2 PRECAUTIONARY STATEMENTS HAZARDS TO HUMANS AND DOMESTIC ANIMALS CAUTION Harmful if swallowed. Causes moderate eye irritation. Wash thoroughly with soap and water after handling and before eating, drinking, chewing gum, or using tobacco. Avoid contact with eyes or clothing. Wear protective eyewear. ENVIRONMENTAL HAZARDS Do not apply to water except as specified on the label. Do not contaminate water outside the intended treatment area by disposal of equipment washwaters. Do not apply in tidewater/brackish water. Lowest rates should be used in shallow areas where the water depth is considerably less than the average depth of the entire treatment site, for example, shallow shoreline areas. Trees and shrubs growing in water treated with Alligare Fluridone Granule may occasionally develop chlorosis. Follow use directions carefully so as to minimize adverse effects on non-target organisms. DIRECTIONS FOR USE It is a violation of Federal law to use this product in a manner inconsistent with its labeling. Read all Directions for Use carefully before applying. PRODUCT INFORMATION Alligare Fluridone Granule is a selective systemic aquatic herbicide in pellet form for managing aquatic vegetation in fresh water ponds, lakes, rivers, drainage or irrigation canals and reservoirs. Alligare Fluridone Granule contains 5% fluridone. This product is absorbed by plant shoots through water and through the roots of aquatic vascular plants via hydrosoil and operates by inhibiting susceptible plants from forming carotene causing chlorophyll to degrade quickly in sunlight. Susceptibility may be affected by factors such as stage of growth, water movement and the season. Symptoms of treatment include white (chlorotic) or pink growing points appearing 7-10 days following application. Management of aquatic weeds will take between days following treatment in optimum conditions. This product is most effective when applied before weed growth begins or when weeds start active growth. Mature weeds may take longer to control and may require application rates at the higher end of the specified range. Dilution of this product (caused by rapid water movement for example) will reduce effectiveness. The ELISA Test (Enzyme-Linked Immunoassay), also known as AquaScout, is recommended for calculating the required active ingredient (fluridone) concentration in treated water. While AquaScout is one recommended method, other proven methods of chemical analyses may also be used. For more information contact Alligare, LLC. The application rates provided below are expressed in pounds of Alligare Fluridone Granule in order to achieve the specified concentration of active ingredient, expressed in parts per billion (ppb). The maximum application rate or sum of all application rates per annual growth cycle is 90 ppb ǂ in ponds and 150 ppb ǂ in lakes and reservoirs: ǂ This is calculated by using the actual application rate not by using the residue levels found by testing the treated water. PRECAUTION Before applications of this product are made to public waters, applicators must consult with relevant authorities as posting treatment notifications may be required and/or obtaining other permits/licenses may be necessary prior to treatment. 2

3 USE RESTRICTIONS Do NOT apply this product to waters less than 2 feet in depth in New York State. Do NOT apply this product to water used for hydroponic farming. Do NOT use water treated with this product for irrigation in greenhouses or for nursery plants UNLESS an AquaScout assay is carried out beforehand and shows that residues are less than 1 ppb. Potable Water Intakes A concentration of up to 150 ppb of the active ingredient in Alligare Fluridone Granule (fluridone) is allowed in potable water sources, but: for lakes and reservoirs/other sources of potable water, applicators MUST NOT apply Alligare Fluridone Granule at a rate greater than 20 ppb within 0.25 miles of any functioning potable water intake*. This product may be applied at a rate of 8-20 ppb within 0.25 miles of any functioning potable water intake*. * former potable water intakes which are no longer used are not considered functioning potable water intakes for these purposes, for example, potable water intakes that have been replaced by a connection to another source of potable water e.g. the municipal water system. Irrigation Damage may be caused to irrigated vegetables if irrigation waters are treated with Alligare Fluridone Granule. There is a greater chance of injuring crops when water treated with this product is applied to soil with low organic content or soil with a high sand content. In order to minimize the risk of damage, applicators must follow the assay directions and time frames in the table below: 3

