2 Transposition of the Directive In order to harmonize regulations, the Republic of Serbia will have obligations in terms of transposition of EU legislation into national regulations Sewage Sludge Directive requirements have not yet been transposed into national legislation 2

3 Transposition framework and status Terms (definitions) and provisions from article , related to Directive may be transposed through: - Water Law - Law on Agriculture Soil - Waste Management Act - Law on Environmental Protection Usage of the sewage sludge in agriculture is not yet defined in Serbian national legislation dealing with fertilizers. 3

4 Anex I i II -Regulation on Systematic Soil Quality Monitoring Program, Indicators for Assessment of Risk of Soil Degradation, and Methodology for Preparation of the Program for Systematically Monitoring of Soil Quality, Indicators for Risk Assessment on Soil Degradation -Methodology for Preparation of Remediation Program -Regulations of permitted amounts of hazardous and harmful substances in soil and water for irrigation and methods of their analysis are prescribed maximum allowable quantities of hazardous and harmful substances 4

5 Law on the land as a natural resource is currently under preparation Transposition gaps -The other requirements of Directive have not been transposed into regulations (especially obligations of Member States) Transposition gaps may be in institutional and legislative framework and financial situation BRUSSELS, NOVEMBER

6 Transposition plan and timelines Competent institutions will decide on the way of transposition of Directive. Transposition will be fulfilled through sets of amendments on the existing regulations listed above. Serbia will have to establish realistic deadlines for full compliance - Full transposition of the Directive is expected by

10 Implementation Implementation GAPS Main steps in implementation: - Assessment of the current situation - Institutional capacity - Establish monitoring program (Directorate for Agriculture Land will prepare) -Establish Code of Good Agricultural Practice -Establish action program -Establish a reporting function Special attention will be given to inter-sectoral jurisdiction in order to avoid overlapping 10

11 Implementation From Directive, main focus in implementation: Having in mind that the produced sewage sludge is stored and disposed in Serbia, when allowed to be used for agriculture, sludge should be properly used to prevent and avoid impact on the soil, vegetation, animals and people 11

12 Sum-up - key messages - Directive requirements have not yet been transposed into national legislation - Implementation of the directive should be adjusted to the situation and needs of the treated soil through the amendments or modification of national legislation - Implementation structures has to be strengthen at the national and local levels - Financing resources for the full implementation should be secured. - Training and information to public companies that collect sewage sludge and farmers is important 12
