2 Inmind Healthcare Grup Asbests Plicy Page 1 f 6 1 Intrductin Asbests is a general name applied t a grup f related, naturally ccurring fibrus minerals, which have been cmmnly, used in a range f building and equipment materials. There are three main types: Chrystile white. Amsite brwn. Crcidlite blue. Asbests cntaining prducts have been widely used in buildings as cnstructin material, fireprfing, thermal insulatin, electrical installatin, heat resistant materials, ceramic flr tiles and Artex. The new use f material cntaining blue r brwn asbests was banned in The new use f material cntaining white asbests was banned in Althugh there is n safe frm f asbests, sme frms, which are tightly bnded such as asbests cement, are less likely t shed fibres and as such present lwer risks e.g. rf sheets and guttering. Expsure can cause three main types f serius health risk: Asbestsis chrnic bstructive lung disease. Lung cancer a fatal lung disease. Mesthelima a fatal cancer f the lining f the lung. The Cntrl f Asbests at Wrk Regulatins 2002 requires emplyers t prevent expsure f emplyees t asbests. Where this is nt reasnably practicable the law states that expsure shuld be cntrlled t the lwest level pssible. Sectin 4 f the Cntrl f Asbests at Wrk Regulatins 2002, which became enfrceable in May 2004, requires a duty t manage expsure t asbests. This requires the duty hlder t: Determine the lcatin and cnditin f materials likely t cntain asbests. Assume materials cntain asbests, unless yu have strng evidence t the cntrary. Make and keep an up t date recrd f the lcatin and cnditin f Asbests cntaining materials (ACMs). Assess the likelihd f risk t anyne being expsed t fibres frm these materials. Prepare a plan f hw the risks will be managed.

Prvide infrmatin n the lcatin and cnditin f AC materials t anyne wh is liable t wrk n r disturb them. Asbests is likely t be fund in a building if: It was built r refurbished between 1950 and 1980 and particularly: If it has a steel frame. It has bilers with thermal insulatin. The duty hlder is defined as anyne wh has respnsibility fr the maintenance and r repair f a nn-dmestic premises either thrugh a cntract, tenancy r because they wn the building. Regulatin 4 f the Cntrl f Asbests at Wrk Regulatins requires that, ccupiers r wners f premises infrm any persn liable t disturb asbests cntaining materials, including maintenance wrkers, abut the presence and cnditin f such materials. 2 Plicy and Prcedure 2.1 Asbests Register An up t date recrd f the lcatin and cnditin f all knwn asbests cntaining materials will be maintained. This will be kept in the frm f a drawing as well as a written recrd. The asbests register will identify all areas where asbests is lcated in detail in each facility, the extent f the asbests cntaining material, what cnditin it is in, what frm it is in and what it lks like. A management plan t maintain and survey asbests cntaining materials identified in facilities will be implemented thrugh a cmpetent asbests cntractr n a cntinuus basis. The asbests register will be made available t all parties where it is deemed such infrmatin wuld be required e.g. Cntractrs, Maintenance persnnel. In line with the Inmind Healthcare Grup asbests management plan an annual inspectin f all areas, cntaining asbests will be carried ut by a cmpetent asbests cntractr t ensure nging integrity f the management plan. Any changes t the previus inspectin will be ntified in writing t the Grup s Head Office in Henley, lcally at the facility and recrded n the asbests register. Risk assessments at site will then be altered in accrdance with the risks nw freseen.

4 Inmind Healthcare Grup Asbests Plicy Page 3 f 6 3 Care Facilities with Full Survey 3.1 Where N Asbests Is Fund Where n evidence f asbests is fund in a prperty nly the asbests survey will be kept at the individual prperty. This will als be reflected n the asbests register. Where there is n evidence f asbests, n ther actins are required. 3.2 Asbests Fund Where asbests is identified t be present in a facility a cpy f the asbests survey must be kept and maintained up t date at the individual prperty Where asbests is identified a written plan f maintenance and mnitring will be develped by the Inmind Healthcare Grup and made knwn t all interested parties. Fllwing each individual asbests survey, a suitable and sufficient risk assessment fr that individual prperty will be develped and dcumented taking int accunt the survey findings by the apprved asbests survey cntractr. Inmind Healthcare Grup will emply a cmpetent apprved cntractr fr all maintenance, repair r remval wrk where expsure t asbests fibres wuld be invlved. The apprved cmpetent cntractr will prvide all the required dcumentatin as utlined in the Cntrl f Asbests at Wrk Regulatin (2006) prir t all wrk carried ut and carry ut all wrk in accrdance with the Regulatins. Simple maintenance wrk in facilities can nly be carried ut by the facility maintenance persn in areas where asbests has been dcumented as nt present. All risk assessments fr the expsure t asbests fibres will be reviewed at least annually r befre if, any significant changes ccur. All individual risk assessments and survey infrmatin must be made available t all emplyees and thers wh are liable t remve, repair r disturb any asbests cntaining materials as part f their undertakings. 4 Hspital/Care Facilities Awaiting an Asbests Survey In any prperty, which has nt had an asbests survey it, will be assumed that any material ther than glass, slid wd drs, flrbards, bricks and stne cntains asbests. In all prperties where an asbests survey has nt been undertaken, a generic risk assessment fr the management f expse t asbests fibres will be dcumented utlining the cntrls in place t maintain the safety f emplyees and all thers wh may have access t the building until the survey has been carried ut. All maintenance wrk in prperties where asbests is assumed t be present will require all suspect areas t be sampled by an apprved cmpetent cntractr prir t any maintenance n thse areas. Simple maintenance wrk in facilities can nly be carried ut by the facility maintenance persn where asbests has been dcumented as nt present. All risk assessments fr the expsure t asbests fibres will be reviewed at least annually r befre if, any significant changes ccur.

