Background Atlas Iron Limited (Atlas) operates the Abydos Direct Shipping Ore (DSO) Project (the Project) in the Pilbara region of Western Australia. The Project is located approximately 100 kilometres (km) southeast of Port Hedland and 85 km west of Marble Bar. Due to economic and opportunistic circumstances, the Project has been developed in stages with each assessed and approved individually. Stage 1 comprised of the initial development of the mine (Trigg and Mullaloo pits), crushing infrastructure, contractor area and permanent accommodation camp. In accordance with the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) Atlas submitted a referral to the Department of Sustainability, Environment, Water, Population and Communities (SEWPaC) on 3 April 2012 to allow a determination of whether Stage 1 of the Project is a controlled action. On 11 May 2012 SEWPaC advised the proposed action is controlled and required to be assessed by preliminary documentation. Following submission of additional documentation and public notification of the action, approval for Stage 1 was granted via EPBC2012/6345 on 19 September At the time of reporting, Stage 1 mining operations have been completed and the Project is in Closure with active rehabilitation of disturbed areas. 2. Objective This report is intended to address Condition 8 of EPBC2012/6345 whereby: Within three months of every 12 month anniversary of the commencement of the action, the person taking the action must publish a report on their website addressing compliance with each of the conditions of this approval, including implementation of the management plan as specified in the conditions. Documentary evidence providing proof of the date of publication and non-compliance with any of the conditions of this approval must be provided to the Department at the same time as the compliance report is published. 3. Scope This report captures the commitments outlined within the EPBC approval document and associated compliance to these commitments for the 1 January 2017 to 31 December 2017 period. Page 1

The person taking the action must implement the standard management measures and species specific management measures as detailed in sections 4 and 5 of the Significant Species Management Plan, Abydos DSO Project (Atlas Iron Limited, March 2012, or as revised under conditions 9 and 10 of this approval). Compliant The approved Abydos DSO Project Significant Species Management Plan (May 2014) is being implemented. Appendix 1. Northern Quoll and Pilbara Leaf-nosed Bat monitoring was conducted in the reporting period. 2. The person taking the action must provide $100,000 (GST exclusive) to the WA DEC to commence actions associated with a Pilbara-wide survey of the landholder and land managers (pastoralists, aboriginal communities etc.) to improve the understanding of the distribution, abundance and seasonal occurrence of the Northern Quoll. Compliant Atlas confirms $100,000 was paid to the Department of Environment and Conservation (now Department of Biodiversity, Conservation and Attractions) on 15 May Appendix The person taking the action must provide $200,000 (GST exclusive) to the WA DEC, for the establishment of a research project for the better protection of EPBC Act listed threatened species including the Northern Quoll (Dasyurus hallucatus) in the Pilbara region of Western Australia. The research program must be designed to improve understanding of the life history and population dynamics of feral predators in the Pilbara, through the monitoring of dingoes, dogs and feral cats to study the interactions between them and with prey. Compliant Atlas confirms $200,000 was paid to the Department of Environment and Conservation (now Department of Biodiversity, Conservation and Attractions) on 15 May Appendix The person taking the action must provide $150,000 (GST exclusive) to the WA DEC, to implement management actions for the higher priority weeds or those weeds posing the greatest risk to biodiversity in the Chichester subregion of the Pilbara. Compliant Atlas confirms $150,000 was paid to the Department of Environment and Conservation (now Department of Biodiversity, Conservation and Attractions) on 15 May Appendix Documentary evidence must be provided to the Department showing that payment of funds specified in conditions 2, 3 and 4 of this approval have been made within 12 months of commencement. Non-compliant - Atlas commenced the Abydos DSO Project on 8 December 2012 however failed to notify the Department within 10 days of commencing the action. This has been recognised and rectified. Appendix The person taking the action must maintain accurate records substantiating all activities associated with or relevant to the conditions of approval, including measures taken to implement the management plan, and make them available upon request to the Department. Such records may be subject to audit by the Department or an independent auditor in accordance with section 458 of the EPBC Act, or used to verify compliance with the conditions of approval. Summaries of audits will be posted on the Departments website. The results of audits may also be publicised through the general media. Compliant - Records of activities associated with or relevant to the conditions of approval are currently being maintained. 8. Within three months of every 12 month anniversary of the commencement of the action, the person taking the action must publish a report on their website addressing compliance with each of the conditions of this approval, including implementation of the management plan as specified in the conditions. Documentary evidence providing proof of the date of publication and non-compliance with any of the conditions of this approval must be provided to the Department at the same time as the compliance report is published. Noted - This compliance report shall be published and available on Atlas website. Appendix If the person taking action wishes to carry out any activity otherwise than in accordance with the management plan as specified in the conditions, the person undertaking the action must submit to the Department for the Ministers written approval a revised version of that management plan. The varied activity shall not commence until the Minister has approved the varied management plan in writing. The Minister will not approve a varied management plan unless the revised management plan would result in an equivalent or improved environmental outcome over time. If the Minister approves the revised management plan, that management plan must be implemented in place of the management plan originally approved. Compliant - All activities being carried out are in accordance with the approved management plan. Page 3

6 Abydos Direct Shipping Ore (DSO) EPBC Compliance Report - Stage 1 Document No 101-LAH-EN-REP-0025 Revision 0 Date 03/01/ If the Minister believes that it is necessary or convenient for the better protection of threatened species and ecological communities to do so, the Minister may request that the person taking the action make specified revisions to the management plan specified in the conditions and submit the revised management plan for the Ministers written approval. The person taking action must comply with any such request. The revised approved management plan must be implemented. Unless the Minister has approved the revised management plan, then the person taking the action must continue to implement the management plan originally approved, as specified in the conditions. Compliant No specified revisions of the approved Significant Species Management Plan requested to date. 11. If, at any time after five years from the date of this approval, the person taking the action has not commenced the action, then the person taking the action must not commence the action without the written agreement of the Minister. Compliant Action has been substantially commenced and is now complete. The Project is now in closure. Fauna monitoring shall be undertaken in accordance with the approved Mine Closure Plan (2017) and include the Northern Quoll, Pilbara Leaf-nosed Bat and Ghost Bat. 12. Unless otherwise agreed to in writing by the Minister, the person taking the action must publish the management plan referred to in these conditions of approval on their website. The management plan must be published on the website within 1 month of being approved.
