2 WI DNR Shoreland Rules WI DNR Shoreland Protection Program, Chapter NR 115 rules are currently being updated to: Better protect lakes and rivers Allow more flexibility for riparian land owners Revised rules effective as of February 2010 Counties must bring their ordinances in line with these updated rules; target date for ordinance adoption is February 2014

3 Under revised NR 115 Rules: Owners can keep whatever structural improvements exist on the property and maintain existing setbacks, even though nonconforming Major alteration of property may require action Must offset potential impacts Give and take will be necessary through mitigation and shoreline stabilization Some Standards will remain unchanged: New principal structure must be conforming with regard to setback >= 75 from OHWM Shoreland : 1000 from OHWM of lake or pond 300 from OHWM of river or stream Vegetative Buffer zones size = 35 from OHWM

4 Some standards will change: Cost limits (50% of value) on repairs for nonconforming principal structures will be eliminated Nonconforming structure may be allowed lateral (sideways) expansion 100 sq. ft. on side and 200 sq. ft. rearward (away from OHWM) Expansion of nonconforming principal structure within setback allowed if: structure is 35 from OHWM Addition is vertical Expansion of nonconforming structure will require mitigation new standards included

6 New items in Shoreland Ordinance MITIGATION definition per NR115.03(4r): balancing measures that are designed, implemented, and function to restore natural functions and values that are otherwise lost through development and human activities. what are natural functions? Nature s ability to maintain good water quality, near-shore aquatic habitat, upland wildlife habitat, all of which sustains the resource and natural scenic beauty

7 When is mitigation required? Not required for existing impervious surfaces Is required for: impervious surfaces added, if total >15% Expanding nonconforming structures This shore buffer zone was created as mitigation for expansion of a nonconforming house

8 Proposed mitigation standards? County to determine system of mitigation plan development and approval County to determine specific options that may include: Rain gardens Replanting native vegetation Increasing natural vegetative buffer Converting existing impervious surfaces Diversion of runoff downspouts redirected
