Currently, the tariff and WVDEP Solid Waste Facility Permit state that the site will be open from 6:OOam to 4:30pm, Monday through Friday. The modification will provide Northwestern Landfill the ability to operate the site more efficiently without impacting local waste companies collections and/or customer's waste disposal options. Therefore, Northwestern Landfill intends to adjust hours of operation to be open 7:OOam and close at 4:00pm, Monday through Friday. I have included a letter of support from the Wood County Solid Waste Authority for your review as well. Lastly, Northwestern Landfill does not intend to modify the hours of operation for Saturday or "Free Day". As always, your review and support of this request will be most appreciated. Box 812 Charleston, WV c- -._, To Whom It May Concern: The current permitted hours at Northwestern Landfill, Inc. in Wood County are 6:OO a.m. to 4:30 p.m. Due to lack of vehicular traffic on the scales at the beginning and end of the day, Northwestern is considering a change in operating hours for the facility. The intention is to modify the hours to open at 7:OO a.m. and close at 4:OO p.m. This change will allow the facility personnel to operate the site more efficiently and reduce potentially dangerous situations. At certain times of the year, the operators are handling a tarp for alternate daily cover - tarping and untarping waste in the dark. The adjusted hours would also assist in controlling operating costs due to a reduction in generated worker overtime. The Wood County Solid Waste Authority supports Northwestern Landfill, Inc. to allow the change of permitted hours of operations to promote efficient and safe operations at the facility. Rules and Regulations for the Government of Solid Waste Disposal Facilities adopted by the Public Service Commission of West Virginia, and now in effect, and all amendments thereto and modifications thereof hereafter made by said Commission. 7:4 4 :& II. OPERATING HOURS: The operating hours of the facility are fromjm6a.m. t o m p.m., Monday through Friday, and 6:OO a.m. to 12:OO noon, non-free day Saturdays. The facility will be closed on the following holidays: Christmas, New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day. The landfill may close on additional days by prior notice. The landfill may, by prior arrangement, open on a holiday. FREE DAY. Normal operating hours on Free Day are 6:OO a.m. until 2:OO p.m. Ill. Billing and Collectinq: All charges for dumping must be paid for in cash at the time of disposal unless a credit agreement has been entered into. The landfill reserves the right to refuse to enter into credit agreements. IV. Refusal or Limitation of Service: Service may be refused or limited in amount for the following reasons: 1. The Disposer refuses to properly disclose the origin, type, or quantity of material, including, where demanded by the landfill, the specific physical and chemical properties of the material, and also, where demanded, physical and chemical analysis provided by a certified laboratory. 2. The material is a type which is not compatible with or harmful to the integrity of the liner or some other part of landfill facility or is incompatible with the facility permits. 3. The material is labeled, tagged or identified in a manner different f rom any manifest or bill of lading for the material. 4. The driver fails to follow traffic patterns or instructions or exhibits a disregard for safety. If the driver has in the past failed to follow instructions or traffic patterns, or exhibited a disregard for safety, or has been involved in an accident, service will be denied. 5. The driver refuses when requested to spread the material for inspection, testing or sampling prior to disposal. 6. The material appears to be burning or smoldering. Refusal or Limitation of Service (Continued) The volume of material presented for disposal is such that the landfill cannot adequately handle the material, or the volume presented for disposal would exceed the existing regulatory approvals for the landfill or in combination with other material typically accepted would contribute to exceeding the existing regulatory approvals. The landfill reserves the right to refuse or to limit service in the event of adverse weather conditions, equipment breakdowns, or labor disruptions or shortages, or unanticipated disruptions, which affect landfill operations. The driver is intoxicated, armed, not properly identified, or not properly licensed. The equipment of the disposer is unsafe, out of repair, or not equipped to be safely operated. 10. The disposer is delinquent in paying previous bills under a credit agreement. 11. The landfill will reject for disposal any material which is a special solid waste which requires prior or special regulatory approval before accepting it. The landfill may, by separate agreement, and upon receiving the appropriate regulatory approvals, accept this waste. 12. The landfill will reject for disposal any material which requires special handling or would interfere with the efficient operation of the landfill including meeting daily cover requirements. The landfill may, by separate agreement, accept this waste. V. APPLICABILITY: Applicable to all commercial haulers, commercial customers, the general public, industrial customers and municipalities. c:..-. In addition to other charges, waste in vehicles which requires additional landfill assistance shall be subject to a surcharge. To be negotiated 4. Materials subject to paragraphs A, B, and C. If the landfill determines to accept materials that are special solid wastes'which require prior regulatory approval, the landfill will negotiate with the disposer: (1) the volume of materials to be accepted; (2) the specific details of the disposal including the time, place, rate of disposal, and other conditions of disposal; and (3) the price of disposal. The following are examples of the kinds of materials which, if the landfill determines to accept, the landfill will negotiate with the disposer for their disposal: (1) tires; (2) asbestos; (3) shredder fluff, insulation and other light-weight materials; (4) ash; (5) bulky goods or appliances; (6) free liquids or containerized liquids; (7) drums; (8) PCBs in concentrations of 50 parts per million; (9) sludges; (1 0) pesticide containers; (1 1 ) infectious waste; (1 2) animal carcasses; (1 3) car bodies; (1 4) contaminated soils; (15) baled waste; (16) carbon black and (17) all materials identified as special wastes by DNR. B. If the landfill determines to accept materials that require special handling, the landfill will negotiate with the disposer: (1) the volume of materials to be accepted; (2) the specific details of the disposal including the time, place, rate of disposal, and other conditions of disposal; and (3) the price of disposal. Certified Commercial Haulers, Municipalities and industrial Customers making full payment within five days of billing shall receive a five percent discount on all charges except governmental fees or taxes. 6. If the landfill rejects a load of material the cost shall be borne by the disposer. If after spreading the material for examination, testing, or sampling the landfill determines not to accept the material, the material shall be reloaded into disposer's vehicle and removed from the landfill. The landfill will charge the disposer a fee for reloading. If the disposer refuses to reload the material or to pay the reloading fee, the landfill will in the future refuse to provide service to the disposer. 7. The landfill will charge an additional. fee to be negotiated with the disposer if the landfill equipment or personnel are required to provide anything other than ordinary services to disposer.
