3 MCAPCO Basics Regulations found in MCAPCO originate from either of two sources: most are adopted by reference from State rules. some are developed locally by Mecklenburg County The 2014 revisions contain regulations adopted by reference from the state. Revisions were adopted by the Board of County Commissioners on April 17 th and October 7 th.

5 Significant Changes: Exemptions (MCAPCO ) Sources subject to a federal MACT/GACT rule (i.e. 40 CFR 63). Does not apply to: Natural gas boilers, as defined in Subpart 6J Burns only natural gas Burns alternate fuels only in time of NG curtailment Existing emergency engines at residential, commercial and institutional facilities Combustion sources, except those permitted after July 10, 2010.

6 Significant Changes: Exemptions (MCAPCO ) Natural gas boilers with an aggregate capacity of 450 million Btu/hr and only source of benzene Emergency engines with an aggregate capacity of 4843 HP and only source of formaldehyde Exempt sources are not included in an evaluation for toxics: Unless the source presents an unacceptable risk

8 Significant Changes: TPERs (MCAPCO ) Addition of a second set of TAP Permitting Emission Rates (TPERs): Existing rates based on an obstructed or nonvertical release point New rates are for vertical and unobstructed release points (all sources at the facility): TAP Obstructed or Non-Vertical Vertical and Unobstructed Formaldehyde 0.04 lbs/hour 0.16 lbs/hour Benzene 8.1 lbs/year lbs/year

9 Significant Changes: Arsenic TPER & AAL Arsenic Allowable Ambient Level (AAL) and TPER revised based on recommendation of the North Carolina Science Advisory Board: AAL (annual basis) Old 2.3 x 10-7 milligrams/cubic meter New 2.1 x 10-6 milligrams/cubic meter TPER lb/year lb/year

11 Significant Changes: Applicability (MCAPCO ) hour Ozone Standard Maintenance and Contingency Plan: Establishes procedures and requirements for implementing the plan Sources currently subject to VOC RACT will continue to be subject: anti-backsliding If an exceedance does occur: Rule specific sources subject regardless capacity to emit VOCs All other sources subject if VOC potential to emit is equal to or greater than 100 tons per year.

12 Significant Changes: PSD/NSR (MCAPCO /2.0531) Established Significance Levels for SO 2 and NO x as PM2.5 precursors Deleted the Alternative Significance Level of 140 tons/year for NOx established previously by the state.
