1 Proceedings for the 86 th meeting of State Level Environment Impact Assessment Authority to be held on at am in the Committee Room, Punjab Pollution Control Board, Vatavaran Bhawan, Nabha Road, Patiala. The following were present: 1. Sh. Darshan Singh Jaidka, Chairman, SEIAA 2. Sh. Anil Kumar Sondhi, Member, SEIAA 3. Sh. Tejinder Singh Dhaliwal, IAS Member Secretary, SEIAA At the outset, the Member Secretary (SEIAA) welcomed the members of the State Environment Impact Assessment Authority (SEIAA) in 86 th meeting. Thereafter, agenda items were discussed in detail as under: Item No : Confirmation of the minutes of 85 th meeting of SEIAA held on The SEIAA noted that the proceedings of 85 th meeting of SEIAA held on were circulated to all concerned vide letter no dated No observation has been received from any of the members. As such, SEIAA confirmed the said proceedings. Item No.86.02: Action taken on the proceedings of 85 th meeting of SEIAA held on It was seen by the SEIAA. Item No.86.03: Application for obtaining Environmental Clearance under EIA notification dated for construction of Group Housing Pocket 2C-2, namely "Sky Gardens" Sector 66-A, Mohali by M/s Janta Land Promoters Ltd. The SEIAA observed that: M/s Janta Land Promoters Ltd applied to MoEF on for obtaining the Environmental Clearance under EIA notification dated for construction of a Group Housing Pocket 2C-2, namely "Sky Gardens" Sector 66- A, Mohali because SEIAA/SEAC, Punjab was not in existence at that time and now

2 the case has been transferred by MoEF to SEIAA, Punjab vide no. F.No /2012-IA-III dated (received on ). The project is covered under category 8 (a) of the Schedule appended to the said notification. The application has been transferred to SEIAA, Punjab in original vide letter dated (received in this office on ). The details of the project as given in Form 1 and 1A and other documents are as under: The total land area of the project is 5.98 acres and the total built up area will be sqm. The project involves construction of 368 residential flats in 8 blocks. The cost of the project is Rs Crores. The total water requirement for the project will be 276 KLD, out of which 202 KLD will be met through groundwater by installing tubewells and 74 KLD will be met through treated wastewater. The CGWA has issued NOC vide no. 637 dated 18/4/2013 to M/s JLPL in respect of their proposed Super Mega Industrial Project at Sector-66A, 82 & 83 at Mohali fopr abstraction of 2322 KLD of groundwater. The total wastewater generation from the project will be 221 KLD, which will be treated in a STP of capacity 2800 KLD to be installed by M/s JLPL for Super Mega Project. The project proponent has proposed to use 74 KLD of treated wastewater for flushing purpose. In summer season, 34 KLD of treated wastewater will be used for horticulture, 11 KLD in winter season and 3 KLD in rainy season. Excess of treated wastewater will be disposed into GMADA sewer. The total quantity of solid waste generation will be 736 Kg/day, which will be segregated at source as biodegradable and non-biodegradable components as per the Municipal Solid Waste (Management & Handling) Rules, The recyclable inorganic waste will be sold out to the local resellers. The solid waste will be handled at the common solid waste handling area of Super Mega Project. The total load of electricity required for group housing will be 1570 KW, which will be taken from the PSPCL. There is a proposal to install Nine no. DG sets of capacity 200 KVA as stand by for power back-up. The project proponent has proposed to provide rainwater harvesting pits for tapping of rain water to recharge the aquifer. 2

