A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2011/10/04, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2011/10/04, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Compared to Standards Specified in a Risk Assessment. As of 2011/10/04, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. 47 Phase Two ESA Conceptual Site Model February 27, Islington Avenue, Toronto, Ontario File No INTRODUCTION The following document presents the Phase Two Conceptual Site Model for the Property located at 1048 Islington Avenue, Toronto (formerly Etobicoke). The Property located at 1048 Islington Avenue, covers an area of approximately 0.3 ha. The Phase Two Property is a commercial property currently occupied by Canada Trust branch (TD Bank). The site location and survey plans are presented in Figure 1 and 2. The Phase Two Conceptual Site Model is part of the report titled Phase Two Environmental Site Assessment, 1048 Islington Avenue, Toronto, October 11, 2011 prepared by Terraprobe Inc. 1.1 Property Description The Phase Two Property is currently legally part of a larger property that includes the adjoining western property with the municipal address of 1040 Islington Avenue, Toronto. According to the owner of the Property an application has been submitted to the City of Toronto with a severance survey for the Property that relates to TD Canada Trust branch (1048 Islington Avenue). The severance survey was completed in July 2011 by Schaffer Dzaldov Bennett Ltd. to submit with the application for severance. The application has been submitted but not severed yet. The Phase Two Property is located southwest of the intersection of Islington Avenue and Norseman Street in the City of Toronto. The property is roughly rectangular in shape, that covers an area of 3,028.8 square metres with a frontage of approximately 46.5 metre along Norseman Street and 67.0 metres along Islington Avenue. The Phase Two Property has a one-storey building present. The majority of the property around the building is currently in use as an asphalt-paved surface parking lot. The Phase Two Property is located in a mixed commercial, industrial and residential area of the city of Toronto. The adjoining and surrounding properties consisted of commercial buildings along Norseman Street to the north, residential houses along Islington Avenue to the east, commercial buildings along Islington Avenue to the south, and industrial/commercial properties along Norseman Street to the west. 48 Phase Two ESA Conceptual Site Model February 27, Islington Avenue, Toronto, Ontario File No INFORMATION FROM THE PHASE ONE ENVIRONMENTAL SITE ASSESSMENT 2.1 Areas Where Potentially Contaminating Activity has occurred Potentially contaminating activity had been identified in the Phase One ESA for the site conducted in The Phase Two Property was developed in The potentially contaminating activity had historically occurred on the property. #8-Chemical Manufacturing, Processing and Bulk Storage Contaminants of concern associated with the potentially contaminating activities include: Petroleum Hydrocarbons Metals VOCs PAHs PCBs The Phase Two Property was part of a larger property with municipal address 1040 Islington Avenue Islington Avenue was historically used as industrial facility by Sunbeam, an equipment manufacturing company. The Phase Two Property is located at northwest corner of 1040 Islington Avenue. A subsurface ground water investigation was conducted by Terraprobe for this property. The findings of the ground water investigation was documented in a letter report entitled Summary of Ground Water Sampling and analysis, 1040 Islington Avenue, Toronto, Ontario, dated May 30, According to this investigation, nineteen monitoring wells were installed on this property. One groundwater sample from each monitoring well was submitted for chemical analysis of Metals and Inorganics, Petroleum Hydrocarbons (PHC), Volatile organic compounds (VOCs) and Polychlorinated Biphenyls (PCBs). Exceedances of the MOE Table 3 Standard (Non-Potable Ground Water Standards were measured for VOC parameters. No exceedances from the MOE Table 3 Standards were observed for other analysed parameters. The ground water sampling was conducted on April 29, 2011 (prior conducting a Phase Two ESA for the Phase Two property). The subsurface soil and ground water investigation on RSC property included drilling six (6) boreholes and installing a monitoring well in each borehole location on July 17 to 19, During the conducting subsurface investigation for the Phase Two property, Terraprobe was aware of ground water impact with only VOCs on the adjoining western property. In addition, a subsurface investigation was conducted by Terraprobe for the adjoining western property (1040 Islington Avenue) Terraprobe PhaseTwoCSM Page No 2

