4 NFIP Ohio Department of Natural Resource (ODNR), Division of Water administers the National Flood Insurance Program (NFIP) in Ohio ORC 1521 authorizes ODNR to manage floodplains and to appoint local jurisdictions with authority over floodplains and the development of standards to protect their local floodplain resources and values.

5 NFIP NFIP- Requires all development undertaken by ODOT (federally funded or state funded) in a federally identified Special Flood Hazard Area (SFHA) within a given jurisdiction (county or municipality) must comply with the performance standards of the respective locally-adopted floodplain regulations.

6 EO Executive Order (EO 11988)- Requires each Federal Agency to address floodplain management Federal Highways Administration (FHWA) regulations for EO 11988, located in 23 CFR 650 Subpart A.

7 CFR 650 Policy Contains Design Policy Consistency with NFIP standards is required Coordination with FEMA is required

8 CFR 650 Policy Where feasible, exclude bridge components from the floodway Bridge elements such as piers may encroach on the floodway if there is a very minor effect and if the model can reflect no rise Modifications to floodway are permitted if it s determined to be cost effective and the community is in agreement

9 EO Executive Order Revised Floodplain Standards- January 2015 FHWA is in the process of developing new criteria due to the EO Directed to continue with CFR 650 policy until FHWA has finalized the new criteria

11 Actions in FEMA Zone Action- any highway construction, reconstruction, rehabilitation, repair, or improvement

12 Actions in FEMA Zone Location and Design Manual, Volume 2 Drainage Design, Section 1005 Highway Encroachments on Flood Plains

13 Actions in FEMA Zone The District Hydraulic Engineer or the Design Consultant will handle the majority of the hydraulic analysis for projects; following policy in the ODOT Location and Design, Volume 2. On every project, the District Environmental Document Preparer is required to check the FIRM map to determine if the project is located within the Special Flood Hazard Area (SFHA).

14 Actions in FEMA Zone The District Hydraulic Engineer (or Design Consultant) will provide the following documents to the Environmental Document Preparer: All correspondence to the Local Floodplain Coordinator Hydraulic and Hydrologic Calculations demonstrating carrying capacity of the body of water if applicable The District Environmental Document Preparer uploads all documents to an Electronic System (Environet)

16 ODOT Flood Clearance All Highways that encroach on floodplains are designed to permit conveyance of the 100 year flood without causing significant damage to the highway, the water course, or other property. Inundation of the highway is acceptable for the 100 year flood, but not the design year

17 ODOT Flood Clearance in SFHA If the floodplain is a Special Flood Hazard Area (SFHA), additional parameters apply: Coordination with the Local Floodplain Coordinator is required Water surface profiles generated from the 100 year discharge from the Flood Insurance Study is restricted per Local Requirements

18 ODOT Flood Clearance in SFHA ODOT is required to comply with Federal, State, and Local flood standards ODOT is not required to obtain a local floodplain permit per ORC (D) ODOT must also ensure / demonstrate compliance with all SFHA-actions it undertakes or preempts Information will be sent to the Local Floodplain Coordinators

19 ODOT Flood Clearance in SFHA New bridges to span floodway when feasible A no-rise condition is preferred when feasible If there are impacts to the water surface elevation above the base flood elevation in an established floodway, a variance or FEMA Map revisions will be required

20 Local Flood Clearance in SFHA Locals using Federal or State funds are required to comply with Federal, State, and Local flood standards Are required to obtain a local floodplain permit Must also ensure / demonstrate compliance with all SFHA-actions it undertakes or preempts