3 Used oil to be generated from the DG sets will be managed & handled as per the provisions of the Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, The other details of the project have been given in the Form 1 & 1-A submitted by the promoter and the details of the proposed project are as under: 1. Layout plan duly approved by the Submitted Competent Authority. 5. Topographical map of the area showing Submitted Contour Plan. 6. Status of construction, if any, alongwith photographs from all the four sides meter radius map of the area from periphery of project site clearly indicating the various industries (specifically red category industries) and structures lying in the area. 8. M/s JLPL further agrees to provide treated 74 KLD for flushing to sky garden group housing pocket. M/s JLPL also agrees to pick & manage solid waste generated from Sky Garden Group Housing. c) Use of Ground Water 10. Water balance chart for summer, rainy and winter seasons indicating critical requirements. 11. Availability of adequate land for use of treated sewage and plantation. 12. Analysis reports of ambient air, ground water and noise levels from NABL/MoEF Accredited laboratories. (c) M/s JLPL has signed MoU with Sky Garden Group Housing to supply 276 KLD (Fresh & treated). Submitted. Not required. The ambient air monitoring has been got done from M/s Eco Laboratories & Consultants Pvt. Ltd. and the analysis results 4

5 indicate that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO x, NH 3, O 3, CO, BaP, C 6 H 6, As, Nickle and Pb have been measured. Also, ambient noise monitoring has been got done from the said firm and the analysis results indicate that the noise levels during day and night times, have been measured as 52.8 db(a) leq and 41.9 db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a) leq. 13. Compliance of various environmental regulations c) Steps to be taken in case of emergency such as accidents at the site including fire. d) For how long period the project proponent will be responsible for implementation of EMP and the name of the person(s) responsible for implementation of EMP. e) Capital & recurring cost for the EMP per year and the details of funds for the same. f) Name of the individual persons / organization, who will be responsible for implementation of EMP after the lapse of the period for which the project proponent is responsible. (e) During construction phase, Rs. 25 lacs will be incurred for implementation of EMP and Rs. 4 lacs/annum will be incurred on account of recurring charges. (f) After the lapse of the period for which the welfare society of Sky Garden along with Environment Management Cell will be responsible for implementation of EMP. 18. Corporate Social Responsibility indicating various activities to be undertaken, provisions of funds for the same, the period for which the same is to be implemented and the person(s) responsible for the implementation of the same. 19. NOC of the nearest Air Port issued by its Authority Rs. 10 lac will be utilized for the following activities under Corporate Social Responsibility and the implementation of the CSR will be responsibility of Partner of the company: School upto middle class Creche for children of labour Dispensary for welfare of villager at the space offered by the villagers. The NOC issued by Airports Authority of India vide the no. Air HQ/S 17726/4/ATS dated submitted and as per this NOC the height of the 6

7 20. Traffic Circulation System and connectivity with a view to ensuring adequate parking, conflict free movements, Energy efficient Public Transport. 21. Disaster/Risk Assessment and Management Plan building shall not exceed 80 m above ground level. Submitted Submitted The case was considered by the EAC in its 134 th meeting held on st May, 2014, wherein, the Committee recommended to defer the proposal and suggested the project proponent to submit the following: (i) Revised layout map with adequate green belt and peripheral road to enable movement of fire fighting vehicles for multi-storey apartments should be submitted. (ii) (iii) (iv) A minimum road width of 9 m shall be provided within the premises. Revised parking plan alongwith traffic circulation plan should be submitted. Detailed energy conservation plan should be submitted. The project proponent has not submitted the reply to the above observations of EAC, as yet. The case was considered by the SEAC in its 101 st meeting held on , which was attended by the following on behalf of the project proponent: (i) (ii) Sh. Ajay Sharma, Deputy Chief Engineer, of the promoter company. Sh. Sandeep Garg of M/s Eco Labs, Mohali, Environmental Consultant of the promoter company. Sh. Ajay Sharma, informed the Committee that 20% of the construction has already been carried out at the site. The SEAC observed that the case is required to be dealt as per the procedure mentioned in the Office Memorandum dated of the Ministry of Environment & Forests as amended on since the promoter company has violated the provisions of EIA notification dated by starting construction of the project without obtaining environmental clearance under the said notification. 7

