For more information on current changes to the Fisheries Act, as well as changes taking effect in the coming months, please refer to the DFO website Your proposal has been reviewed to determine whether it is likely to result in impacts to fish and fish habitat which are prohibited by the habitat protection provisions of the Fisheries Act, or by those prohibitions of the Species at Risk Act that apply to aquatic species.* Our review consisted of: Request for review form and a topo map showing site location, received September 18, 2013 Cross-sectional view of proposed riprap shoreline protection plan, received October 4, 2013 We understand that you propose to: Place clean rip rap of up to 3ft in diameter in size along the Mendel Riverbank of the South Saskatchewan River shoreline, up to a linear length of 135m *Those sections most relevant to the review of development proposals include 20, 22, 32 and 35 of the Fisheries Act and sections 32, 33 and 58 of the Species at Risk Act. 7 13-HCAA-CA o The rip rap will be placed slowly to avoid stirring up silt o Machinery will be working from the top of the bank o Rip rap will protrude about 1m into the water Work on the initial length of shoreline is proposed to be done between October 1 and Oct 31, 2013 o The remaining length of shoreline protection will be constructed as funding is secured To reduce potential impacts to fish and fish habitat, we are recommending that the attached mitigation measures be included into your plans: To prevent impacts to downstream habitat from sedimentation associated with construction, no in-water work shall occur during the spring spawning and rearing period, as well as the fall spawning period for whitefish. For this area, the closed inwater work period is Nov 1 st to July 15 th of any year. o Construction should be avoided during unusually wet, rainy, or winter thaw conditions. o Every effort will be made to minimize the introduction of sediment and the disturbance of sediment and debris during in-water work activities. Sediment and erosion control measures should be installed and maintained until all disturbed ground has been permanently stabilized to ensure that suspended soil particles in surface runoff water are trapped before being discharged into the aquatic environment. o Regularly inspect erosion and sedimentation control measures and structures during the course of construction and repair as needed. Stabilize disturbed areas, including spoil piles, as required (e.g., planting and seeding preferably with native trees, shrubs or grasses, cover areas with mulch to help seeds germinate). If there is insufficient time remaining in the growing season, the site should be stabilized (e.g., cover exposed areas with erosion control blankets to keep the soil in place and prevent erosion) and vegetate the following spring. Rip rap used to stabilize the shoreline is not to be taken from below the Ordinary High Water Mark of any water body. Please be aware that pursuant to Subsection 36(3) of the Fisheries Act, it is unlawful to deposit any deleterious substance, including sediment, into waters frequented by fish. To prevent any such deposit, the following mitigation measures should also be incorporated into your plans: o All materials and equipment used for site preparation and project completion should be operated and stored in a manner that prevents any deleterious substance (e.g., petroleum products, sediment etc.) from entering the water. o Operate machinery in a manner that minimizes disturbance to the banks or bed of the water body..../3

8 13-HCAA-CA o Equipment operating near the water should be free of external fluid leaks, grease, oil and mud. The cleaning, fuelling, and servicing of equipment will be conducted in an area from which spills and wash water will not enter the water. o All required machinery should be supplied with appropriate spill containment kits as a precaution in the event of accidental fuel spills or hydraulic leaks. Additional kits should be available on site with the capacity to contain any spills of deleterious substances that may be reasonably expected to occur. Contractors should ensure that all personnel are familiar with the used of spill kits. o Should there occur, or should there be a serious and imminent danger of the deposit of any deleterious substance, you are required to notify the Environment Canada 24 hour Spill Hotline at as soon as possible. Provided that the mitigation measures described in the attached are incorporated into your plans, DFO has concluded that your proposal is not likely to result in impacts to fish and fish habitat, and you will not need to obtain a formal approval from DFO in order to proceed with your proposal. It remains your responsibility, however, to meet the requirements of any other federal, provincial and municipal agencies. If your plans have changed or if the description of your proposal is incomplete you should consult our website to determine if a DFO review is required, and if so contact this office to determine if the advice in this letter still applies. Please be advised that any impacts to fish and fish habitat which result from a failure to implement this proposal as described or incorporate the additional mitigation measures included in this