COMMITTEE SECTION (H.A) 9.1 Main functions of the Section: The primary function of this Section is to provide secretarial assistance to one of the eight Department-related Parliamentary Standing Committees (DRPSCs) serviced by Rajya Sabha Secretariat i.e. Committee on Home Affairs. Like the other seven DRPSCs serviced by Rajya Sabha Secretariat, the Committee on Home Affairs is governed by Rules 268 to 277 of the Rules of Procedure and Conduct of Business in the Council of States. In other respects, the rules applicable to Select Committee on Bills in the Council apply mutatis mutandis to the Committee. The functions assigned to the Committee, as enumerated in Rule 270 supra, pertain to the consideration of Demands for Grants of the related Ministries, examination of Bills pertaining to the related Ministries when referred to the Committee by the Hon ble Chairman and Hon ble Speaker, as the case may be, consideration of Annual Reports of the related Ministries and National basic long term policy documents presented to the Houses, if referred to the Committee by the Hon ble Chairman or the Hon ble Speaker, as the case may be, and report thereon. 9.2 Jurisdiction of Committee: Two Ministries of Government of India, namely, the Ministry of Home Affairs; and the Ministry of Development of North Eastern Region (DONER), as enumerated in the Third Schedule of Rules of Procedure and Conduct of Business in the Council of States, are under the jurisdiction of the Committee on Home Affairs. 9.3 Tenure of Committee: The Committee re-constituted on 5 August under the Chairpersonship of Smt. Sushma Swaraj with 10 Members from Rajya Sabha and 21 Members from Lok Sabha continued till the dissolution of 14 th Lok Sabha on 18 May After the constitution of the Fifteenth Lok Sabha, the new Committee has been constituted under the Chairmanship of Shri M. Venkaiah Naidu on 31 st August for a term of one year. 9.4 Consideration of Demands for Grants ( ): Consequent on a Motion for Suspension of Rule 272 of the Rules of Procedure and Conduct of Business in the Council of States (Rajya Sabha) in its application to consideration of Demands for Grants ( ) of the related Ministries/Departments by the DRPSCs moved by the Minister of State in the Ministry of Parliamentary Affairs and adopted by the Rajya Sabha on , the demands for Grants ( ) were not examined by the DRPSCs being serviced by the Rajya Sabha Secretariat. Accordingly, the DRPSC on Home Affairs did not consider the Demands for Grants ( ) of the Ministries of Home Affairs and DoNER. 9.5 Consideration of Bills: During the period under review, two Bills namely, the Central Industrial Security Force (Amendment) Bill 2008 and The Land Port Authority of India Bill, 2009 were referred to the Committee on 9 th January and 14 th September 2009 respectively, for examination and report thereon 3. 2 9.5.2 Report on the Private Detective Agencies (Regulation) Bill, 2007 was presented to both the Houses of Parliament on 13 February The Committee could not complete all stages of consideration of the Land Ports Authority of India Bill 2008 and present its report thereon due to announcement of dates for General Elections to the Fifteenth Lok Sabha. With the dissolution of the Fourteenth Lok Sabha on , the Bill had lapsed. 9.6 Consideration of General Subject: The Committee re-constituted on 5 August, 2008 had in its agenda the following subjects for detailed study:- S. (1) and (2) above and presented reports thereon to Parliament. The subjects at Sr. No. (3) and (4) could not be taken up due to paucity of time at the disposal of the Committee. The consideration of the subject at Sr. No. (5) remained inconclusive The new Committee constituted on 31 st August, 2009 identified the following subjects for detailed study during its tenure:- S. Ministry of Home Affairs Internal Security (Naxalism, Cross-border terrorism and Infiltration); 2.* -do- Housing Scheme for Central Police Forces and Delhi Police; 3.* -do- Working of Foreigner's Division; and 4. -do- Administration of UTs The Committee heard the oral presentations of the representatives of Ministries of Home Affairs, Finance, Planning Commission, Delhi Police, CPWD etc. on the Housing Scheme for Central Police Forces and Delhi Police and Ministry of Home Affairs on Internal Security (Naxalism and Cross-border Terrorism). The Committee held detailed discussion on these subjects and conducted the study tour thereof. 9.7 Sub-Committees: The Committee did not constitute any sub-committee during the period under review. 9.8 Tours/Visits: The Committee did not undertake any study visit during the period under review. 9.9 Meetings & Reports: The Committee held 17 meetings in all devoting more than 50 hours. The Committee on Home Affairs had the following specific goals to be achieved: (i) Consideration of Demands for Grants ( ) of related Ministries and report thereon; (ii) Consideration of ATRs received from the related Ministries on the respective Reports pertaining to Demands for Grants ( ) and report thereon; (iii) Examination of Bills and report thereon; and (iv) Detailed examination of the subjects and report thereon The succeeding paragraphs contain the analysis of the extent to which each of the above mentioned goals were achieved during the tenure of the Committee With regard to the goal mentioned at Sl.No.(i), the Committee did not consider the Demands for Grants ( ) of the related Ministries in view of suspension of Rule 272 of the Rules of Procedure and Conduct of Business in the Council of States (Rajya Sabha) in its application to consideration of Demands for Grants ( ). 5 Regarding Sl. No. (ii), ATRs of the concerned Ministries on the observations/recommendations of the Committee as contained in its Reports on Demands for Grants ( ) were considered by the Committee and reports thereon were presented on As regards the examination of Bills, the Committee presented its Reports on the Private Detective Agencies (Regulation) Bill, 2007 and the Central Industrial Security Force (Amendment) Bill, The Committee could not present its report on the LPAI Bill, 2008 due to announcement of General Elections to the Fifteenth Lok Sabha, and the Bill lapsed after the dissolution of the Fourteenth Lok Sabha. The LPAI Bill, 2009 introduced in Lok Sabha on 7 th August was referred to the Committee on 14 th September, The examination of this Bill could not be completed at the end of the year In respect of Sr. No. (iv), the Committee presented its 137 th Report on on Rehabilitation of J&K Migrants and 142 nd Report on on Implementation of Central Scheme of Modernisation of Prison Administration. 6 9.16 Budget: The details of allocation of Budget & Expenditure is as under: i) Budgetary Allocation: Rs. 2,50,000 Lunch/Dinner/Refreshment etc. (revised estimate) ii) Expenditure: a) Anticipated Expenditure upto 31 December 2009 is to the tune of Rs. 80,000 on Lunch/Dinner/Refreshment etc.; b) No expenditure incurred on binding of Reports and verbatim proceedings of the Committee. 73
