SIA/PB/MIN/4944/2015) The SEAC observed as under: The General Manager cum Mining Officer, District Industries Centre, SBS Nagar vide application no.sia/pb/min/4944/2015 dated submitted online, has applied for obtaining environmental clearance under EIA notification dated for mining of minor minerals(sand) from river bed in the revenue estate of Village Auliapur, Tehsil Balachaur, District SBS Nagar. The project is covered under category 1 (a) of the Schedule appended to the said notification. The project proponent has submitted the following documents alongwith Form I: (i) Pre- feasibility report (ii) Land Documents (iii) 10 K.M. radius Topographic Map of Proposed Project. (iv) 1 Km google map showing the sand mining site. (v) Location Plan on Latha Map. (vi) Haul Road Map (vii) Contour Map (viii) DFO Letter (ix) Site Photographs (x) Undertaking (xi) Consent of Farmer (xii) Commissioner Certificate for land excavation The GMDIC has not submitted the mining plan. Further, the hadbast no mentioned in form is 421 whereas that mentioned in PFR & Jamabandi is 459. The case was placed in the agenda of the 139 th meeting of SEAC held on , but no one from the project proponent attended the said meeting. In view of above, the SEAC decided to defer the case in light of Office Memorandum dated of MoEF, Govt. of India and to convey the above observations to Project Proponent. Accordingly, the project proponent was asked by vide letter no. 430 dated to submit the reply of the aforesaid observation and attend the

The case was considered by the SEAC in its 141 st meeting held on , which was attended by the following on behalf of the project proponent: i) Sh. Gurdev Singh Mahal, GM, DIC, SBS Nagar ii) Sh. Ltd., Noida is the Environmental Consultant, presented the case before the SEAC as under: About Tonne of mining of minor minerals(sand) will be carried out in an area Hectare in the revenue estate of Village Auliapur, Tehsil Balachaur, District SBS Nagar on river Satluj in H.B. no. 459, and details of khasra nos is as under:- Murba No.:18, Killa No.: 3, 4, 5, 6, 7, 8, 9, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25 Murba No.: 19, Killa No.: 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25 Murba No.: 13, Killa No.: 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25 Murba No.: 12, Killa No.: 2, 3, 4, 5, 6, 7, 8, 9, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22/1, 22/2, 23, Murba No.: 11, Killa No.: 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24. The entire mining lease area being part of river bed, there is no vegetation in the lease area. Hence, there would be no clearance of existing land, vegetation and buildings. The mining activity will be confined to the lease area i.e. from the dry bed of River Satluj, so no new land use will be created. Excavation will be carried out only up to a depth of 3 m (Maximum) below ground level or above water level, whichever is less. Excavation of Sand material will be done only during the day time and completely stopped during the monsoon season. The work relates to only excavation of sand (River Bed Material) from dry bed of the river during non-monsoon season. No construction work is required for the proposed activity.

3 Proceedings of the 141st meeting of SEAC held on (Online).doc The proposed project is of open cast Sand (RBM) mining. There will not be any underground mining or tunneling. The minerals excavated during mining process will be replenished naturally during the subsequent rainy seasons. Hence no reclamation works are proposed. Sand excavated will be loaded directly into trucks for transportation. Hence no storage facility will be required. About persons for 300 working days will be deployed to carry out various activities of mining of minor minerals. Insignificant amount of Domestic solid waste will be generated from the proposed project tonnes of top soil will generated.. The soil covering the sand horizon commands good demand and may be distribute to neighborhood farmers free of cost. The top soil cover should not be wasted and disposed off anywhere else Liquid effluent will be generated from Portable Bio-Toilet provided for the mining workers at site. The sewerage generated from the toilet shall be collected and treated by the inbuilt process of DRDO pantented Bio technology using specially cultured anaerobic bacteria. No new road, rail will be proposed. Only exiting transport network will be used. There will be an increase in traffic because of movement of few trucks for transportation of minerals The total water requirement will be 8.22 KLD out of which 6.6 KLD will be used for dust suppression activities, KLD for domestic purpose, and KLD for Green Belt development which will be supplied through private tankers on rent. This project operation will not involve use of any materials, hazardous to human health or environment. Mining activity will be done semi-mechanically by using JCB & Poclain. No hazardous and toxic material will be used or to be generated during operational phase. Proposed mining is for sand from inactive channel of riverbed. There is a cover of approximately 50 cm thick of soil/overburden. The soil covering the sand horizon commands good demand because of enriched soil nutrients and may be distributed to villagers free of cost