letter could lead to corrective action such as enforcement. In addition, under the new Fisheries Act, there is a requirement to notify DFO of any harmful alteration or disruption, or any destruction of fish habitat that has not been authorized. It is understood from your application dated September 18, 2013, that you propose to place rock rip rap to prevent erosion of the shoreline of the South Saskatchewan River. It is understood that the rock will be placed by using a backhoe. It is understood that the rock will be placed above the water on a 2:1 slope. It is understood that he proposed work will take place in the fall. Where appropriate, the Water Security Agency recommends the planting of deep rooted native vegetation species (e.g., willows, red osier dogwood, poplar, etc.) along the shoreline to provide greater stability to the bank and provide a more natural looking shoreline. 11 2014-SWCR-072-ST1 August 15 th, 2014 AQUATIC HABITAT PROTECTION PERMIT Pursuant to Section 36 of The Environmental Management and Protection Act, 2002, permission is hereby granted to Nola Stein of the Meewasin Valley Authority, ( Permit Holder ), and any agents acting on behalf of Meewasin Valley Authority to proceed with the placement of rock rip rap along the bank of the South Saskatchewan River at W. This permit is issued subject to and restricted to the following conditions: 1. No excavation of the bed, bank or boundary of the South Saskatchewan River is permitted. 2. No sand, soil, rock and vegetation shall be removed, altered, disturbed or added below the bank, other than that rock proposed for slope stabilization. No earthen fill, sand or any other material shall be pushed into the water or deposited below the bank. 3. Rock rip rap shall be obtained from outside the bed, bank or boundary of any watercourse or waterbody. These rocks must also be clean and free from dirt, sand, oil, grease or other contaminants and rocks shall be appropriately sized to withstand expected wind, wave and ice action. For example, rock with an average diameter size of 30 cm with a range of both smaller and larger sizes to fill in the gaps is often effective. 4. Stockpiled materials shall be located above the bank and stabilized so they will not erode into any waterbodies or watercourses. 5. Machinery and heavy equipment must arrive at the project site clean and free of fluid leaks or accumulations of external contaminants that may include, but are not limited to: oil, fuel, grease, other lubricants, soils, and mud or plant materials. Machinery and heavy equipment must be cleaned, fuelled, serviced and stored in a manner that will not contaminate the bed, bank or boundary of any waterbody or watercourse. 6. Machinery and heavy equipment must be located and operated from a stable location above the bank and is not to enter the open water under any circumstances. 7. Adequate precautions must be taken to prevent debris and sediment from entering the water. Any project debris must be prevented from entering the water and must be removed as soon as practical and disposed of in approved sites. It is unacceptable to bury or burn any debris on site. 8. All disturbed project site areas, including approaches and disturbed slopes adjacent to any waterbody, shall be stabilized with short and long term sediment and erosion control measures that have been tailored to site conditions, to prevent sediment laden runoff from entering the lake Albert Street Regina SK S4P 4K1 Canada ph: fax:

12 9. All project debris, including any structures removed or replaced, and temporary works must be removed and disposed of appropriately. 10. The natural contour of the shoreline shall be maintained unless authorized by the Water Security Agency. 11. To maintain shoreline stability, no rock shall be removed from the bed, bank or boundary of any waterbed or watercourse. 12. Where appropriate, WSA recommends the planting of deep rooted native vegetation species (e.g., willows, red osier dogwood, poplar, etc.) along the shoreline to provide greater stability to the bank and provide a more natural looking shoreline. 13. During construction and until a stable shoreline is re-established, effective sediment and erosion control measures must be used on disturbed areas to prevent sediment laden runoff from entering the water body or water course. 14. All contractors are to receive copies of all permits before they begin any work, and shall have a copy of the permit on site at all times. 15. Contact a Conservation Officer at (306) prior to beginning this work so that appropriate inspections may be conducted. 16. The Permit Holder is solely responsible for all design, safety, and workmanship aspects of all works associated with this permit. 17. Water Security Agency may order the Permit Holder to cease any or all work regarding this project if, in the Agency s opinion, the work is or may cause harm to the environment. 18. Water Security Agency may order the Permit Holder to do any further work required to rectify any actual or potential problems that is deemed necessary to protect the environment. 19. Activity restriction guidelines for Prairie Ragwort (Senecio plattensis) exist at this location. All construction activities must be 25 metres from any population. 20.
