8 RE policy and regulatory framework - recent reforms In 2010 FBiH Government has identified Draft law on renewable energy and cogeneration that promotes production from RES providing incentives for producers of renewable energy In 2010 Federation of BiH Government also adopted Regulation on use of renewable energy and cogeneration in FBiH. It defines: obligation of repurchase of electricity, priority of delivery to the network guaranteed prices Guaranteed price depends on reference price and the tariff coefficient Operator for RES and Cogeneration that will be established according to the Regulation will determine reference price for next years

10 RE policy and regulatory framework - recent reforms In 2011 RS Government made Decree on generation and consumption of electricity from RES. It defined following: collective objective on a share of energy consumption from renewable sources in the gross final energy consumption in RS objective on share of consumption of electricity generated from efficient co-generation facilities in the gross final consumption of electricity in Republic of Srpska objectives for stimulated generation of electricity from RES and co-generation facilities. Decree limits total capacities and amounts of electricity, being stimulated for each year in the period Decree Proposal has been forwarded to the Government for adoption.

11 RE policy and regulatory framework - recent reforms In 2011 Regulatory Commission for Energy of Republic of Srpska (RERS) made Draft Rulebook on issuance of certificates. It provides procedure for issuance, extension, transfer, cancellation and revocation of certificates for generation facility which uses RES and co-generation facilities. In 2011 RERS also made: Draft Rule book on incentives for generation of electricity from RES and in efficient co-generation, Draft Decision on the amount of the feed-in prices and premium Draft Decision on the amount of the fee

12 Indicative Development Plan for the production Each year ISO make Indicative Development Plan for the production (IDPP) for 10 years period The main goal is to provide the information on the announced projects to build new generating capacity that will be connected to the transmission network The great interest of investors to build production capacity based on renewable energy, primarily wind power. In the Indicative Development Plan for the production following No. of new generation are registered: 9 TPP - two of them on natural gas 47 HPP 43 WPP 1 Power plant on biogas

14 EE policy and regulatory framework - recent reforms Development of the Energy Efficiency Laws at the entity level are underway Energy Efficiency Road Map for transposition of Energy Efficiency Directives under the Energy Community Treaty are already prepared Development of Energy Efficiency Action Plans are underway Action Plans are intended to set energy savings targets (of 9% or higher) to be achieved and measured in 2018, and an intermediate indicative savings target to be achieved in 2012, as well as to propose concrete measures and actions that would contribute to meeting those targets

15 EE and RE project in BiH International Donors how an increasing interest in providing assistance to BiH in the field of EE and RE There is an increasing number of proposals for the development of EE and RE projects. Some of them are listed below: UNECE EE 21 Financing EE investments for climate change mitigation EU IPA 2007 Support to BiH to meet the requirements of the EnC with specific reference to EE and RE USAID 3E (Economy of Energy Efficiency) GIZ ORF-E and GIZ bilateral project EE Consultancy Norway: Energy Saving International AS (ENSI) UNDP Energy Efficiency Project ( ) USAID and Greek Government Synenergy Project EBRD Western Balkans SE Direct Financing Facility

16 EE and RE project in BiH The main outcomes of EE and RE project in BiH are to: Promote reform processes and the development of institutional capacities on energy efficiency and renewable energy Increase public and private sector capacity to implement EE and RE projects Improve energy efficiency at local level and to strength capacities to manage EE pilot projects To increase understanding of energy stakeholders about EE and RE in BiH Support development of EE and RE initiatives and technologies Strength public awareness on energy efficiency and renewable energy in BiH

17 Investments framework in BiH Foreign Investment Legislation in BiH is based on the State Law on Policy of Foreign Direct Investment in BiH According to this Law and related Entity Laws, foreign investors are entitled to invest capital and to reinvest profits ofsuch investments into any sectors of the BiH economy, without any limitation and under the same conditions and will have the same rights, obligations and benefits as defined for investors - residents of BiH The RS Government has successfully completed the project called "Guillotine of regulations" and by it committed itself for the introduction of modern European practice in the legal system of the RS in order to ensure that the new legislative framework serves the interests of RS citizens, entrepreneurs and investors In FBiH adoption of Instructions for investors are underway

18 Conclusions There is a huge EE and RE potential in BiH and investors shown great interest to invest in BiH EE and RE policy and regulatory framework are in process of development in BiH, but through various ongoing EE and RE project international donors are providing assistance to BiH in further and faster development of EE and RE These projects are of great significance for BiH and they are very welcomed
