3 INTRODUCTION This report constitutes an amendment to the regional transportation plan prepared by the Ohio Kentucky Indiana Regional Council of Governments (OKI) for the Cincinnati metropolitan area. The OKI 2040 Regional Transportation Plan Moving the Region Forward (the Plan) was originally adopted by the OKI Board of Directors on June 14, The OKI Board of Directors adopted Amendment 1 in January, 2013, Amendment 2 in October, 2013 and Amendment 3 in November, The Board also took action on resolution on April 9, 2015 that adopted the FY16 19 TIP and amended the mobile source emissions analysis for the TIP and the Plan. A separate report was not prepared for the Plan therefore this amendment will be referred to as Amendment 4. Periodically, as needs and conditions change, it becomes necessary to modify the Plan and TIP. This amendment is undertaken to address the following items: 1) Add Duck Creek Extension in Hamilton County which is a high priority recommendation from the Eastern Corridor program of projects 2) Add the Wasson Way Trail in the City of Cincinnati The OKI 2040 Plan has fiscal capacity to accommodate the project. The Duck Creek Connector is considered a non exempt, non regionally significant roadway in terms of air quality conformity. Wasson Way is an exempt project. Therefore OKI will rely on a previous mobile source emissions analysis. Following is a more detailed description of each. 4 OHIO PROJECT RECOMMENDATIONS Duck Creek Extension (PID 98689) (Add project) The project would extend Duck Creek Rd. across Red Bank Road to Madison Rd and MedPace Way. Project creates a four legged intersection that will reduce the Red Bank and Madison Rd. intersection delay. Project cost is estimated at $5,581,000. 5 Wasson Way Trail (add project) The Wasson Way Trail is a 6.5 mile proposed shared use trail that runs along the Wasson Way Rail Corridor from Xavier University to the Little Miami Bike Trail. The Wasson Way Trail Network Phase 1 includes the primary shared used trail from Montgomery Road to Wooster Pike plus neighborhood connections extending from Blair Court to Sherman Avenue and Observatory Avenue to Old Red Bank Road. Total Project Cost for Phase 1 which includes the Wasson Way Trail and the three trail network connections is: $33,400,000 ($11,700,000 for ROW; $1,700,000 for design, and $20,000,000 for construction). Phase 2 total project cost is estimated at $10,000,000 for ROW and construction. Project is sponsored by the City of Cincinnati. Amendment 4 OKI 2040 Regional Transportation Plan June

