1 "THE COOL DINNER CONTEST RULES Article 1: THE ORGANIZER Carrier Transicold Europe SCS, with registered office at L Européen Bâtiment D - 4, Rue Joseph Monier, Rueil-Malmaison (FRANCE) registered with the RCS of Nanterre under (hereinafter referred to as the "Organizer") is organizing a contest free of charge and without obligation to purchase, won by random drawing of lots, entitled "The Cool Dinner" (hereinafter the "Contest"). The Cool Dinner contest rules will be available at the Carrier Transicold dedicated website governed by these terms & conditions and additionally by applicable French and European laws. Article 2: DURATION This Contest will be conducted from September 1st, 2017 at 00h00 (Paris time) to January 31st, 2018 at 23h59 (Paris time). The Organizer reserves the right at any time and without notice to shorten, extend, modify, cancel or suspend the Contest due to any event beyond its control, without being held liable in any way. Any change to the Contest will be recorded by the Bailiff Stéphane CLAISE, SCP HELDT CLAISE LE MAREC, 3 Rue de l'assemblée Nationale Versailles FRANCE (hereinafter Bailiff ). Article 3: PARTICIPATION This Contest is open to all physical persons who correspond to the conditions listed in the Article 4 and 5 and who are residents/ or are domiciled in the following regions: Region 1 Region 2 Region 3 France Denmark Austria Italy Finland Belgium Portugal Ireland Czech Republic Spain Norway Germany Poland Netherlands Sweden UK Region 4 Albania; Algeria; Angola; Armenia ; Belarus; Bosnia; Bulgaria; Croatia; Cyprus; Egypt; Estonia; Ethiopia; Ghana; Greece; Hungary; Israel; Ivory Coast; Jordan, Kazakhstan ; Kenya; KSA; Kuwait; Kyrgyzstan; Latvia; Lebanon; Lithuania; Macedonia; Malta; Mauritius; Moldova; Morocco; Oman; Pakistan; Qatar; Romania; Russia; Slovakia; Slovenia; Serbia; Senegal; South Africa; Switzerland; Tunisia ; Turkey; Ukraine; United Arab Emirates Article 4: GAME OPERATING RULES To enter and confirm their registration for the Contest, participants must visit the Carrier Transicold website and complete the contact information via the Contest registration form. Participants can also enter the contest by completing the Contest registration form during Carrier Transicold events and trade shows taking place during the period defined in Article 2, if available. Draw for the main prize: The drawing will take place on January 15 th, 2018 from among all the eligible participants as defined in the Article 5 and registered for the draw in the participating countries, under the 1

2 control of the Bailiff in order to determine the 4 winners (one from each region as designated in Article 3) of the prize indicated in Article 6. Draw for the intermediate prize: The campaign is divided in two (2) seasons. The first season is taking place from September 1st at 00h00 (Paris time) to November 15th, 2017 at 23h59 (Paris time) and the second season from November 16th, 2017 at 00h00 (Paris time) to January 31st, 2018 at 23h59 (Paris time). The participants can enter the contest until January 14 th, 2018 at 23h59. The intermediate prizes are a total of forty (40) food baskets that can be won and distributed as follows: - Five (5) food baskets for each region per season (detailed in Article 3), totaling twenty (20) food baskets per season in total. The draw of the first season will take place on November 16th, 2017 from among all the participants registered for the Contest in the participating countries, under the control of the Bailiff, in order to determine the winners per region of the first intermediate prizes designated in Article 6. The draw of the second season will take place on January 15th, 2018 from among all the participants registered for the Contest in the participating countries, under the control of the Bailiff, in order to determine the winners per region of the second intermediate prizes and the main prize designated in Article 6. Winning participants shall consider their prize to be confirmed only after receiving an official from the Organizer. Within 15 days of the confirmation to each winner per region, he or she shall lose the benefit of the prize, which shall remain the property of the Organizer in the following cases: the telephone number or address provided by the winner are unusable (incorrect or obsolete); the winner cannot be contacted; the winner cannot be identified, either by name or address, or by telephone; the winner refuses his or her prize; Article 5: ELIGIBILITY Main prize attribution criterias: The winner of the main prize must work at the following types of companies or industries: Transport company, food production, flower industry, supermarket and/or pharmaceutical industry. The selected winner must work in a company which operates refrigerated vehicles. This type of information will be collected via the fields of the registration form to be completed by all participants. Intermediate prize: All participants can win the intermediate prize. The winner of the intermediate prize cannot win this intermediate prize twice (only once). He/she is still eligible to win the main prize (the dinner cooked by the chef) if eligible. Exclusion The Organizer reserves the right to verify that the winners meet the above and below conditions. Only one entry per household will be accepted for the duration of the Contest (for example: same name, same address, same landline, same address or mobile number). Persons corresponding to the following criteria are not eligible to win neither the main prize nor the intermediate prize: 2

