3 Permit Background Court determined need for a Clean Water Act permit for pesticide application to water EPA and States develop a pesticide general permit by Oct. 31, A Pesticide General Permit Issued Oct. 31, 2011 Expired Sept. 30, 2016
4 NPDES General Permit Permit is for a pollutant discharge to water Pollutant is the chemical pesticide excess or residue that remains after product use Pollutant is a biological pesticide
5 NPDES General Permit National Pollutant Discharge Elimination System A general permit is for a large number of sources Similar types of operation and discharge Similar discharge limits and monitoring requirements One general permit is issued then applications are screened for eligibility Lower cost permit
6 Current Permit Requirements General Permit Content 2300A Pesticide General Permit issued in 2011 Area of Coverage Coverage and Eligibility Statewide permit coverage Five types of pest control Operator is a term used to describe an entity that is responsible for the permit Application Process Registration and fees required for Federal and State agencies, certain Districts and large scale pesticide application For small scale pesticide applications, operators are not required to submit an application form. This subgroup is required to keep a copy of the permit and follow basic conditions. Process for an emergency situation

10 Permit Requirements Who has to register for permit coverage? Federal or State agency with pest control responsibility must apply for a permit Mosquito Control Districts and weed control districts must apply for a permit Operators of Irrigation Systems<new>
11 Permit Requirements Who has to register for permit coverage? Applies to operator cities, counties, landowners, land managers, and others Must apply for permit if the total treatment area in a calendar year is large scale. Exceeds 20 acres or 20 linear miles Exceeds 6400 acres