8 After detailed deliberations, the SEAC decided as under: (i) (ii) To forward the case to SEIAA with the recommendation to ask the project proponent to submit a formal resolution passed by the Board of Directors of the Company or to the Managing Committee / CEO of the Society, Trust, partnership / individually owned concern, within 60 days, mentioning that violations will not be repeated in future and in the meantime, the project may be delisted. In the eventuality of not having any response from the project proponent within the prescribed limit of 60 days, the project file may be closed. To recommend to SEIAA for: initiating credible action against project proponent / responsible persons / promoter company under the Environment (Protection) Act, 1986 due to start of construction activities of the project without obtaining Environmental Clearance under EIA notification dated issuance of directions under Section 5 of the Environment (Protection) Act, 1986 to restrain the promoter company from carrying out any further construction activity of the project till the environmental clearance under EIA notification dated is obtained. (iii) To request the Punjab Pollution Control Board to verify the construction status of the project at site and send the detailed status report (with quantification) to SEAC within 15 days. The case was considered by the SEIAA in its 72 nd meeting held on , which was attended by Sh. Sandeep Garg of M/s Eco Labs, Mohali, Environmental Consultant of the promoter company. Sh. Sandeep Garg of M/s Eco Labs, Mohali, Environmental Consultant of the promoter company, informed the Authority that 20% of the construction has already been carried out at site. After detailed deliberations, the SEIAA decided as under: a) To ask the project proponent to submit, within 60 days, a formal resolution passed by the Board of Directors of the Company or to the 8

9 (b) (c) Managing Committee / CEO of the Society, Trust, partnership / individually owned concern, mentioning that violations in respect of starting construction activities without obtaining environmental clearance under EIA notification dated , are un-intentional and will not be repeated in future. In the meantime, the project be delisted. In case, the project proponent fails to submit the said resolution within a period of 60 days, it will be presumed that the project proponent is no longer interested in pursuing the project further and the project file will be closed and the project proponent will have to initiate the procedure de novo for obtaining environmental clearance. To initiate credible action against project proponent(s), responsible person(s) & promoter company by invoking powers u/s 19 of the Environment (Protection) Act, 1986 as delegated by Ministry of Environment & Forests vide notification No. S.O. 638 (E) dated due to start of construction activities of the project without obtaining Environmental Clearance under EIA notification dated Punjab Pollution Control Board be written in this regard for taking necessary legal action u/s 15 of the Environment (Protection) Act,1986 for the period for which the violation has taken place. To issue directions under section 5 of the Environment (Protection) Act, 1986 as delegated by Ministry of Environment & Forests vide notification No. S.O. 637 (E) dated to restrain the promoter company from carrying out any further construction or operation activity of the project till the environmental clearance under EIA notification dated is obtained. (d) To inform the project proponent that the application for environmental clearance under EIA Notification dated will be considered only after the compliance of decision (a) above and action is initiated for violating the provisions of the EIA notification dated due to start of construction work of the project without obtaining environmental clearance. Accordingly, the decision of the SEIAA was conveyed to the project proponent vide letter no dated The case was also sent to the Punjab Pollution Control Board for initiating action under Environment (Protection) Act, 1986 vide letter no dated Directions u/s 5 of the Environment (Protection) Act, 1986 were issued to the project proponent vide letter no dated Now, the Punjab Pollution Control Board vide letter no dated has informed that a complaint has been filed in the Hon'ble Court of 9