An analysis f all asbests like material will be undertaken by a cmpetent apprved cntractr prir t any wrk which may expse r culd be liable t expse emplyees r thers t asbests fibres. Inmind Healthcare Grup will emply a cmpetent apprved cntractr fr all maintenance, repair r remval wrk where expsure t asbests fibres wuld be invlved. 5 Where Asbests Cntaining Materials Require Maintenance r Remval A risk assessment will be carried ut by an apprved cmpetent cntractr t determine the risks t thse peple using the building prir t any planned wrk t be carried ut which culd expse emplyees r service users t asbests fibres. Where any risk assessment fr planned wrk which may expse emplyees r service users t asbests fibres determines that the risk f expse t asbests fibres is likely, then a planned remval f such persns will be put int place prir t such wrk. The management team at the site will develp and maintain a planned evacuatin strategy shuld such an event be required, fr planned maintenance wrk in the facility where the expsure t asbests fibres wuld be deemed as likely. 6 Emergency Plan fr Asbests Release Where an unplanned release f asbests ccurs Inmind Healthcare Grup will mitigate the effects f expsure t asbests by fllwing a pre-planned management and evacuatin plan. The management team at each site will develp and maintain an evacuatin plan t be put int use in the event f an unexpected release f asbests fibres int the facility. All Inmind Healthcare emplyees shuld receive infrmatin in the frm f this plicy and a cpy f the HSE leaflet n asbests as evidence f prviding all emplyees with infrmatin abut the prcess and its management available at 7 Legislatin The Health & Safety at Wrk Act 1974 requires emplyers t prtect the Health and Safety f peple wh might be affected by wrk activities. The Health and Safety at Wrk Regulatins (1999) expand n these duties by requiring emplyees t risk assess the risks t the Health and Safety f emplyees and thers and take apprpriate measures t prevent r reduce thse risks. The Cntrl f Asbests at Wrk Regulatins (2002) requires emplyers t prevent expsure f emplyees t asbests. Where this is nt reasnably practicable the law requires that expsure shuld be cntrlled t the lwest pssible level. The Cntrl f Asbests at Wrk Regulatins (2002) requires that prir t any wrk being carried ut with asbests that a suitable and sufficient risk assessment must be carried ut t determine the likely expsure t asbests dust. The Cntrl f Asbests at Wrk Regulatins (2004) 4 requires a duty t manage asbests in nn-dmestic premises by making a suitable and sufficient assessment as t whether asbests is liable t be present in the premises and t maintain an up t date recrd f this assessment.

6 Inmind Healthcare Grup Asbests Plicy Page 5 f 6 In 2006, the Cntrl f Asbests at Wrk Regulatins (2002) (CAW), which gverns the way all wrk with asbests is dne t ensure it is dne safely. The Asbests (Licensing) Regulatins 1983 (ASLIC), as amended, which require wrk with all the mre hazardus asbests cntaining materials t be dne by a cntractr licensed by the HSE, and The Asbests (Prhibitins) Regulatins 1992 (Prhibitins Regulatins), as amended, which ban the imprtatin, supply and use f raw asbests and asbests cntaining materials which will be repealed and replaced with a single set f regulatins, The Cntrl f Asbests at Wrk Regulatins The Cnstructin (Design and Management) Regulatins 1994 (CDM) requires the client t prvide the planning supervisr with infrmatin abut relevant health and safety issues, in any prjects submitted, which include surveys f asbests n buildings. The Asbests (prhibitins) Regulatins 1992 (as amended) ban the imprtatin f prducts cntaining asbests. They als ban the secnd hand use f asbests building materials. The Health and Safety (safety signs and signals) Regulatins 1996 require that suitable warning signs are put in place if apprpriate preventative r prtective measures are nt pssible. 8 Dcumentatin Asbests lcatin register. Risk Assessments. Asbests maintenance and mnitring plan. Apprved Asbests cntractr cntract. Asbests evacuatin plan at each individual facility. Unplanned release f asbests management plan. Infrmatin leaflet fr all abut asbests. 9 Respnsibilities The service will s far as is reasnably practicable ensure that the health, safety and welfare at wrk f its emplyees and thers wh may wrk at their facilities are maintained with regard t expsure t asbests. The service shall ensure that knwn and identified lcatins f asbests are recrded n an asbests risk register and that this infrmatin is made available t thse persns wh require it. In additin, each site will ensure that this register is maintained cntinually reviewed and updated. The service has a respnsibility t develp a cntract and emply a cmpetent asbests cntractr in accrdance with The Cntrl f Asbests at Wrk Regulatins 2006 and the Health & Safety at Wrk Act A systematic prgramme f type 2 and where required type 3 surveys f all Inmind Healthcare Grup prperties will be undertaken by a cmpetent cntractr. Abatement wrk frm these surveys and planned annual re-inspectins will be carried ut by a cmpetent asbests cntractr nly.

7 Inmind Healthcare Grup Asbests Plicy Page 6 f 6 The Registered Manager will be respnsible fr ensuring that they maintain at their facility a cpy f any risk assessments r surveys with regard t expsure t asbests. The Registered Manager will ensure that all emplyees at their facility are made aware f this plicy and their respnsibilities t cmply. Emplyees have a respnsibility t c-perate with their emplyer by cmplying with cmpany plicies. 10 Equality Impact Assessment All relevant persns are required t cmply with this plicy and must demnstrate sensitivity and cmpetence in relatin t diversity in race, faith, age, gender, disability and sexual rientatin.