Do not use water treated with Alligare Fluridone Granule in these areas if the concentration of active ingredient (fluridone) is greater than 5 ppb. Consultation with an aquatic specialist is recommended before irrigating these sites. If the result of an AquaScout assay determine that the concentration of active ingredient (fluridone) is greater than 5 ppb, do not use that water source to irrigate plants within the Solanaceae family e.g. tomatoes, peppers, tobacco. Members of the Solanaceae family must not be planted in land that has been irrigated with water treated with fluridone concentrations of greater than 5 ppb. Consultation with an aquatic specialist is recommended before irrigating these sites. ** If water treated with Alligare Fluridone Granule is to be used prior to the to the time frame detailed in the table above, applicators must carry out an AquaScout assay to determine the concentration of active ingredient (fluridone) in the water. Where the concentration of active ingredient is less than 10 ppb there are no irrigation precautions/time frames for watering established row crops, established tree crops or established turf. *** For the purposes of applying this product, a pond is a body of water of 10 acres or less. **** For the purposes of applying this product, a lake/reservoir is a body of water of greater than 10 acres. Where one half or more of the lake/reservoir has been treated with this product, use the time frame specified above for ponds and static canals. PLANT CONTROL INFORMATION The following categories are used to describe the expected efficacy of Alligare Fluridone Granule when applied using maximum label rates in ideal application conditions: controlled partially controlled not controlled (i.e. tolerant of Alligare Fluridone Granule) If Alligare Fluridone Granule is applied using lower application rates, the number of plants listed as partially controlled or controlled will increase. The control of aquatic plants can also be categorized as controlled, partially controlled or not controlled (i.e. tolerant of Alligare Fluridone Granule). Before applying this product, in order to determine the tolerance or susceptibility to Alligare Fluridone Granule of a plant, consult an aquatic specialist. IMPORTANT: Algae are not controlled by this product (nitella, filamentous and chara species) 4

Once species have been identified, determine their susceptibility/tolerance to Alligare Fluridone Granule. In order to determine the correct application rate, calculate the surface area (in acres) that you wish to treat, and the average depth of the water (in feet). Applicators MUST NOT exceed the maximum rate in this label for any treated area in an annual growth cycle. Applications to Ponds The whole surface area of a pond may be treated with this product. For a single application of Alligare Fluridone Granule, select an application rate that will provide a concentration of 30 to 90 ppb in treated water (see table below). Due to the slow release formulation of Alligare Fluridone Granule, actual concentrations in treated water maybe lower at any point. Where dilution of the water to be treated is foreseen, multiple applications may be used. The total of all applications in an annual growth cycle should be 30 to 90 ppb and MUST NOT exceed 90 ppb. Use higher application rates: Where there is a dense weed mass in the area to be treated Where there are species which are difficult to control In ponds less than 5 acres in surface area and an average depth of less than 4 feet Lower application rates may be selected where the applicator requires selective control for sensitive target plants. Refer to the table below for application rates to achieve the appropriate concentration. 6

Application to Lakes and Reservoirs When applying Alligare Fluridone Granule to reservoirs and partial lakes, for optimal results, the treatment area should be 5 acres or more. Applying this product to smaller areas (i.e. less than 5 acres) or to narrow areas (e.g. shorelines or boat lanes) may result in sub-optimal results due to the dilution of treated water by untreated water. IMPORTANT: In reservoirs or lakes, when applying this product within 0.25 miles of a potable water intake, a single application MUST NOT exceed 20 ppb, and the total of applications in a yearly growth cycle MUST NOT exceed 150 ppb. The treatment methods below may be used as a method of application for whole or partial reservoirs or lakes. Ranges of rates of application are provided in order to deal with environmental factors, such as: plant susceptibility selectivity target species aquatic plant management objectives Applicators must select the most appropriate application rate and application method in order to meet specific aquatic plant management objectives. Whole Lakes / Reservoirs with Limited or No Water Discharge Treatment Method 1: Single Application to Whole Lakes/Reservoirs See the Method of Calculation of Application Rate: Lakes, Reservoirs and Ponds section for specific application rate calculation. When applying a single treatment to a whole lake/reservoir, use an application rate of 16 to 90 ppb. In order to achieve the desired concentration, use the table below. Select a rate from the table that will best meet plant management objectives. Choose a lower application rate in the range where greater plant selectivity is required e.g. for the control of curlyleaf pondweed and Eurasian watermilfoil. When controlling other species, it is the recommendation of Alligare, LLC that an aquatic specialist is consulted in order to determine when lower application rates should be used to meet plant management objectives. When dealing with: difficult to control species 7

