Disclaimer 3 Topic 1 Introduction & Overview 4

Seven Module Series Overview 1. History & Requirements of the Clean Water Act 2. Basic Stormwater Management 3. Inspections & Documentation 4. Phases of Construction Management 5 Seven Module Series Overview 5. Principles of Erosion & Sediment Control 6. Best Management Practices - Structural Controls 7. Best Management Practices - Procedural Controls 6

Topic 2 History & Requirements of CWA 7 EPA Enforcement Strategy Motivation for Staying in Compliance The possibility of incurring significant fines You may be subject to time in jail Enforcement Activity is Aggressive Federal agencies State agencies Local agencies 8

Enforcement Vigorous Enforcement is a Reality Many who have chosen to neglect the rules are now paying significant fines & penalties for their activities 9 Three Levels of Compliance To fully comply with the regulations, you must comply with all federal, state and local requirements for stormwater discharges Federal EPA delegated states State delegated state programs Local local erosion control ordinances 10

Topic 3 Compliance & Sustainability 11 Stormwater Pollutants Stormwater is Your Best Friend & Most Challenging Foe Pollution travels into our ecosystem through stormwater The two primary pollutants are Sediment & Construction materials Sediment Even uncontaminated soil is still considered a pollutant Construction Materials Transported by stormwater create hazardous situations For example... Sediment runoff Thermal loading Metals Oil & Grease Fertilizer Trash Bacteria 12

Environmental Advantages of Compliance Environmental Advantages: Clean land, water & air Healthy wildlife & humans Sustainable building practices Protection of natural resources 13 Topic 4 Beneficial Uses & History 14

Economic Advantages of Compliance Economic Advantages: Stay on time & on budget No fines, penalties or jail time Good reputation Repeat Business 15 History of Stormwater How did we get here? In the 60 s & 70 s the waters of the U.S. were heavily polluted Approximately 70% of those waters were consider polluted 16

History of Stormwater A classic example of severity of pollution The Cuyahoga River, where industrial plants discharged pollutants The river caught on fire as a result 1969 Cuyahoga River (photo credit George Leavens Permission Ohio EPA) November 3, 1952 Cuyahoga River fire (photo credit James Thomas, from Cleveland Press Collection, Cleveland State University Library) 17 Footer goes here History of Stormwater In 1972, the newly formed EPA Modified the Federal Pollution Water Control Act of 1948 Protect & restore beneficial use of the waters of the US CWA set a goal of having 100% of the Waters of the U.S. 70% of our waters were polluted in the early 70 s Fishable and Swimmable 18 Footer goes here

Summary of the CWA Requirements Create standards to protect beneficial uses Monitor & Assess the water against standards If met, apply anti-degradation policies If not met, listed on 303(d) Develop action plans to meet water quality objectives Known as TMDL s 19 Footer goes here Topic 5 NPDES Point Source Pollution 20

Allowable Discharges Uncontaminated discharges from construction sites Water from fire fighting Fire hydrant flushing Wash water (no detergents) Potable water line flushing Uncontaminated groundwater & spring water Uncontaminated discharges from support activities Batch plants Staging areas Material storage areas Excavated material disposal areas Borrow areas (may require separate permits) 23 Other Sections of The Clean Water Act Title IV - Permits Section 401 State water quality certification Section 402 National Pollutant Discharge Elimination System (NPDES) includes Stormwater regulations Section 404 Dredge and fill permit for wetlands administered by US Army Corps of Engineers 24

Storm Water Regulation by Decade Review 1980 s NRDC files lawsuit challenging USEPA s exemption of stormwater discharges Clean Water Act revised to mandate regulation of storm water Construction activities considered Point Source Pollution 1990 s Phase I Rules 5 acres or greater 2000 s Phase II Rules 1 > 5 acres 10,000 pop. Density 25 Waters of the US in 2000 Even with extensive stipulations 30% Contaminated Waters 26

PROPERTIES On passing, 'Finish' button: On failing, 'Finish' button: Allow user to leave quiz: User may view slides after quiz: Footer goes here User may attempt quiz: Goes to Next Slide Goes to Next Slide After user has completed quiz At any time Unlimited times Topic 6 NPDES Permits & Notices 28

General Overview of NPDES Construction Permits 29 NPDES Permit Requirements Develop SWPPP File Notice of Intent (NOI) Receive Authorization from agency Implement SWPPP Inspect, report, and document Maintain Best Management Practices (BMPs) Update and maintain SWPPP Final Stabilization File Notice of Termination (NOT) Retain documents 30

Notice of Intent (NOI) Submit NOI or equivalent document to the governing authorities with fee, if applicable of intent to discharge Stormwater 32

When To Start Construction Activities Varied depends on requirements specific in the state permit Completely fill out & sign permit application Possible SWPPP review 33 Notice of Termination (NOT) To terminate permit coverage, you must submit an NOT or Notice of Termination Original vegetative state 100% coverage, 70% density Implement stabilization measures throughout the life of the project 34

Retention Test Retention Test 10 Questions Combination of Questions Passing Score is 100% Correct GOOD LUCK! 35
