2 Background and Summary of Proposal The applicant requests a Conditional Use Permit for an Automobile Repair Garage. has been operating an automobile repair facility on the site for eight years. The business employs one employee. The auto repair business is in operation from 8:00 a.m. to 4:00 p.m., Monday through Friday. Areas of service include: truck and fleet repairs, oil changes, brake repair, battery replacement and other light repair activities. No body work or paint work take place on the subject site. Plans for this area are to retain the existing buildings and increase connectivity and access. Land uses will continue to be industrial in nature, including flex spaces and research and development, and commercial office space. Natural and Cultural Resources Impacts This site is fully developed with a one-story building and associated parking area. The site is located within the Chesapeake Bay Watershed. There do not appear to be any significant environmental or cultural features associated with the site. Page 2

The Master Transportation Plan shows a two-lane minor collector with an ultimate right-of-way of 70 feet. Thurston Avenue is a two-lane collector in the vicinity of this site with a right-of way of 60 feet. No improvements are shown on the Master Transportation Plan. Public Utility Impacts Water The site currently connects to City water. There is an existing 12-inch City water line along Thurston Avenue. Sewer The site currently connects to City sewer. There is an existing eight-inch City sewer gravity main along Thurston Avenue and an existing 10-inch City sewer force main at the rear of the property within a 15-foot Public Utility Easement. Evaluation and Recommendation The proposed Conditional Use Permit application for an automobile repair garage is, in Staff s opinion, consistent with the land use and vision for this portion of the Burton Station SGA. Additionally, the use is compatible with the existing and recommended light industrial surrounding the site. No additional site improvements are proposed with this request and all repair work will take place inside the building. Based on the findings above, Staff recommends approval of this request subject to the conditions below. Page 3

4 Recommended Conditions 1. All vehicle repair shall take place inside the building. 2. No outside storage of equipment, parts, or materials shall be permitted. 3. There shall be no outside storage or display of tires. 4. No outside storage of vehicles in a state of obvious disrepair shall be permitted. If vehicles in this condition require storage, then such vehicles shall be stored within the building. 5. All parking spaces required by the City Zoning Ordinance must be marked by painted striping, including handicap spaces in accordance with the Americans with Disabilities Act (ADA). Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site.