3 Members of staff of the Organizer (Carrier Transicold and Marquetis agency) as well as members of the staff of any UTC entities and service provider operating under any UTC brands or their partners and family members (spouses, ascendants, descendants, brothers, sisters, etc.) Members of staff of the Bailiff, or their partners and family members (spouses, ascendants, descendants, brothers, sisters, etc.) Members of staff of Carrier Transicold service centers (incl. independent companies) or their partners and family members (spouses, ascendants, descendants, brothers, sisters, etc.) Members of staff of Carrier Transicold distributors or dealers, or their partners and family members (spouses, ascendants, descendants, brothers, sisters, etc.) The Organizer reserves the right to exclude, temporarily or permanently, any participant whose behavior jeopardizes the success of the Contest and/or becomes for any reason persona non-grata in the jurisdictions listed in the Article 3. Any participant, who allegedly attempts to interfere with the proper conduct of the Contest, shall be immediately disqualified and charges may be requested by the Organizer for attempted fraud. Article 6: PRIZES The following prizes will be awarded in the Contest. Main prize: A dinner cooked by chef at the winner s home or at the home of someone chosen by the winner (one of the guests) for a total of four (4) participants and for the maximum value of 200 per person VAT included (including food and beverages). Alternative prize for the winner, if no chef is available for home cooking: the winner and a maximum of 3 additional guests of his/her choice can be invited to a restaurant dinner value only: up to 200 /person VAT included (Including food, beverages). The prize value cannot be given as money instead of the prize. Winner or guest transportation expense (train ticket, taxi, flight ), and/or home rental expenses will not be refunded by Carrier Transicold. Intermediate prize: 40 Food baskets of a maximum value per basket: up to 100 VAT included. Delivered by post to the winners. Post costs are free of charge for winners. Article 7: DELIVERY OF PRIZES The winning contestants will receive their prize as follows: The winner of the main prize will be directly notified, following the draw which will take place on January 15th 2018, by or by phone call by a Carrier Transicold representative or Bailiff. Winners of the intermediates prizes will be directly notified, following the drawing, which will take place on November 16th, 2017 and on January 15th 2018, by or by phone call by a Carrier Transicold representative or a member of the Bailiff. The prizes will be sent or offered free of charge to the winners by the Organizer. Each winner will communicate the place to which the prizes are to be delivered or organized. The Organizer cannot be held responsible for any delays or flight/delivery problems involving any prizes dispatched. 3

4 In case a prize is returned for any reason to the Organizer the prize will be lost. Such winner will no longer be able to claim his or her prize. The Organizer reserves the right to substitute the prize with another prize of equal value and similar nature or equivalent monetary value if circumstances dictate. Article 8: REIMBURSEMENT OF EXPENSES The Terms & Conditions of the Contest are deposited at the office of Bailiff. The Terms & Conditions shall be addressed, free of charge, to any person who requests them from Carrier Transicold Europe - L Européen Bâtiment D - 4, Rue Joseph Monier, Rueil- Malmaison (FRANCE) and are available at The Organizer will refund any participant who requests the Terms & Conditions within 15 days following the end of the Contest at the latest: Postage (slow rate) or internet connection based on the low-speed routing in effect. The Internet connection fee corresponding to a flat rate of 10 cents related to sending to requestors and corresponding to the time required for sending, determined as 5 minutes. Only one request for reimbursement by participant in the Contest for the duration of the Contest will be taken into account. Article 9 - MISCELLANEOUS Participation in the Contest implies acceptance of these terms and conditions in their entirety and the decision of the Organizer on any challenge that may arise concerning the interpretation and application of these terms and conditions and, more generally, any difficulties that may not be provided concerning the existence, implementation and completion of the Contest. The Organizer assumes no responsibility for force majeure or events beyond its control, preventing the smooth running of the Contest. The Organizer reminds participants of the nature and limitations of the internet and accepts no responsibility for the consequences of their connection to the network via the site. Carrier Transicold Europe may under no case be held liable in case of problems concerning the delivery or loss of post or . Specifically, Carrier Transicold Europe cannot be held responsible for any damage, material or immaterial, caused to participants, their computer equipment and the data stored on it and the possible implications for their personal or professional lives. The Organizer cannot be held responsible in the event that one or more participants are unable to connect to or play due to any technical fault or any problem related in particular to network congestion. The Organizer cannot be held responsible for any damage caused to participants related to beverage and food consumption. The participants remain responsible for communicating to the Organizer any information regarding any allergies and/or medical objections. By virtue of the acceptance of his or her prize, each winner authorizes the Organizers to use and reproduce his or her name, address, photo and possibly a video on the day of the delivery of the food basket and participation in the dinner for all advertising and promotional material 4

5 related to this Contest without this use incurring any additional rights other than the prize won. If a winner is opposed to the use of his or her contact details, he or she must inform the Organizers immediately the same day after finding out that he or she won a prize to the address: GPCARCTEMARKETING@carrier.utc.com Article 10 - DATA PROTECTION ACT In accordance with French Law No , Files and Freedoms of January 6, 1978 amended by the law of 06 August 2004, participants have the right to oppose (article 38), access (article 39) rectification and deletion (article 40) of their personal data. Thus, participants who do not wish to receive the commercial information from Carrier Transicold will be removed from the file upon written request made to the Organizer at the address below. The Organizer will refund the postage (slow rate) to any participant who submits such a request.
