are not otherwise accredited or do not possess formal qualifications in pig production, in that experienced pig producers who are not accredited as suitably qualified to carry out certain procedures or who do not possess a Certificate III in Agriculture (Pig Production) or an equivalent qualification are not currently considered to be suitably qualified to carry out husbandry procedures on pigs, with the consequence that they may not meet the competency requirements of industry quality assurance programs and access to some markets may be denied as a result. This Regulation amends Schedule 2 (Code of practice about pigs) of the Animal Care and Protection Regulation 2012 by providing, in the words of its Explanatory Notes, that, where a person has at least 12 months practical training and experience in husbandry procedures at a pig establishment that complied with an industry recognised quality assurance program or had in place an industry recognised herd health program, that person is considered to be suitably qualified to undertake husbandry procedures on pigs.

SL No. 13 of 2014: Nature Conservation (Protected Areas Management) Amendment Regulation (No. 1) 2014 This Regulation amends Schedule 3 (Permitted uses in prescribed national parks) of the Nature Conservation (Protected Areas Management) Regulation 2006 to permit: the use and operation of existing service facilities within specified parts of the following national parks: Mount Cook National Park; Bowling Green Bay National Park; and, Conway National Park; and the installation and operation of a service facility within parts of the following national parks: Burrum Coast National Park; and, Lizard Island National Park. 3. SL No. 14 of 2014: Building Amendment Regulation (No. 1) 2014 As referred to in the Explanatory Notes for this Regulation, the Commonwealth Games Federation (CGF), the body responsible for direction and control of the 2018 Commonwealth Games to be held on the Gold Coast, has set minimum requirements for buildings in the development of the Games Village, one of which requires maximum occupancy numbers for a particular class of accommodation building that is in excess of those set out under the National Construction Code. In order to satisfy this CGF directive, this Regulation amends the Building Regulation 2006 by inserting a new provision, namely, s51blac (Approval of amendment of QDC by adding part MP 3.6), in Division 1 of Part 8, the effect of which is to approve, pursuant to s13(3) of the Building Act 1975, a new mandatory part of the Queensland Development Code, namely, MP 3.6 (Commonwealth Games Village Accommodation Buildings), which was published by the chief executive of the department responsible for the administration of the legislation on 23 January MP 3.6 will apply only to class 1b buildings that are located on Lot 460 on Survey Plan , thereby ensuring that only class 1b buildings relating to the Commonwealth Games Village are assessed against MP 3.6. Queensland Government Gazette of 7 February Place Names Act 1994 Gazettal of the Place Name Proposal Notice (No 01) 2014, under s9, pursuant to which notice is given that the Minister for Natural Resources and Mines intends to proceed with proposals to name the places, alter the boundaries and change the names of the places set out in the Schedule to the notice which are located in the following local government areas: Cairns Regional Council; Douglas Shire Council; and, Gold Coast City Council.

6 1 7 February 2014 page 6 Gazettal of the Place Name Decision Notice (No 01) 2014, under s11, pursuant to which notice is given that the Minister for Natural Resources and Mines has decided to alter the boundaries of the places set out in the Schedule to the notice which are located in the following local government areas: Brisbane City Council; Scenic Rim Regional Council; Fraser Coast Regional Council; Sunshine Coast Regional Council; Ipswich City Regional Council; Bundaberg Regional Council; Logan City Council; and, Goondiwindi Regional Council. 2. Economic Development Act 2012 Gazettal of the declaration made under s125 by the Minister for Economic Development Queensland ( the MEDQ ) that, from 24 January 2014, unallocated state in the Ripley Development Area, namely, land in permanently closed road reserve being Lot 600 on unregistered survey plan SP184460, is vested in the MEDQ in fee simple. 3. Education (General Provisions) Act 2006 Notice, given under s18,that the Moresby State School in Far North Queensland is proposed for closure and that consultation regarding this proposed school closure has now commenced. 4. Government Owned Corporations Act 1993 Gazettal, under s114, of the notification of the revocation by the Treasurer and Minister for Trade and the Minister for Energy and Water Supply of the application of the policy document entitled State Procurement Policy to SunWater Limited, its subsidiaries and controlled entities, gazetted on 19 December 2008, and to each of the following Government owned corporations, their subsidiaries and controlled entities, gazetted on 27 February 2009: CS Energy Limited; Energex Limited; Ergon Energy Corporation Limited; Queensland Electricity Transmission Corporation Limited; and, Stanwell Corporation Limited.

Parliamentary Sittings The first Parliamentary sitting week for 2014, as indicated on the Parliamentary website, is scheduled for Tuesday, 11 February, to Thursday, 13 February (The complete proposed sitting dates for the remainder of 2014 are available on that website.) 2. Listing of Approved Forms The Parliamentary Counsel website has advised that, from 1 February 2014, the Forms document will no longer be published on the Current Queensland Legislation Annotations page of that website but, from that date, interested persons should visit the website of the relevant Queensland government department for information about that department s forms.