49 Phase Two ESA Conceptual Site Model February 27, Islington Avenue, Toronto, Ontario File No and the findings of the subsurface soil and ground water investigation was documented in a report entitled Phase Two Environmental Site Assessment, 1040 Islington Avenue, Toronto, Ontario, Dated December According to this report, the subsurface investigation involved advancing thirty seven (37) boreholes to between 3.1 and 8.5 m below ground surface, and completing all the boreholes with monitoring wells. VOCs exceedances were observed on this property only for ground water. Based on the historical use of the property for industrial purposes and subsurface investigation conducted on the larger parcel (1040 Islington Avenue), media potentially impacted included both soil and ground water as follows: Soil Ground water Metal and Inorganics - VOCs VOCs PHCs - PAHs - PCBs - Based on previous investigation the ground water was impacted with VOCs only. 2.2 Areas of Potential Environmental Concern The area of potential environmental concern resulting from the historic potentially contaminating activity was the entire Property. 2.3 Subsurface Structures and Utilities The inspection of the property indicated the following information related to utility services: Underground hydro is interpreted at the Property and in the surrounding area. Overhead hydro lines were observed along Islington Avenue and Norseman Street. No overhead hydro lines are observed on the Property. Natural gas meters were observed at the northwest corner of the building. A phone/cable box was observed on the lawn at the northeast of the property. The underground feed to the building was interpreted to be along the east side of Property. Catch basins were observed in the parking area on the west, south and east sides of the Property and on the lawn at the north of the Property. These indicate the presence of a municipal storm drain. A manhole was located in the grassed area at the south portion of the Property. This is an indication that the Property is connected to the municipal sanitary sewage system. 50 Phase Two ESA Conceptual Site Model February 27, Islington Avenue, Toronto, Ontario File No PHYSICAL SETTING OF THE PHASE TWO PROPERTY 3.1 Site Stratigraphy The Phase Two ESA included drilling of six boreholes to depths ranging from 3.3 to 6.4 metres below ground surface to investigate the soil condition. Information regarding the borehole location is shown on Figure 3. The Stratigraphy that was present on the site during the 2011 investigation is shown on Figure 5 and is described below. The investigation examined the stratigraphy between the ground surface at masl (surface elevation) and terminated at 107.2masl. Surficial Material During the Phase Two investigation the land was covered by a building and asphalt surface. Earth Fill Fill material extending to a maximum depth of 1.5 metres below ground surface was observed in the location of monitoring wells TRP , TRP and TRP A shallow surficial zone of fill material (0.8 m to 1.1 m) was encountered in other borehole locations. The fill material encountered in the boreholes was generally sand to silty sand and gravel. No hydrocarbon odours or staining were noted from the fill material. The fill material was underlain by a native soil deposit. Native Soil All boreholes penetrated into undisturbed native soil deposit. The native soil consisted of silt to sandy silt or silty sand to sand in all locations. Silty clay was observed at the location of borehole TRP103. The soil is considered to be coarse grained. Native soil was encountered at minimum 0.8 m blew ground surface (mbgs) and extended to maximum depth of 6.5 mbgs at the location of TRP 103. No hydrocarbon odours or staining were noted in the native soils. Bedrock Bedrock was not encountered at the borehole locations. 3.2 Site Hydrogeological Characteristics Based on the topographic information from the 1982 Ontario Base Map, the ground surface is at approximately 115 m geodetic elevation. Regionally, the ground surface slopes down to the south, toward Lake Ontario. The nearest significant natural surface water feature is Mimico Creek, which is situated approximately 1 km to the east of the property. Terraprobe Page No PhaseTwoCSM

According to Freeze and cherry (1979) and the Ministry of the Environment (1997), the typical hydraulic conductivity of the strata investigated are: Earth Fill (silty sand) 10-5 m/s to 10-7 m/s Native Soil (silty sand) 10-5 m/s to 10-7 m/s, (sandy) 10-3 m/s to 1 m/s, (silt) 10-5 m/s to 10-1 m/s Georgian Bay formation 10-4 m/s to 10-8 m/s The horizontal hydraulic gradient of the ground water for the Phase Two property was determined to be approximately Approximate Depth to Bedrock The bedrock was not encountered during the investigation. Based on subsurface investigation of adjoining western property (1040 Islington Avenue) the depth to bedrock is approximately 6 to 8 m. 3.4 Approximate Depth to Water Table The approximate elevation of the ground water table ranges from to mbgs.