8 dilution caused by heavy rainfall an area which is densely weeded use the higher rate within the range. When dealing with these plants/conditions, split/multiple applications may be required. IMPORTANT: The total of all applications in an annual growth cycle MUST NOT exceed 150 ppb. See Treatment Method 2: Split/Multiple Applications to Whole Lakes/Reservoirs, for instructions and maximum application rates. Where split/multiple applications are used, apply Alligare Fluridone Granule at lower rates in the rate range i.e. 16 to 75 ppb. Choose a lower application rate in the range where greater plant selectivity is required e.g. for the control of curlyleaf pondweed and Eurasian watermilfoil. When controlling other species, it is recommended that an aquatic specialist is consulted in order to determine when lower application rates should be used in order to meet plant management objectives. IMPORTANT: The total of all applications in an annual growth cycle MUST NOT exceed 150 ppb. Treatment of Partial Lakes/Reservoirs Split/multiple applications may be required where dilution of this product by untreated water is likely to occur, e.g. when treating part of a reservoir or lake. In such circumstances, split/multiple applications may be used in order to prolong the contact time of targeted plants with the active ingredient (fluridone). 8

9 The nature of the area to be treated with Alligare Fluridone Granule will dictate the required rate and frequency of application. For example, where greater dilution by untreated waters is predicted, apply Alligare Fluridone Granule at a higher rate in the range of rates. Treatment Method 3: For Areas More Than 0.25 Miles from a Functioning Potable Water Intake IMPORTANT: former potable water intakes which are no longer used are not considered functioning potable water intakes for these purposes, for example, potable water intakes that have been replaced by a connection to another source of potable water e.g. the municipal water system. For single applications, apply Alligare Fluridone Granule at an application rate of 45 to150 ppb when treating with this product as a single application. Use split/multiple applications in order to sustain the required concentration of active ingredient for 45 days or longer. It is recommended that AquaScout is used in order to ensure that the required concentration is maintained. IMPORTANT: When using split/multiple applications, the total of all applications in an annual growth cycle MUST NOT exceed 150 ppb. Treatment Method 4: For Areas within 0.25 Miles of a Functioning Potable Water Intake A single application MUST NOT exceed 20 ppb in areas treated with Alligare Fluridone Granule that are less than 0.25 miles from a potable water intake. If applicators use split/multiple applications on areas which have a potable water intake, use an AquaScout test to determine the concentration of active ingredient (fluridone) in the water. IMPORTANT: When using split/multiple applications, the total of all applications in an annual growth cycle MUST NOT exceed 150 ppb. Method of Calculation of Application Rate: Lakes, Reservoirs and Ponds (Average depth of water (in feet) of area to be treated) (Required concentration (in ppb) of active ingredient) = Amount of Alligare Fluridone Granule to be applied per acre of surface area (in pounds) Example: to provide a concentration of 20 ppb in water with an average depth of 8 feet: Ave depth: 8 feet Required concentration: 20 ppb = 8.6 pounds of Alligare Fluridone Granule per acre of surface area IMPORTANT: Calculated rates MUST NOT exceed maximum rates listed in site specific application rate tables. Treatment of Irrigation Canals, Drainage Canals and Rivers Static Drainage and Static Irrigation Canals: apply this product at the rate of 20 to 40 pounds per surface acre. Rivers or Static or Moving Water Canals Containing a Functioning Potable Water Intake: apply Alligare Fluridone Granule as follows: In treating a static or moving water canal or river which contains a functioning potable water intake: 1. Applications greater than 20 ppb must be made more than ¼ mile from a functioning potable water intake 9