10 Judicial Magistrate, SAS Nagar against the project promoter and the persons responsible for violation of the provisions of the EIA notification dated The project proponent has also submitted a formal resolution passed by the Board of Directors of the Company or to the Managing Committee / CEO of the Society, Trust, partnership / individually owned concern, mentioning that violations in respect of starting construction activities without obtaining environmental clearance under EIA notification dated , are unintentional and will not be repeated in future. The case was considered by the SEAC in its 112 th meeting held on , which was attended by the following on behalf of the project proponent: (i) (ii) Sh. Ajay Sharma, Deputy Chief Engineer, of the promoter company. Sh. Sandeep Garg of M/s Eco Labs, Mohali, Environmental Consultant of the promoter company. Before allowing the project proponent to present the case, SEAC observed that the site of the proposed project is situated in the area development project namely Super Mega Projects being developed by M/s Janta Land Promoters Ltd., by whom the environmental clearance is yet to be obtained. Further, the project proponent is to use / share various resources such as water supply, sewerage, treatment of wastewater (STP) of the Super Mega Projects. After detailed deliberations, the SEAC decided to recommend to SEIAA that the application for obtaining environmental clearance for construction of Group Housing Pocket 2C-2, namely "Sky Gardens" Sector 66-A, Mohali by M/s Janta Land Promoters Ltd be kept pending till the Super Mega Projects obtains the environmental clearance for the area development project. The case was considered by the SEIAA in its 84 th meeting held on , however, no one from the project proponent attended the meeting. The SEIAA in-compliance to office memorandum dated of the MoEF decided to defer the case. The above noted decision of the SEIAA was conveyed to the project proponent vide letter no dated

11 The case was considered by the SEIAA in its 86 th meeting held on , which was attended by Sh. Ajay Sharma, Deputy Chief Engineer on behalf of the project proponent. After discussions, the SEIAA decided to remand the case to SEAC with a request to appraise the application after the environmental clearance is obtained by M/s Janta Land Promoters Ltd., for its area development project namely Super Mega Projects wherein the construction of a Group Housing Pocket 2C-2, namely "Sky Gardens" Sector 66-A, Mohali is coming up. Item No.86.04: Application for obtaining Environmental Clearance under EIA notification dated for Construction of a Mix land use Project namely ACME SQUARE ONE at Zirakpur, by M/s ACME Heights (P) Ltd. The SEIAA observed that: M/s Acme Heights (P) Ltd., T4, 3 rd floor, Centra Mall, Industrial Area, Phase I, Chandigarh has applied for obtaining the Environmental Clearance as required under the EIA notification dated for development of a Mix Land use Project namely ACME Square One at Zirakpur. The project is covered under category 8 (a) of the Schedule appended to the said notification. The case was considered by the SEAC in its 109 th meeting held on and was attended by the following: i. Sh. Rajni Mehra, Manager ii. Sh. Deepak Gupta of M/s Jalvayu Consultants, Environmental Consultant of the promoter company The SEAC observed that it is a fresh application and as per decision taken by the SEIAA & SEAC in its 8 th combined meeting held on that: As and when the application is received for obtaining environmental clearance, the Punjab Pollution Control Board be requested to visit the site of the project and verify its construction status before the case is placed before the SEAC. The letter to Punjab Pollution Control Board be written at the level of Secretariat staff of SEIAA. In case of non-receipt of report from Punjab Pollution Control Board within 15 days, the visit be got conducted by the Secretariat Staff/SEAC members to be decided by Member 11

12 Secretary (SEIAA) and case be placed before the SEAC in its next immediate meeting. Accordingly, the SEAC decided that the Punjab Pollution Control Board be asked to visit the project site and submit its report regarding latest construction status, within 15 days and defer the case, till the report is received. Punjab Pollution Control Board was requested vide letter no dated to visit the project site and submit its report regarding latest construction status, within 15 days Now, Regional Office Mohali of the Punjab Pollution Control Board vide its letter no dated has intimated that the site of the project was visited on 08/03/2015 and it was observed as under: 1. No construction activity of the main project has been started by the promoter company at the proposed site of the project. However, boundary wall on three sides of the project is already existing and a small post (without roof) of brick masonry material for security guard has already been constructed near the entry point to the project site. During visit photographs of the proposed project site were taken, which are attached herewith. The representative of the promoter company claimed that the back side boundary wall has been constructed by the management of the school. 2. Front side of the project is located on the Patiala-Zirakpur Road and on the back side there is a school namely Holy Family convent School. On one side there is a road leading to Village Nabha and the fourth side the project is abutting to the agricultural fields. The case was considered by the SEAC in its 112 th meeting held on , which was attended by the following on behalf of project proponent: i. Ms. Rajni Mehra, Operations Manager of promoter company ii. Sh. Deepak Gupta of M/s Jalvayu Consultants, Environmental Consultant of the promoter company Before allowing the project proponent to present his case, the SEAC observed that as per report submitted by PPCB, the project proponent has constructed boundary wall on three sides of the project and project proponent is 12