6 AMENDED FISCAL CONSTRAINT DETERMINATION Fiscal constraint is determined on a state by state basis for the 2040 Plan. Individual project cost impacts are listed below. A positive number in the Amount column below indicates that the revised cost is less than the original the net amount. Cost changes are due to improved estimates and/or timing changes (i.e. time cost of money for projects with schedule changes compared to the original Plan or TIP). 7 TRANSPORTATION AIR QUALITY CONFORMITY Air Quality Conformity Report for an Amendment to the OKI 2040 Regional Transportation Plan Reliance on Previous Regional Emissions Analysis The Ohio Kentucky Indiana Regional Council of Governments (OKI) is the metropolitan planning organization (MPO) for the Greater Cincinnati/Northern Kentucky area responsible for transportation planning and air quality conformity. Transportation conformity is a mechanism to ensure that federal funding and approval are given to those transportation activities that are consistent with the air quality goals of the State Implementation Plans for Indiana, Kentucky and Ohio. On June 21, 2012, OKI adopted its OKI 2040 Regional Transportation Plan and the OKI FY Transportation Improvement Program was adopted on April 9, This report documents that the OKI 2040 Regional Transportation Plan, as amended, is in conformance with the State Implementation Plans (SIPs) of Indiana, Kentucky and Ohio and complies with the Clean Air Act. The amended OKI 2040 Regional Transportation Plan is relying on a previous regional emissions analysis per 40 CFR In 2012, under provisions of the Clean Air Act Amendments of 1990, the U.S. Environmental Protection Agency (EPA) designated nine counties in the Cincinnati area as a marginal nonattainment area for ozone under the current ozone standard. Nonattainment means that the area is not meeting the national ambient air quality standard. The Cincinnati ozone nonattainment area includes Lawrenceburg Township in Dearborn County Indiana, portions of the Kentucky counties of Boone, Campbell and Kenton, and the Ohio counties of Butler, Clermont, Clinton, Hamilton and Warren. Clinton County is outside of the OKI region, but is part of the nonattainment area. The Ohio Department of Transportation (ODOT) is the lead planning agency for Clinton County. In 2014, U.S. EPA designated seven counties as a nonattainment area under the 2012 annual fine particulate (PM 2.5 ) standard. The fine particulate nonattainment area includes portions of the Kentucky counties of Boone, Campbell and Kenton, the Ohio counties of Butler, Clermont, Hamilton and a portion of Warren. Budgets for the 2012 standard have not been established, however, the region must demonstrate maintenance of the previous PM 2.5 standard. That previous standard includes a portion of Dearborn County, Indiana as part of the maintenance area. The region is in attainment for all other criteria pollutants monitored by U.S. EPA. The amended OKI 2040 Regional Transportation Plan (OKI Plan) contains all projects which must be started in the OKI s Plan timeframe in order to achieve the highway and transit system envisioned. All OKI Plan and TIP projects which are regionally significant, have been included in the OKI Plan, as amended on April 9, 2015 with design concept and scope adequate to determine their contribution to regional emissions. This amendment #4 does not change the design concept nor scope of any regionally significant project. The previous regional emissions analysis was adopted by OKI on April 9, 2015 to support the adoption of the new OKI FY16 FY19 Transportation Improvement Program (OKI TIP) and amended OKI 2040 Regional Transportation Plan. (As of May 18, 2015, the federal conformity determination for the previous regional emissions analysis has not been made.) The results of the previous emission analysis show that emissions of ozone precursors, VOC and NO x, do not exceed the Amendment 4 OKI 2040 Regional Transportation Plan June

8 established VOC or NOx budgets. It also shows that annual direct PM2.5 and annual NO x emissions in the PM2.5 maintenance area do not exceed the established budgets. Kentucky NO x Annual Emissions OKI qualitatively finds that no goals, directives, recommendations or projects identified in the amended OKI 2040 Regional Transportation Plan contradict in a negative manner with any specific Amendment 4 OKI 2040 Regional Transportation Plan June

9 requirements or commitments of the applicable state implementation plans. The applicable implementation plans do not contain any transportation control measures (TCM s), therefore nothing in the amended TIP can interfere with their timely implementation. The OKI 2040 Regional Transportation Plan, as amended, and the OKI TIP continue to meet all requirements regarding fiscal constraint. Details on the proposed actions and fiscal constraint can be found in the amendment document, Amendment 4 OKI 2040 Regional Transportation Plan. INTERAGENCY CONSULTATION AND PUBLIC INVOLVEMENT In accordance with OKI s Public Participation Plan, the amendment documentation, as well as instructions on how to provide public comments, will be posted on OKI s website for a period of at least 14 days prior to the adoption by the OKI Executive Committee on June 11, OKI initiated interagency consultation (IAC) on May 18, All seven responses from IAC members indicated concurrence with the approach to rely on the previous emission analysis. A summary is below. Any additional IAC correspondence or public comments related to the air quality conformity for this amendment will be included in the final report. Name, Agency Concurrence? Please refer to Chapter 2. Provisions for public comment on this Amendment were provided through a 30 day public comment period and culminated in a public hearing held at 5:00 p.m. on Monday, June 8, 2015 at the OKI offices, 720 East Pete Rose Way, Suite 420, Cincinnati, Ohio. OKI advertised the Amendment in mainstream and minority newspapers and through standing OKI committees. This document was placed for public review on the OKI website. Through a qualitative evaluation, it is determined that the changes included in this Amendment 4 OKI 2040 Regional Transportation Plan and FY Transportation Improvement Program ensure Amendment 4 OKI 2040 Regional Transportation Plan June