Applications less than 20 ppb may be applied within ¼ mile from a functioning potable water intake; however, if applications are made within ¼ mile from a functioning water intake, the AquaScout test must show that the concentration of active ingredient (fluridone) in the treated water does not exceed 150 ppb at the potable water intake. Rivers and Moving Water Canals: apply Alligare Fluridone Granule as follows: Alligare Fluridone Granule will perform better if the water flow can be restricted. In slow moving bodies of water, use an application technique that maintains a concentration of 10 to 40 ppb in the applied area for a minimum of 45 days. Alligare Fluridone Granule can be applied by split or multiple broadcast applications or by metering in the product to provide a uniform concentration of the herbicide based upon the flow pattern. The use of an AquaScout test is recommended to maintain the desired concentration in the target area over time. Method of Calculation of Application Rate: Drainage Canals, Irrigation Canals and Rivers Step 1: Average flow rate (in feet per second) Average width (in feet) = Cubic feet per second (CFS) Average Depth (in feet) 0.9 Step 2: CFS = Water movement in acre feet per day 1.98 Step 3: Acre feet per day Required ppb = Alligare Fluridone Granule to be applied per day (in pounds) STORAGE AND DISPOSAL Do not contaminate water, food or feed by storage or disposal. PESTICIDE STORAGE: Store in original container only. Do not store near feed or foodstuffs. In case of spill, contain material and dispose as waste. PESTICIDE DISPOSAL: Wastes resulting from use of this product may be used according to label directions or disposed of at an approved waste disposal facility. CONTAINER HANDLING: Nonrefillable container. Do not reuse or refill this container. Triple rinse container (or equivalent) promptly after emptying. Triple rinse as follows: Empty the remaining contents into application equipment or a mix tank. Fill the container ¼ full with water and recap. Shake for 10 seconds. Pour rinsate into application equipment or a mix tank or store rinsate for later use or disposal. Drain for 10 seconds after the flow begins to drip. Repeat this procedure two more times. Then offer for recycling if available or puncture and dispose of in a sanitary landfill, or by incineration, or, if allowed by state and local authorities, by burning. If burned, stay out of smoke. CONDITION OF SALE AND LIMITATION OF WARRANTY AND LIABILITY To the extent consistent with applicable law, upon purchase or use of this product, purchaser and user agree to the following terms: Warranty: Alligare, LLC (the Company) warrants that this product conforms to the chemical description on the label in all material respects and is reasonably fit for the purpose referred to in the directions for 10

11 use, subject to the exceptions noted below, which are beyond the Company s control. To the extent consistent with applicable law, the Company makes no other representation or warranty, express or implied, concerning the product, including no implied warranty of merchantability or fitness for a particular purpose. To the extent consistent with applicable law, no such warranty shall be implied by law, and no agent or representative is authorized to make any such warranty on the Company s behalf. Terms of Sale: The Company s directions for use of this product must be followed carefully. It is impossible to eliminate all risks inherently associated with use of this product. Crop injury, ineffectiveness or other unintended consequences may result because of such factors as weather conditions, presence of other materials, and the manner of use or application (including failure to adhere to label directions), all of which are beyond the Company s control. To the extent consistent with applicable law, all such risks are assumed by the user. Limitation of Liability: To the extent consistent with applicable law, the exclusive remedy against the Company for any cause of action relating to the handling or use of this product is a claim for damages, and in no event shall damages or any other recovery of any kind exceed the price of the product which caused the alleged loss, damage, injury or other claim. To the extent consistent with applicable law, under no circumstances shall the Company be liable for any special, indirect, incidental or consequential damages of any kind, including loss of profits or income. Some states do not allow the exclusion or limitation of incidental or consequential damages. The Company and the seller offer this product, and the purchaser and user accept this product, subject to the foregoing warranty, terms of sale and limitation of liability, which may be varied or modified only by an agreement in writing signed on behalf of the Company by an authorized representative.