Portable Bio-Toilet shall be provided for the workers at the site. The sewage generated from the toilet provided for the mine workers shall be collected and treated by the inbuilt process of DRDO patented Bio technology using especially cultured anaerobic bacteria. The emission will be due to operation of JCB/Poclain machine and by movement of vehicles used in transportation (vehicular exhaust) which will be minimized by using only PUC vehicles and Bharat-IV stage vehicles in related to the project. Some dust is likely to be emitted during transportation of minerals i.e. dust, vehicular exhaust anticipated during loading, unloading of excavated material. However adequate measures will be taken to suppress the dust and preventing it to become airborne. Blasting and piling is not proposed for the proposed project. Mining will be carried during day time and in open area. Thus there is no need for lighting and cooling systems. No discharge of sewage or other effluents will be there. No hazardous substance will be used or produced during the proposed mining operations. The proposed activity will be undertaken by the Department of Industries & Commerce, Punjab and the General Manager-cum-Mining Officer will be Incharge of the Mining site. The project proponent has submitted the consents of the farmer of the land from where mining is to be carried out. NOC has been issued by the Department of Forest & Wildlife, SBS Nagar vide letter no. 239 dated 10/04/2015, to the effect that the above said khasra nos are not under the control of Department of forest & Wildlife, SBS Nagar. Further, there is one forest namely Auliapur Reserve Forest adjoining to the said mining site, as such demarcation is required. Further, the project proponent has clarified that mining has to be carried out in the Hadbast no. 459 as mentioned in jamabandi. Hadbast No. 421 is wrongly mentioned in the in Pre feasibility report. The project proponent has also presented the proposed TOR

5 Proceedings of the 141st meeting of SEAC held on (Online).doc The SEAC observed that as per the amendment in EIA notification, 2006 issued by MoEF & CC vide notification dated , sustainable sand mining guidelines have been framed according to which the District Survey Report (DSR) shall be prepared and finalized for each minor mineral in the district separately by the DEIAA and DSR shall form the basis for application for Environmental Clearance, Preparation of report and appraisal of the projects. To this observation of SEAC, the General Manager cum Mining officer requested that provisions of amended notification dated including forming District Survey Report to the basis of report etc. will be kept in mind while preparing EIA report. He further requested that they may be issued TOR and allowed to start monitoring/collection of baseline data at their own risk & cost and EIA report will be prepared subject to technical feasibility of site as per District Survey Report. After detailed deliberations, the SEAC categorized the project as category B-1 of the EIA Notification dated and the project proponent is required to be issued 'Terms of Reference' (TOR) for preparation of detailed draft Rapid EIA report. The Committee decided to finalize following "Terms of Reference" and to convey the same to the project proponent for preparation of rapid EIA study report: 1. EIA study report shall be prepared as per final District Survey Report (DSR), which is to be prepared & finalized by respective DEIAAs. However, the project proponent may carry out monitoring/collect baseline data at his own risk & cost. 2. EIA study shall be carried out in acordance with the provisions of MoEF & CC notification dated incorporating all the guidelines and procedures listed for sustainable sand mining. 3. EIA study shall also cover the provision of OM NO /57/2014-IA-II(M) dated regarding Impact of mining activities on habitations-issues related to the mining projects where in Habitations and villages are the part of the mine lease area or Habitations and villages are surrounded by the mine lease area. 4. All documents including approved mine plan (eco friendly mine plan), EIA report and public hearing should be compatible with one another in terms of the mine lease area, production levels, waste generation and its management

The terms and conditions imposed, if any, by the Competent Authority in the State Government while granting mining lease/permit/contract should be built into the mine plan (eco friendly mine plan) as well as the EIA report. It may inter-alia include; area of working (length and breadth of the river stretch), mode of working, working shift, transportation of mineral, restriction, if any imposed for working etc. 6. Involvement of forestland, if any, in the project and status of forestry clearance should be given. 7. The study area will comprise of 10 km zone around the mine lease from lease periphery and the data contained in the EIA such as waste generation etc should be for the life of the mine / lease period. 8. Land use of the study area delineating forest area, agricultural land, grazing land, wildlife sanctuary and national park, migratory routes of fauna, water bodies, human settlements and other ecological features. 9. Land use plan of the mine lease area should be prepared to encompass preoperational, operational and post operational phases. 10. Impact of the project on the wildlife in the surrounding and any other protected area and accordingly detailed mitigation measures required should be worked out with cost implications. 11. The vegetation in the reserved forest/protected forest in the study area, if any, should be indicated. 12. A study shall be got done to ascertain the impact of the mining project on wildlife of the area including aquatic life. 13. Location of National Parks, Sanctuaries, Biosphere Reserves, Wildlife Corridors, Tiger/Elephant Reserves (existing as well as proposed) within 10 km of the mine lease should be clearly indicated supported by a location map duly authenticated by Chief Wildlife Warden. Necessary clearance from the Chief Wildlife Warden for operating the mine within 10 km of the National Park / Sanctuary, if any, should also be obtained and furnished. 14. A detailed biological study for the study area [core zone and buffer zone (10 km radius of the periphery of the mine lease)] including the aquatic fauna in the riverine system shall be carried out. Details of flora and fauna, duly authenticated, separately for core and buffer zone should be furnished based