13 required to clarify as to whether boundary wall constructed is part of the project or not. To this observation of SEAC, the project proponent clarified that the boundary wall already constructed is not a part of the proposed project and has been constructed to secure the land only. The same will be demolished lateron. After this, the SEAC allowed the project proponent to present his case. Thereafter, Sh. Deepak Gupta Environmental Consultant of the promoter company presented the sailent feature of the project as under: The total project area is sqm having total built up area of sqm. The total cost of the project will be Rs.90 cores. Total water requirement for the project will be 203 KLD, out of which 160 KLD will be met from own tubewell and remaining 43 KLD will be met from treated wastewater. The total wastewater generation from the project will be 162 KLD, which will be treated in a STP to be installed within the project premises. The project proponent has proposed to use 43 KLD of treated wastewater for flushing purpose, 14 KLD for irrigation of green area and remaining 57 KLD will be used for construction /discharged into MC sewer in summer season. In winter season, 43 KLD of treated wastewater will be used for flushing purpose, 4 KLD will be used for irrigation of green area and remaining 115 KLD will be discharged into MC sewer. In rainy season, 43 KLD of treated wastewater will be used for flushing purpose and remaining 119 KLD will be discharged into MC sewer. The M.C. Zirakpur has issued a letter no. 102 dated wherein it has been mentioned that the project proponent has applied for the approval of layout plane and after the approval of project, submission of completion certificate after deposition of applicable connection charges and other requisite charges, the MC will have no objection for giving the sewerage connection from its main sewer of MC to the project site for discharge of its treated water. 13

14 The total quantity of solid waste to be generated from the proposed project has been estimated as 833 kg/day, which will be segregated into bio-degradable and non-biodegradable waste as per the MSW Rules, The bio-degradable waste will be sent to approved dumping site. The non-biodegradable and recyclable waste will be sold to the recyclers. The M.C. Zirakpur has issued a letter no. 121 dated wherein it has been mentioned that the project proponent has applied for approval of the layout plans and after the approval of project, submission of completion certificate, deposition of applicable connection charges and other requisite charges, the solid waste generated will be taken care by MC, Zirakpur. The e-waste will be handled and managed as per the E-waste (Management & Handling) Rules, The used oil from the D.G. sets will be sold out to the registered recyclers as per the provisions of the Hazardous Waste (Management, Handling & Transboundary Movement), Rules, The total load of electricity required for proposed project will be 4.3 MW (4300 KW) which will be supplied by PSPCL. The project proponent has proposed to install DG sets, for backup power supply. The ambient air monitoring has been got done from M/s EKO Pro Engineers Pvt. Ltd. and the analysis results indicate that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2 and CO have been measured. Also, ambient noise monitoring has been got done from the said firm and the analysis results indicate that the noise levels during day and night times, have been measured as 59.2 db(a) leq and 48.6 db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a) leq. Director of the company will be responsible for implementation of EMP till the handing over of the project. Thereafter, association of the residents or MC whosoever takes over the project will be responsible for implementation of EMP. During construction phase, 33.0 lacs will be incurred for implementation of EMP and Rs lacs/annum will be incurred on account of recurring charges. During operation phase, 75.0 lacs will be incurred for implementation of EMP and Rs

