1 PUBLC NOTCE CHARLESTON DSTRCT, CORPS OF ENGNEERS 69A Hagood Avenue Charleston, South Carolina REGULA TORY DVSON Refer to PN #SAC G 12 MARCH 213 Pursuant to Section 1 of the R1vers and Harbors Act of 1899 (33 U S.C. 43} and the South Carolina Coastal Zone Management Act { etseq.) an application has been submitted to the Department of the Army and the S.C Department of Health and Environmental Control by C/ MR. RAY PANTLK 14 NORTH ADGERS WHARF CHARLESTON, SOUTH CAROLNA 2941 for a permtt to construct a jotnt use fixed pter and float1ng dock in AN UNNAMED TRBUTARY OF THE KAWAH RVER at a location, Lots 62 and 64, LeMoyne Lane, in the Cassique neighborhood, Kiawah sland, Charleston County, South Carolina (l atitude Longitude ) n order to give all interested parties an opportunity to express the1r views NOTCE 1s hereby g1ven that written statements regarding the proposed work will be received by the Corps until 15 Days from the Date of this Notice, from those nterested in the act1v1ty and whose tnterests may be affected by the proposed work. The proposed work consists of constructron of a 1 ' x 1 ' prerhead attached to high land by a 4' 8"x 236.5' walkway A 1' x 16' floating dock will be installed on the downstream side of the pierhead and attached to the pierhead by a 3' x 2' ramp n addrtion, a 1 ' x 16' floatrng dock will be installed on the upstream side of the pierhead and attached to the pierhead by a 3' x 2' ramp The purpose of the proposed work 1s for the JOint private recreational use of the future owners of lots 62 and 64 NOTE: The SCDHEC OCRM has published a separate public notice for the proposed work. n addition, plans depicting the work described in this notice are available and will be provided, upon receipt of a written request, to anyone that is interested in obtaining a copy of the plans for the specific project The request must identify the proje ct of interest by public notice number and a self-addressed stamped envelope must also be provided for mailing the drawings to you. The Distnct Eng1neer will not process this application to a conclusion until such certifications are received. The applicant S hereby advised that supplemental information may be required by the State to facilitate the review This notice 11tiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act mplementation of the proposed project would have minimal1mpact on estuanne substrates and emergent wetlands utilized by various life stages of species compns1ng the red drum. shnmp, and snapper-grouper management complexes Our tnitial determtnat1on 1s that the proposed act1on would not have a substantial individual or cumulative adverse impact on EFH or fishenes managed by the South Atlantic Fishery Management Council and the National Marine Fishenes Service (NMFS). Our final determination relative to project impacts and the need for mitigation measures is subject to review by and coordination with the NMFS. The District Engineer has consulted the most recently available tnformation and has determtned that the project will have no effect on any federally endangered, threatened, or proposed species and will not result in the destruction or adverse mod1ficat1on of designated or proposed critical hab1tat. Th1s public not1ce serves as a request to the U S Fish and W1ldltfe Serv1ce and the Nat1onal Marine Fisheries Serv1ce for any additional tnformat1on they may have on whether any listed or proposed endangered or threatened spec1es or des1gnated or proposed critical habitat may be present tn the area which would be affected by the activity, pursuant to Sect1on 7(c) of the Endangered Species Act of 1973 (as amended). Pursuant to Section 16 of the Nat1onal H1storic Preservation Act (NHPA), this public notice also constitutes a request to lnd1an Tribes to notify the District Engineer of any historic properties of rellg1ous and cultural s1gn1f1cance to them that may be affected by the proposed undertaking. n accordance w1th the NHPA, the Distnct Eng1neer has also consulted the latest published vers1on of the National Register of H1stonc Places for the presence or absence of reg1stered properties, or properties listed as being eligible for inclusion therein, and this works1te is not ncluded as a registered property or property listed as being eligible for inclusion in the Register To insure that other cultural resources that the District Engineer is not aware of are not overlooked, this public notice also serves as a request to the State H1stonc Preservation Office to provide any tnformation it may have with regard to historic and cultural resources. Any person may request. in writing within the comment period spec1fied 1n th1s not1ce that a public heanng be held to consider this appllcatton Requests for a public hearing shall state with particularity, the reasons for holding a pubhc hearing The decision whether to issue a permit will be based on an evaluation of the probable impact includ1ng cumulative impacts of the activity on the public interest. That decision will reflect the nat1onal concem for both protection and utilization of important resources The benefit wh1ch reasonably may be expected to accrue from the project must be balanced aga1nst its reasonably foreseeable detriments All factors which may be relevant to the project will be considered ncluding the cumulat1ve effects thereof; among those are conservation econom1cs. aesthetics general environmental concems, wetlands h1stonc properties. fish and w1ldhfe values. flood hazards flood pla1n values land use. navigation shoreline erosion and accret1on recreatton water supply and conservation water quality, energy needs, safety. food and fiber production and. in general, the needs and welfare of the people A permit will be granted unless the D1stnct Engineer determines that it would be contrary to the public tnterest. n cases of conflicting property rights, the Corps of Engineers cannot undertake to adjudicate rival claims

To make this decision, comments are used to assess impacts on endangered spec1es, histone properties. water quality, general environmental effects, and the other public interest factors listed above.
