The matters n respect of whch the Councl has reserved control are lsted wth each Controlled Actvty. Buldngs Buldngs n respect of landscapng, external appearance, and vsual mpact on the streetscape. Outdoor Storage Areas Outdoor storage areas located wthn any street scene setback n respect of landscapng, screenng, appearance and vsual mpact. Supermarket Retalng Supermarket retalng on Lots DP Dscretonary Actvtes The followng shall be Dscretonary Actvtes provded they are not lsted as a Prohbted or Non-Complyng Actvty and they comply wth all the relevant Zone Standards. Retal Sales Any goods dsplayed for sale and retalng undertaken from a ste contanng n excess of 500m² net floor area, except: Goods manufactured on ste, and ancllary products up to 20% of the gross floor area; or Goods stored permanently outdoors. Any Actvty whch s not lsted as a Non-Complyng or Prohbted Actvty and whch comples wth all the Zone Standards but does not comply wth one or more of the Ste Standards shall be a Dscretonary Actvty wth the exercse of the Councl s dscreton beng confned to the matter(s) specfed n the standard(s) not compled wth Non-Complyng Actvtes - 8

Retal Sales Any goods dsplayed for sale and retalng undertaken from a ste less than 500m² net floor area ncludng restaurants. v v Arports Arports other than the use of land and water for emergency landngs, rescues and fre fghtng or for actvtes ancllary to farmng actvtes. Any Actvty whch requres an Offensve Trade Lcence under the Health Act Resdental Flat Any Actvty whch s not lsted as a Prohbted Actvty and does not comply wth one or more of the Zone Standards..2.4 Non-Notfcaton of Applcatons An applcaton for a resource consent for the followng matters may be consdered wthout the need to obtan a wrtten approval of affected persons and need not be notfed n accordance wth Secton 93 of the Resource Management Act 1991, unless the Councl consders specal crcumstances exst n relaton to any such applcaton. Applcatons for the exercse of the Councl s dscreton n respect of the followng Ste Standards: Vsual Amenty Buldng Heght where the ste does not adjon a Hgh Densty Resdental, Low Densty Resdental, Townshp, Rural Lfestyle or Rural-Resdental Zone..2.5 Standards - All Actvtes Ste Standards v v v Resdental Accommodaton One resdental unt per ste for the purpose of on-ste custodal management. Street Scene The mnmum buldng setback from road boundares shall be: Anderson Road - 6m Gorge Road - 6m Bowen Street, Sawmll Road, Hallensten Street - 4m Plantaton Road - 8m All Other Roads - 2m Buldng Coverage Maxmum ste coverage - 75% Setback from Internal Boundares The mnmum buldng setback from a Resdental Low Densty, Resdental Hgh Densty, Townshp, Rural Lfestyle or Rural-Resdental Zone boundary shall be 4.5m. Vsual Amenty Storage of Waste No outdoor waste storage area shall be located n any street scene setback area. Any outdoor type area shall be sted behnd any street scene setback and screened from road frontages by ether a sold fence of at least 2m mnmum heght, or dense plantng of the same heght. Resdental Zone Boundary Fencng A sold fence of at least 1.8m heght shall be erected on the boundary of any resdental zone. Buldng Heght Maxmum buldng heght - 7m. - 9