15 lacs/annum will be incurred on account of recurring charges. Cost of monitoring during construction phase will be Rs 5.90 lacs/annum and during operation phase, the cost of monitoring will 6.90 lacs/annum. Rs. 8 lacs will be utilized for following activities under Corporate Social Responsibility and the implementation of the CSR will be responsibility of Partner of the company: (i) The management will give preference in the job to people of nearby area (Vill. Taffazalpura and other surrounding villages). (ii) Educational programmes in the nearby villages Nabha. (iii) Blood donation camps and other health related camps will be organized in the 5 km area of the project. (iv) Widening of road in the vicinity of the project. (v) Toilets for girls in the nearest village school. Disaster/Risk Assessment and Management Plan and traffic circulation plan has also been prepared. After hearing the presentation, the SEAC observed that: 1. The proposed site is located along the National Highway and approach to the project site may involve forest land, as such, the project proponent is required to submit NOC/permission from the concerned District Forest Officer. 2. The NOC issued by M.C. for giving sewer connection from its main sewer to the project is not as per requirement of SEIAA/SEAC and the project proponent is required to submit a letter from M.C. giving complete details including quantity of sewage to be accepted for discharge into main sewer. 3. The project proponent is required to submit a written statement to the effect that the boundary wall already constructed at the site is not a part of the proposed project and has been constructed to secure the land only. The same will be demolished lateron. 4. The project proponent is required to submit detailed calculation sheet in support of his energy saving statement. 5. The project proponent is required to submit detailed solid waste management plan i.e. complete details including mechanism to be adopted for door to door collection, handling, segregation, transportation, on-site storage and vermi-composting (if any). 15

16 6. The project proponent is required to submit storm water management plan. The Committee observed that the project proponent has otherwise provided adequate and satisfactory clarifications of the observations raised by it. Therefore, the Committee awarded 'Silver Grading' to the project proposal and decided that as and when the project proponent submits the above noted documents/information and if the same are approved by the Chairman SEAC on the case file of the project, the case be forwarded to the SEIAA with the recommendation to grant environmental clearance to the project proponent for construction of a Mix Land Use Project namely ACME Square One in an area of sqm having total built up area of sqm at Zirakpur, District SAS Nagar, subject to the following conditions in addition to the proposed measures: PART A Specific conditions I. Pre-Construction Phase (i) (ii) (iii) (iv) (v) II. (i) Consent to establish shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase. A first aid room will be provided in the project both during construction and operation phase of the project. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project. Construction Phase: All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site. 16

17 (ii) (iii) (iv) (v) (vi) (vii) (viii) (ix) (x) (xi) (xii) (xiii) Disposal of muck during construction phase should not create any adverse effect on the neighbouring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the groundwater. Construction/provision of the STP, tubewell, DG Sets, Utilities etc, earmarked by the project proponent on the layout plan, should be made in the earmarked area only. In any case the position/location of these utilities should not be changed later-on Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 and notification No. S.O (E) dated (This condition is applicable only if the project is within 100 Km of Thermal Power Station). Ready mixed concrete should be used in building construction as far as possible. Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices. The project proponent shall adopt dual plumbing system for reuse of treated wastewater for flushing system & HVAC etc Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. (xiv) The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards. (xv) The project proponent will provide dual plumbing system for reuse of treated wastewater for flushing/ HVAC purposes etc. and colour coding of different pipe lines carrying water/wastewater/ treated wastewater as follows: 17

18 a. Fresh water: Blue b. Untreated wastewater: Black c. Treated wastewater: Green (for reuse) d. Treated wastewater: Yellow (for discharge) e. Storm water: Orange (xvi) The installation of sewage treatment plant (STP) and adequacy of disposal system should be certified by Punjab Pollution Control Board and a report in this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. III. Operation Phase i) Consent to operate shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority at the time of start of operation. ii) iii) The project proponent shall discharge not more than 57 KLD wastewater into sewer during summer season, 115 KLD wastewater into sewer during winter season and 119 KLD wastewater into sewer during rainy season. The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for reusing the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis. iv) The position / location of the STP, tubewell, DG Sets, Utilities etc, installed by the project proponent as per the provisions made in the layout plan, should not be changed later-on under any circumstances. v) Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the complex. vi) vii) viii) Adequate treatment facility for drinking water shall be provided, if required. The green belt along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/variety. The project proponent should take adequate and appropriate measures to contain the ambient air quality within the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forests/ State Level Environment Impact Assessment Authority within three months. 18