In case of any scheduled-i fauna found in the study area, the necessary plan for their conservation should be prepared in consultation with State Forest and Wildlife Department and details furnished. Necessary allocation of funds for implementing the same should be made as part of the project cost. 15. Impact of the project on land use including change of river course, if any should be given. 16. Impact on topography, drainage, agricultural fields, cattle fields, wildlife, water logging leading to water borne diseases, if any. It may also be shown whether it will lead to change of watercourse of the river. Modelling exercise should also be carried out through an expert agency to show the change in river flow dynamics, if any. 17. Collection of one season (non-monsoon) primary baseline data on ambient air quality (PM 2.5, PM 10, S0 2 and NO x ), water quality, noise level, soil and flora and fauna, site-specific meteorological data should also be collected. The location of the monitoring stations should be justified. Date wise collected baseline AAQ data should form part of EIA and EMP report. The mineralogical composition of PM 10 particularly for free silica should be given. There should be at least one AAQ monitoring station within 500 m of the mine lease in the pre-dominant downwind direction. 18. Air quality modelling should be carried out for prediction of impact of the project on the air quality of the area. It should also take into account the impact of movement of vehicles for transportation of mineral. The details of the model used and input parameters used for modelling should be provided. The air quality contours may be shown on a location map clearly indicating the location of the site, location of sensitive receptors, if any and the habitation. The wind roses showing pre-dominant wind direction may also be indicated on the map. The water requirement for the project, its availability and source to be furnished. A detailed water balance should also be provided. Fresh water requirement for the project should also be indicated. 19. Necessary clearance from the Competent Authority for withdrawal of requisite quantity of water for the project should be provided. 20. Impact of the project on the water quality should be assessed and necessary safeguard measures, if any required should be provided.

A schematic diagram may also be provided for the same. 22. Quantity of solid waste generation, if any, should be estimated and details for its disposal and management should be provided. 23. Impact on local transport infrastructure due to the project should be evaluated. Projected increase in truck traffic as a result of the project in the present road network (including those outside the project area) and whether it is capable of handling the increased load should be estimated. Arrangement for improving the infrastructure, if contemplated including action to be taken by other agencies such as State Government, if any, should be covered. 24. Details of the infrastructure facilities to be provided for the mine workers should be furnished. 25. Phase-wise plan of greenbelt development, plantation and compensatory afforestation clearly indicating the area to be covered under plantation and the species to be planted should be provided. 26. Occupational health impacts of the project activity should be anticipated and reported and proposed preventive measures indicated. These alongwith details of pre-placement medical examination and periodical medical examination schedules and medical facilities proposed to be provided should be incorporated in the EMP 27. Measures of socio economic influence to the local community, proposed to be provided by project proponent should be spelt out. As far as possible, quantitative dimensions should be given. 28. Detailed environmental management plan to mitigate the environmental impacts. Specific safeguard measures to control PM 10 as well as pollution due to transportation should be given. 29. Public hearing points raised and commitment of the project proponent on the same along with time bound action plan to implement the same should be provided. 30. Details of litigation pending against the project, if any, with direction order passed by any Court of Law against the project should be given. 31. The cost of the project (capital cost and recurring cost) as well as the cost towards implementation of EMP should clearly be spelt out.

No. J-11013/41/2006-IA.II(I) Part dated Other details as indicated in Appendix III of EIA Notification 2006 and the manual titled as "EIA guidance Manual" published by the Ministry of Environment & Forests, New Delhi for mining projects, should also be attended. The project proponent should prepare draft rapid EIA / EMP Report for its project based on above Terms of Reference and apply to the Member Secretary, Punjab Pollution Control Board for conducting public hearing as per the provisions of EIA Notification, 2006 as amended from time to time on submitting EIA / EMP / Executive Summary Report prepared by the project proponent as per TORs. After completing the process of public hearing / public consultation, the industry shall submit final EIA / EMP to the State Expert Appraisal Committee after incorporating all the issues raised during public hearing / public consultation for Appraisal of its project. Land use of the study area delineating forest area, agricultural land, grazing land, wildlife sanctuary and national park, migratory routes of fauna, water bodies, human settlements and other ecological features. 9. Land use plan of the mine lease area should be prepared to encompass preoperational, operational and post operational phases. 10. Impact of the project on the wildlife in the surrounding and any other protected area and accordingly detailed mitigation measures required should be worked out with cost implications. 11. The vegetation in the reserved forest/protected forest in the study area, if any, should be indicated. 12. A study shall be got done to ascertain the impact of the mining project on wildlife of the area including aquatic life. 13. Location of National Parks, Sanctuaries, Biosphere Reserves, Wildlife 14