3 v Deleted Zone Standards Buldng Lne Restrcton Where a buldng lne restrcton s shown on Dstrct Plan Maps, no buldng shall be located wthn the restrcted area as dentfed on Dstrct Plan Maps. Nose Sound from non-resdental actvtes measured n accordance wth NZS 6801:2008 and assessed n accordance wth NZS 6802:2008 shall not exceed the followng nose lmts at any pont wthn any ste outsde ths zone: Exteror lghtng nstalled on stes or buldngs shall be drected away from adjacent stes, roads and publc places. Roofs of buldngs shall be fnshed to avod glare when vewed from any publc place. No actvty shall result n a greater than 10 lux spll, horzontal or vertcal, of lght onto any adjonng property wthn the zone, measured 2m nsde the boundary of any adjonng property. No actvty shall result n a greater than 3 lux spll, horzontal or vertcal, of lght onto any adjonng zone, measured at any pont more than 2m nsde the boundary of the adjonng property. Sound from these sources shall be assessed n accordance and comply wth the relevant New Zealand Standard, ether NZS 6805:1992, or NZS 6808:1998. For the avodance of doubt the reference to arports n ths clause does not nclude helpads other than helpads located wthn any land desgnated for Aerodrome Purposes n ths Plan..2.6 Resource Consents - Assessment Matters The Assessment Matters, whch apply to the consderaton of resource consent n the Busness Zone, are specfed n Rule.4..3 Industral Zone Rules.3.1 Zone Purpose The purpose of the zone s to provde for the contnued vablty of ndustral actvtes and the servces they provde for the socal and economc well beng of the communty..3.2 Dstrct Rules Attenton s drawn to the followng Dstrct Wde Rules, whch may apply n addton to any relevant Zone Rules. Any outdoor storage area shall be sted behnd any setback and be screened by ether a sold fence of at least 2m heght or dense plantng of the same heght. Resdental Zone Boundary Fencng A sold fence of at least 2m heght shall be erected on the boundary. Buldng Heght Maxmum buldng heght - 6m. - 12

7 .4.1 General () () The followng Assessment Matters are other methods or matters ncluded n the Dstrct Plan, n order to enable the Councl to mplement the Plan s polces and fulfl ts functons and dutes under the Act. In consderng resource consents for land use actvtes, n addton to the applcable provsons of the Act, the Councl shall apply the relevant Assessment Matters set out n Clause.4.2 below. () In the case of Controlled and Dscretonary Actvtes, where the exercse of the Councl s dscreton s restrcted to the matter(s) specfed n a partcular standard(s) only, the assessment matters taken nto account shall only be those relevant to that/these standard(s). (v) In the case of Controlled Actvtes, the assessment matters shall only apply n respect to condtons that may be mposed on a consent. The external appearance, heght and locaton, to avod or mtgate adverse effects on: street scene; adjonng or surroundng buldngs; prvacy of adjonng resdental propertes. Any relevant factors n respect to the undesrablty of stng offces or showrooms away from the front of buldngs or facng the road. The relatve mportance of landscapng on the partcular ste concerned, takng account of the nature of plantng or materals to be used, the locaton of parkng manoeuvrng or storage areas, and the vsual qualty of the surroundng envronment, partcularly where a low standard of vsual qualty exsts and mprovement s necessary. (v) Where an actvty s a Dscretonary Actvty because t does not comply wth one or more relevant Ste Standards, but s also specfed as a Controlled Actvty n respect of other matter(s), the Councl shall also apply the relevant assessment matters for the Controlled Actvty when consderng the mposton of condtons on any consent to the dscretonary actvty..4.2 Assessment Matters In consderng whether or not to grant consent or mpose condtons, the Councl shall have regard to, but not be lmted by, the followng assessment matters: Controlled Actvty - Buldngs Condtons may be mposed n respect of: The nature of the busness actvty, and any partcular adverse vsual mpacts. (e) (f) The extent to whch developments detract from the vsual approach to Queenstown, Arrowtown, Frankton and Wanaka. The extent to whch the development s vsble from adjonng stes, partcularly those n resdental zones. Controlled Actvty - Outdoor Storage Areas Condtons may be mposed n respect of: The nature of the busness actvty tself, and any partcular adverse vsual mpacts. The type and volume of materals to be stored on the frontage of the ste. The relatve mportance of landscapng on the partcular ste concerned, takng account of the nature of plantng or materals to be used, the locaton of parkng manoeuvrng or storage areas, and the vsual qualty of the surroundng envronment, partcularly - 14