19 ix) Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating. x) A report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about machinery of air conditioning, lifts, lighting, building materials, R & U Factors etc. and submitted to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA in three months time. xi) xii) xiii) xiv) Environmental Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Separation of drinking water supply and treated sewage supply should be done by the use of different colors. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control. IV. Entire Life: i) Consent to operate shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and get it renewed from time to time and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority. ii) iii) iv) The project proponent shall discharge not more than 57 KLD wastewater into sewer during summer season, 115 KLD wastewater into sewer during winter season and 119 KLD wastewater into sewer during rainy season. The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for reusing the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis. The position / location of the STP, tubewell, DG Sets, Utilities etc, installed by the project proponent as per the provisions made in the layout plan, should not be changed later-on under any circumstances. v) Rainwater harvesting for roof run-off should be implemented. Before recharging the roof run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/green area/roads/pavements shall be connected with the ground water recharging system. 19

20 vi) vii) viii) ix) The solid waste generated should be properly collected and segregated. The recyclable solid waste shall be sold out to the authorized vendors and inert shall be sent to disposal facility. The Bio-degradable solid waste shall be adequately treated as per the scheme submitted by the project proponent. Prior approval of competent authority should be obtained, if required. Hazardous waste/e-waste should be disposed off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board. Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored. Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized. x) The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. PART B General Conditions : I. Pre-Construction Phase i) This environmental clearance will be valid for a period of five years from the date of its issue or till the completion of the project, whichever is earlier. ii) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit. iii) iv) All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, by project proponents from the competent authorities including Punjab Pollution Control Board and from other statutory bodies as applicable. The project proponent shall also obtain permission from the NBWL, if applicable. The project proponent should advertise in at least two local newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded environmental clearance and copies of clearance letters are available with the Punjab Pollution Control Board. The advertisement should be made within seven days from the day of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office, Ministry of Environment & Forests, Chandigarh and SEIAA, Punjab. v) These stipulations would be enforced among others under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environmental (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification,

21 vi) vii) viii) ix) The project proponent shall obtain permission from the CGWA for abstraction of groundwater & digging of borewell(s) and shall not abstract any groundwater without prior written permission of the CGWA, even if any borewell(s) exist at site The project proponent shall obtain CLU from the competent authority, if any authority insists. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the local NGO, if any, from whom suggestions / representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent. The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. x) Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, II. Construction Phase i) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit. ii) iii) iv) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB, the SPCB and SEIAA, Punjab. Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh and State Level Environment Impact Assessment Authority, Punjab. 21

22 v) In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by State Environment Impact Assessment Authority, Punjab. vi) vii) viii) Separate distribution pipelines be laid down for use of treated effluent / raw water for horticultural/gardening purposes with different colour coding. The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility and shall spend the amount as proposed or atleast minimum required to be spent under the provisions of the Companies Act 1956, whichever is higher. The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. ix) Separation of drinking water supply and treated sewage supply should be done by the use of dual plumbing line. x) Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, III. 23 criteria pollutant levels namely; PM 2.5, PM 10, SO 2, NO x, CO, Pb, Ozone (ambient air as well as stack emissions) shall be monitored and displayed at a convenient location near the main gate of the company in the public domain. v) The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility and shall spend the amount as proposed or atleast minimum required to be spent under the provisions of the Companies Act 1956, whichever is higher. xi) The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. xii) Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, IV Entire Life i) Environmental clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004 as may be applicable to this project and decisions of any Competent Court, to the extent applicable. ii) iii) iv) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.
