This is an Environment Agency initiated variation which has been undertaken to correct some issues with the original permit determination. This variation also implements the changes imposed by The Environmental Permitting (Engl Wales) (Amendment) Regulations 2013 which transpose the requirements of the Industrial Emissions Directive (IED). The schedules specify the changes made to the original permit. The status log of a permit sets out the permitting history, any changes to the permit number. 4 Schedule 1 conditions to be deleted None Schedule 2 conditions to be amended The following conditions are amended as detailed, following an Environment Agency initiated variation Conditions are amended to the requirements of the conditions to the specified activities. 1.2 Energy efficiency For the activities d in schedule 1, table S1.1 as AR1, AR2, AR3, AR4 AR5, the operator shall: (a) (b) (c) take appropriate measures to ensure that energy is used efficiently in the activities; review record at least every four years whether there are suitable opportunities to improve the energy efficiency of the activities; take any further appropriate measures identified by a review. 1.3 Efficient use of raw materials For the activities d in schedule 1, table S1.1 as AR1, AR2, AR3, AR4 AR5, the operator shall: (a) (b) (c) (d) take appropriate measures to ensure that raw materials water are used efficiently in the activities; maintain records of raw materials water used in the activities; review record at least every four years whether there are suitable alternative materials that could reduce environmental impact or opportunities to improve the efficiency of raw material water use; take any further appropriate measures identified by a review. Condition is amended to include process monitoring in the permit. 3.5 Monitoring The operator shall, unless otherwise agreed in writing by the Environment Agency, undertake the monitoring specified in the following tables in schedule 3 to this permit: (a) point source emissions specified in tables S3.1 S3.2. 6 Condition is amended to the requirements of the condition to the specified activities For the activities d in schedule 1, table S1.1 as AR6 to AR10, the Environment Agency shall be notified without delay following the detection of: (a) any malfunction, breakdown or failure of equipment or techniques, accident, or emission of a substance not controlled by an emission limit which has caused, is causing or may cause significant pollution; (b) the breach of a limit specified in the permit; or (c) any significant adverse environmental effects. Table S1.1 as d by condition 2.1.1, is amended to the updated Schedule 1 s imposed by The Environmental Permitting (Engl Wales) (Amendment) Regulations 2013 to add additional limits to AR9 Blending mixing to produce SLF. 10 Table S1.3 Improvement programme requirements Reference Requirement Date IC2 Survey of VOC emissions to air The operator shall conduct a survey for emissions of VOCs to air from the bulking drum washing/crushing activities. The monitoring methods locations shall be agreed in advance with the Environment Agency. Within 3 months of drum washing/crushing commissioning Monitoring report assessment of VOC emissions The operator shall submit a report detailing the findings of the above monitoring exercise that shall include, but need not be limited to, the following: a summary of the monitoring results; an evaluation of the potential impact, using the Environment Agency s H1 software, (or other agreed methodology); a review of the need for emission limit values, on-going monitoring abatement for any emissions that are not regarded as insignificant; in any case, a BAT assessment for the minimisation of VOC emissions, (such as the installation of local exhaust ventilation with abatement, carbon filters for tanker transfers wet scrubber on drum washer) Once approved in writing by the Agency, the report shall be implemented in accordance with the timescales specified in that report. The notification requirements of condition will be deemed to have been complied with on submission of the report. Within 2 months of the above monitoring survey Table S1.4 as d by condition 2.5.1, is amended to include additional pre-operational conditions PO4 to PO10. These are required to correct issues arising from the determination of the original application for the permit. 11 Table S1.4 Pre-operational measures for future development Reference Operation Pre-operational measures PO2 Use of heat in bulk tank in oil/water phase separation process At least 4 weeks prior to the use of heat in the oil separation process, the operator shall submit a report that reviews the potential increase in VOC odour emissions the whither suitable abatement is fitted to the tank vents. This review shall also include a review of the need for a repetition of the monitoring, reporting assessment conducted for PO6. Where the report identifies improvements, these shall be implemented in accordance with the timescales agreed with the Environment Agency. PO3 Change of bulk tank duty from waste oil storage / to other liquid waste storage / bulking / blending operation At least 4 weeks prior to change of tank duty, the operator shall submit a report to the Environment Agency that reviews whether the existing tank vent abatement is suitable for the new waste types. Where the report identifies improvements, these shall be implemented in accordance with the timescales agreed with the Environment Agency. PO4 Emissions to sewer Prior to any discharge to the sewer the operator shall submit a populated H1 assessment (or other agreed methodology) to assess the emissions to sewer monitoring proposals for the Environment Agency s written approval. PO5 Emissions to sewer The operator shall conduct a survey of emissions to sewer from the oil / water phase separation process, having regard to Environment Agency Sector Guidance Note IPPC S5.06, Section The operator shall send a report in writing to the Environment Agency confirming that the above survey has been conducted that the system emissions are in line with Environment Agency Sector Guidance Note IPPC S5.06, Section Also, based the results of the above assessment, a report shall be submitted to the Environment Agency shall include, but need not be limited to, a review of the need for emission limit values, on-going monitoring abatement for any emissions that are not regarded as insignificant. Once approved in writing by the Environment Agency, the report shall be implemented in accordance with the timescales specified in that report. Page 9

PO7 Blending of Fuel Oil/Solvent in bulk tanks Prior to designing constructing the plant for the Blending of SLF Oil/Solvent bulking activities (AR9, the operator shall submit full specification ( Piping Instrumentation Diagrams (P&ID)) for the plant detailing at least but not limited to :- 1. Reaction Vessel (Tanks), pipework, valves etc. 2. Bunding 3. Process controls 4. Emissions control monitoring if necessary. The above shall be submitted to the Environment Agency for written approval. PO8 Blending of Fuel Oil/Solvent in bulk tanks Prior to the construction of the Blending of SLF Oil/Solvent bulking activities (AR9, the operator shall 1. undertake a review of the BAT assessment for the Blending of SLF Oil/Solvent Bulking submitted with the application submit a report to the Environment Agency for written approval; 2. ensure that this proposed design performance meets the requirements of legislation, guidance /or BREFs/BREF Conclusions at that time; 3. ensure that any relevant legislative changes or stards have been incorporated in to the system design, management systems ELV. PO9 Blending of Fuel Oil/Solvent in bulk tanks Prior to commencement of commissioning of the Blending of SLF Oil/Solvent bulking activities (AR9, the operator shall, at least 2 weeks before, submit a report demonstrating that the management systems process controls are in place for the blending of Fuel Oil/Solvent bulking activities (AR9 that staff have received the necessary training. PO10 Blending of Fuel Oil/Solvent in bulk tanks Prior to the commencement of commissioning of the Blending of SLF Oil/Solvent bulking activities (AR9, the operator shall provide a written commissioning plan for approval by the Environment Agency.
