Ltd. operates the Hythe Sour Gas plant and contravened the Approval by exceeding the SO2 limit set out in Table 4.1.3B and failing to immediately report the exceedance. Sturgeon County NW W4 10-Sep-07 Assessed: $6, (1)(h) 142(1)(e) Sureway Construction Ltd. was issued licences for the temporary diversion of water from Kirk Lake. The Company contravened the licences by withdrawing water in excess of the total amount permitted under Temporary Diversion Licences; conducting an activity in a watercourse without an Approval; and the failure to immediately report a contravention of the terms of the Approval. Stony Plain Plan , Block 1, Lot 14ER 07-Sep-07 36(1) 142(1)(h) The Town of Stony Plain is the registered owner of lands in which the Company is developing a light industrial park on adjacent property. Alberta Environment attended the site and observed it was in the process of constructing two stormwater ponds including excavating an area along the Tributary to allow water to flow to the lower reaches of Atim Creek, and removal of all the vegetation and surface material within the open excavation. This Construction has damaged the Tributary and the aquatic environment in this waterbody, including changing the level, location and flow of the water and causing siltation to downstream areas. Remedial works are required to remove the Works to restore the natural topography of the bed and shore of the Tributary and to restore the natural drainage pattern in the Tributary and to downstream areas. The Company commenced or continued an activity without the proper authorization and shall immediately cease any further construction, operation or maintenance of the Works; submit and implement a Remedial Plan; and submit a Final Report. Suncor Energy Inc. MD of Wood Buffalo 93-7-W W W W W W W W W W W W W W W4 21-Sep-07 The Company operates the Firebag Enhanced Recovery In-Situ Oil Sands or Heavy Oil Processing Plant and Oil Production Site pursuant to an Approval. It contravened its approval by emitting effluent streams to the atmosphere from sources such as tanks, containing produced water, the production sales tank, the skim tanks, and the skimmed oil tanks. It has continuously vented produced gas containing hydrogen sulphide to the atmosphere from various tanks contained produced water with no vapour recovery unit pollution control equipment ever installed. There have been a number of instances where the measured values of H2S in the ambient air at a stationary air monitoring station exceeded the Alberta Ambient Air Quality Objectives. The Company shall submit and implement an Interim Action Plan; submit and implement the Comprehensive Action Plan; provide written status reports; commission a third party Environmental Management System Audit; submit a Schedule of Implementation for the Environmental Management System Audit; and conduct the Environmental Management System Audit. 5 Environmental Protection Orders Syncrude Canada Ltd MD of Wood Buffalo W4 27-Aug The Company operates the Mildred Lake Oil Sands processing plant pursuant to an Approval. On many occasions the hydrogen sulphide (H2S) alarms located near the effluent pond have sounded, indicating a release of H2S to the atmosphere. Alberta Environment ("AENV") received various types of odour complaints. The Company sent sour water containing H2S concentrations from 592 ppm to 1720 ppm to the effluent pond on several occasions, and indicated the effluent pond is a likely source of ammonia releases and may be linked to the odour complaints. It has exceeded the Alberta Ambient Air Quality Objective for both H2S and ammonia and AENV is of the opinion that releases of H2S and ammonia into the environment may have caused or may cause an adverse effect. It shall develop, submit, and implement a plan that details the steps to be taken to minimize inputs and emissions into and from the effluent pond; and submit written progress reports. Page 5 of 10

Donna & John Crozier Limited Edmonton Plan , Block 2, Lot 3 07-Aug /96 18 The Company failed to have adequate storage for hazardous recyclables. The potential existed in a release event for the hazardous recyclables to make it to a storm drain located nearby. Degussa Canada Inc. Gibbons SE W4 16-Aug-07 The Company operates the Gibbons Hydrogen Peroxide Manufacturing Plant pursuant to an Approval.