15 Corridors, Tiger/Elephant Reserves (existing as well as proposed) within 10 km of the mine lease should be clearly indicated supported by a location map duly authenticated by Chief Wildlife Warden. Necessary clearance from the Chief Wildlife Warden for operating the mine within 10 km of the National Park / Sanctuary, if any, should also be obtained and furnished. 14. A detailed biological study for the study area [core zone and buffer zone (10 km radius of the periphery of the mine lease)] including the aquatic fauna in the riverine system shall be carried out. Details of flora and fauna, duly authenticated, separately for core and buffer zone should be furnished based on field survey clearly indicating the Schedule of the fauna present. In case of any scheduled-i fauna found in the study area, the necessary plan for their conservation should be prepared in consultation with State Forest and Wildlife Department and details furnished. Necessary allocation of funds for implementing the same should be made as part of the project cost. 15. Impact of the project on land use including change of river course, if any should be given. 16. Impact on topography, drainage, agricultural fields, cattle fields, wildlife, water logging leading to water borne diseases, if any. It may also be shown whether it will lead to change of watercourse of the river. Modelling exercise should also be carried out through an expert agency to show the change in river flow dynamics, if any. 17. Collection of one season (non-monsoon) primary baseline data on ambient air quality (PM 2.5, PM 10, S0 2 and NO x ), water quality, noise level, soil and flora and fauna, site-specific meteorological data should also be collected. The location of the monitoring stations should be justified. Date wise collected baseline AAQ data should form part of EIA and EMP report. The mineralogical composition of PM 10 particularly for free silica should be given. There should be at least one AAQ monitoring station within 500 m of the mine lease in the pre-dominant downwind direction. 18. Air quality modeling should be carried out for prediction of impact of the project on the air quality of the area. It should also take into account the impact of movement of vehicles for transportation of mineral. The details of the model used and input parameters used for modeling should be provided. 15

16 The air quality contours may be shown on a location map clearly indicating the location of the site, location of sensitive receptors, if any and the habitation. The wind roses showing pre-dominant wind direction may also be indicated on the map. The water requirement for the project, its availability and source to be furnished. A detailed water balance should also be provided. Fresh water requirement for the project should also be indicated. 19. Necessary clearance from the Competent Authority for withdrawal of requisite quantity of water for the project should be provided. 20. Impact of the project on the water quality should be assessed and necessary safeguard measures, if any required should be provided. 21. Information on site elevation, working depth, groundwater table should be provided both in AMSL and BGL. A schematic diagram may also be provided for the same. 22. Quantity of solid waste generation, if any, should be estimated and details for its disposal and management should be provided. 23. Impact on local transport infrastructure due to the project should be evaluated. Projected increase in truck traffic as a result of the project in the present road network (including those outside the project area) and whether it is capable of handling the increased load should be estimated. Arrangement for improving the infrastructure, if contemplated including action to be taken by other agencies such as State Government, if any, should be covered. 24. Details of the infrastructure facilities to be provided for the mine workers should be furnished. 25. Phase-wise plan of greenbelt development, plantation and compensatory afforestation clearly indicating the area to be covered under plantation and the species to be planted should be provided. 26. Occupational health impacts of the project activity should be anticipated and reported and proposed preventive measures indicated. These alongwith details of pre-placement medical examination and periodical medical examination schedules and medical facilities proposed to be provided should be incorporated in the EMP 27. Measures of socio economic influence to the local community, proposed to be provided by project proponent should be spelt out. As far as possible, 16

17 quantitative dimensions should be given. 28. Detailed environmental management plan to mitigate the environmental impacts. Specific safeguard measures to control PM 10 as well as pollution due to transportation should be given. 29. Public hearing points raised and commitment of the project proponent on the same along with time bound action plan to implement the same should be provided. 30. Details of litigation pending against the project, if any, with direction order passed by any Court of Law against the project should be given. 31. The cost of the project (capital cost and recurring cost) as well as the cost towards implementation of EMP should clearly be spelt out. 32. The prescribed TORs would be valid for a period of three years for submission of the EIA/EMP reports, as per the O.M. No. J-11013/41/2006-IA.II(I) Part dated Other details as indicated in Appendix III of EIA Notification 2006 and the manual titled as "EIA guidance Manual" published by the Ministry of Environment & Forests, New Delhi for mining projects, should also be attended.