8 where a low standard of vsual qualty exsts and mprovement s necessary. The extent to whch developments detract from the vsual approach to Queenstown, Arrowtown, Frankton and Wanaka. v Open Space The ablty to mtgate the effects of ncreased coverage by addtonal landscapng and screenng n respect of the mpact of ncreased coverage on neghbours. (e) The extent to whch the ste s vsble for adjonng stes, partcularly those n resdental zones. The ablty to satsfy the requrements n respect of parkng, manoeuvrng and access. Retal Sales - Dscretonary and Non-Complyng Actvty v Setback from Roads and Internal Boundares The lkely mpact of addtonal retalng on town centres and amenty thereof. The lkely effect of addtonal retalng on pedestran actvty, traffc congeston, access, road network and amentes of adjonng actvtes and propertes. The extent to whch a lmted buldng setback from a road or neghbours s necessary n order to allow more effcent or practcal use of the remander of the ste. The extent to whch alternatve practcal locatons are avalable for the buldng or structure. v v Resdental Accommodaton Street Scene The ablty of exstng or future busness and servce actvtes to operate wthout constrant as a result of resdental actvty. The ablty of offce, showroom, and landscapng to mtgate adverse vsual effects. (e) The degree to whch the proposed buldng enhances the vsual amenty of the ste as vewed from the road and adjonng stes. The degree to whch the proposed buldng wll detract from the outlook and prvacy of people on adjonng stes. The degree to whch proposed landscapng, ncludng plantngs, wll mtgate the effects of lmted buldng setback from a road or neghbours. The effect on the overall appearance of the street scene, havng regard to exstng landscapng, road wdths, and the general amenty. The effect on any adjonng or adjacent resdental or open space areas. (f) (g) The extent to whch the proposed buldng, wll be compatble wth the appearance, layout and scale of other buldngs and stes n the surroundng area, ncludng the setback of exstng buldngs n the vcnty from road boundares. The extent to whch the proposed buldng wll have a sze, form, and external appearance whch s sympathetc to, and n vsual harmony wth the surroundng envronment. - 15

9 (h) The extent to whch the use of the proposed buldng wll detract from the pleasantness or amenty of adjonng stes, n terms of nose, smell, dust, glare or vbraton. Any relevant factors n respect to the undesrablty of storage n a non-complyng poston. v Heght of Buldngs (e) (f) (g) Whether any earthworks have been carred out on the ste, pror to the date of notfcaton, 10 October 1995, that have lowered the ground level. The extent to whch the heght of the buldng would mpact on the street scene, ncludng havng regard to the matters specfed n Assessment Matter (). The degree to whch the ncreased buldng heght wll adversely affect vews from propertes n the vcnty, or from roads or publc open space n the surroundng area. The extent to whch the buldng wll have an adverse effect on other stes n the surroundng area. Conversely, offces, resdental and almost all retal uses are avoded n the zone n order to ensure that t does not become a mxed use zone where reverse senstvty ssues and land values make ndustral and some busness uses unvable wthn the zone..5.2 Dstrct Rules x Vsual Amenty The nature of the use of the ste. Open space areas and pedestran and cycle lnks () Whether the road layout s effcent, legble, and pedestran-frendly. The Councl expects roadng layouts and herarches (rangng from collector roads to servce lanes) to be easy to navgate. The Councl expects roadng cross sectons to be provded, whch llustrate the wdth, character, landscapng, antcpated speed envronment. (e) (f) Earthworks, Landscapng and streetscape desgn Any proposed desgn gudelnes. Intatves whch help reduce prvate car use and encourage alternatve modes of transport (.e. Travel Demand Management). To acheve ths the Councl expects ether a combnaton of naturalstc moundng of 3-5 metres n heght and 15-20m n wdth, and predomnantly evergreen plantng of around 5-6 metres n heght or, n the absence of any moundng, a 30 metre strp of dense predomnantly evergreen plantng of at least 8 metres n heght s requred n order to provde effectve mtgaton. Note: Any change to the landscape plan wll requre a Varaton to the Outlne Development Plan. - 30

24 () Whether adequate space has been provded n the road reserve for a bus stop to be located every 400 m along any bus route that has been dentfed by the Councl. Regardng the management of stormwater, the ODP s expected to dentfy stormwater collecton and retculaton methods and the area(s) that wll be developed as stormwater treatment and dsposal facltes, whch wll be capable of: Fg 1: 15-20m buffer wth 3-5m mound and dense plantng to 5 or 6m. The Integrated Transport Assessment should cover all those matters lsted n the Councl s gude on the subject. Refer to Councl gudelnes relatng to ITA. Note: Any ODP applcaton whch wll enable over 5,000m² GFA of ndustral or servce space or over 10,000m² GFA of warehousng or storage space to be developed, shall nclude an Integrated Transport Assessment (ITA).
