4 Project Overview Location Hwy 162 and Forbestown Road, six miles east of the City of Oroville 537 acres of land proposed for development on 10 Assessor s Parcels that cover 1132 acres ( , , , , , , , , , and ) Rezone to Commercial Recreation Overlay (approx. 498 acres) Use Permit for Golf Course and Hotel & Wellness Center including Architectural Theme Lot line adjustments 1-acre dedication of land for a fire station site Infrastructure extensions Water South Feather Water and Power for irrigation and domestic water supply Sewer Lake Oroville Area Public Utility District (LOAPUD)

5 Project Commitments & Related Plans Sustainable Transportation Plan Sustainable Waste Management Plan Lighting Management Plan Natural Landscape Plan Wildlife Management Plan Integrated Pest Management Plan Fire Management Plan Water Quality and Water Conservation Management Plan First Tee Program National School Program that provides outreach and education for area youth teaching golf and promoting core values. Audubon Sanctuary Program for the Golf Course. This a certification program through the Audubon International Society to protect the environmental and preserve the natural heritage of the game of golf.

6 Project Objectives Develop a high quality golf course and hotel resort that will serve residents and visitors. Provide amenities for golf, lodging, dining, retail, spa and wellness center, and education. Establish a platform for educational opportunities and mentoring of children. Conserve natural resources and emphasize the natural heritage of the area in the project design. Demonstrate sustainable design and green building practices. Integrate the golf course facilities with the existing Springtown Specific Plan development and surrounding natural community.

13 CEQA EIR Review Process Notice of Preparation 30-day review process from October 15 with public scoping meeting on October 26, 2012 Draft EIR 45-Day Public Review Period through February 13, 2013 Planning Commission Hearing on DEIR January 24, 2013 Comments on Draft EIR, Responses and Revisions Final EIR includes responses and changes to the Draft EIR

15 Impacts 44 impact categories were determined to have a less than significant impact without mitigation 23 impacts and 36 mitigation measures proposed to reduce those impacts to less than significant 10 direct and cumulative impacts remain significant and unavoidable after applying mitigation measures

21 Use Permit Required Findings The proposed use is allowed in the applicable zone The location, size, design, and operating characteristics of the proposed use will be compatible with the existing and future land uses in the vicinity of the subject property. The proposed use will not be detrimental to the public health, safety, and welfare of the County. The proposed use is properly located within the County and adequately served by existing or planned services and infrastructure. The size, shape, and other physical characteristics of the subject property are adequate to ensure compatibility of the proposed use with the existing and future land uses in the vicinity of the subject property.

22 Overlay Zone - Findings Findings: GP2030 & Specific Plan Consistency Site is physically suitable and is not a hazard AG rezone: surrounding uses; ag operations; urban area; no feasible alternative less determential to ag; full mitigation; not in the Williamson Act or Greenline areas Conditional Zoning Agreement limits uses of the Rec Commercial Overlay zone to the proposed project

23 Overriding Considerations Significant and Unavoidable Impacts remain after mitigation. 24 Recommendation Adopt the Resolution certifying the Final EIR Approve the Rezone Ordinance for a Recreation Commercial Overlay with a Conditional Zoning Agreement Adopt the Resolution approving the Whisper Ridge Golf Resort at Lake Oroville (UP /REZ /LLA & ) with a Statement of Overriding Considerations Include an additional condition of approval for the requirement for a tribal monitor
